The phase in transition period is 30 days and the Phase-out transition period is 30 days as per Section L of the solicitation of the RFP. Gov’t Response: This solicitation is a commercial procurement on the SF1449 and therefore the Uniform Contract Format does not apply. The government has included the following information in Clause 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) to further clarify documentation requirements for the proposal evaluation.

L.1 DOCUMENTATION REQUIREMENTS FOR PROPOSALS

General Information: The technical and price proposals shall be submitted in two (2) separate three-ring binders, tabbed appropriately, and must include a cover page with the name of the prime contractor, addresses, phone and fax numbers, email addresses, solicitation number, and point of contact. Binders must be marked as “Volume 1:

Technical Proposal” and “Volume 2: Price Proposal”. Should there be a discrepancy between paper and electronic information, the paper copies shall govern.

Team Arrangements: FAR 9.6 defines contractor team arrangements. Team arrangements mean: (1) two or more companies form a partnership or joint venture to act as a potential prime contractor or (2) a potential prime contractor agrees with one or more other companies to have them act as its subcontractor under a specified Government contract or acquisition program.

All offerors proposing a partnership, joint venture, other teaming arrangement, or resource of a parent company/subsidiary/affiliate shall submit the following information in the front of the technical and price proposals:

b. Volume 2: Price Proposal - Submit one (1) original and two (2) copies of the price proposal in a three ring binder. Submit on two (2) CDs, a complete copy of the price proposal. Documents should be in Microsoft Word or Excel. Please do not submit Adobe Acrobat files.

L.3 VOLUME 1: TECHNICAL PROPOSAL

A. BASIS FOR AWARD

The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest price technically acceptable proposal.

As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

The LPTA process selected as appropriate for this acquisition because the best value expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

The number of proposals evaluated for technical acceptability shall be limited to the three lowest priced offerors. If the selected proposals are not found to be technically acceptable within the first three proposals, then the next lowest priced offerors proposal evaluated. The evaluation process described above will be conducted again as many times as necessary, until the Government identifies technically acceptable proposals.

9. In an effort to make the procurement balanced and fair, would the government reconsider the requirement for Resumes and Letters of Commitment for each position on the contract? Only the incumbent has access to the existing personnel without disrupting current operations and Executive Order 13495 requires incumbents right-of-first-refusal limiting the use of other personnel.

Gov’t Response: The government will remove the requirement for resumes and commitment letters as basis of evaluation criteria for Factor 1 Techincal & Management approach. However, it will retain it as part of the award requirement to be provided 15 days after award.

10. Would the Government consider lowering the threshold for similar size projects to $4 million per year from $6 million per year?

Gov’t Response: No, the procurement is based on the current requirements.

11. Would the Government provide copies of the CBA’s associated with personnel working in the Washington, DC and Virginia locations?

Gov’t response: See question 6 and 7 for government responses to question 11 above.

12. Do any of the jurisdictions require a gross receipts or similar tax on guard services?

Gov’t Response: Clauses 52.229-1 (State and local taxes) speaks to what is required by the USG as to state and local taxes. The awardee will invoice the USG separately, excluding taxes. The USG should provide notice to prospective that evidence of exemption should be provided to the state / local tax authority, using available means to establish the exemption. (see FAR 29.305).

13. Are weapons required to be stored on-site for this requirement?

Gov’t Response: See government response to question #157 above.

14. Can you provide the Attachments containing CBA 2017-9636?

Gov’t Response: See government response to question #7.

15. One of the site on this solicitation is for FCL of Top Secret. Would the Navy consider awarding a contract and sponsor up to TS?

Gov’t Response: No, see government response to question #1.

16. Can the Government please provide the number of TAS & ESS hours performed in each of the last three years?

Gov’t Response: Refer to page 188, Attachment J-0401060-14 Post Manning Requirements Summary Hours of Operation are based on 365 Days per year (366 days in leap year). Figures in the “Typical Weekly Hours” column are based on no holidays in the week. Increases in Force Protection Conditions (FPCON) above the designated baseline funding levels below may require realigning of contract aggregate Recurring/Firm Fixed Price (FFP) post labor hours to accommodate pre-planned and exigent actions, but will not result in additional aggregate labor hours. Upon request by the Contracting Officer, the Contractor shall work closely with the Regional or Installation Security Officer after contract award to incorporate in the contract by modification realigned Recurring/FFP labor for higher FPCONs. Also, some Non- Recurring/Indefinite Delivery Indefinite Quantity (IDIQ) work items may be used to obtain services to operate under increases in FPCON.

17. We would like to schedule a site visit. Would the Government advise what dates are available and the process for scheduling the visit?

Gov’t Response: The government has determined there will be no schedule site visit for this solicitation.

18. The RFP states “Project Data Sheet (Attachment C) is MANDATORY and used to submit project information.”The RFP later states “If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment C), which will provide contract and client information for the respective project(s).” Can you please clarify which is correct? Is Attachment C the Project Data Sheet or is it the PPQ? Can you also provide the correct “Project Data Sheet”?

Gov’t Response: Both are correct. The PPQ Attachment C is included as external attachment to solicitation N4008019R0309 loaded to FBO on 29 July 2019 which was titled J-0200000-05 Past Performance Questionaire (PPQ) for N4008019R0309. The same attachment reattached to this amendment and the page titled Attachment C is in RED.

19. Is there a security clearance requirement for this solicitation? The DD254 does not specify.

Gov’t Response: See government response to question #1 above.

20. Transition Plan: Factor 1 (Paragraph A, pg. 199) of the Evaluation Factor section, indicates the Phase in Timeline is 30 days. Paragraph B.21 indicates the transition timeline is 60 days. Please advise which is correct.

Gov’t Response: Paragraph B.21 on page 6 of solicitation has been corrected to read 30 days for phase in period to match Paragraph A, Page 199 30 day phase in timeline.

21. Corporate Experience: The Evaluation Section requires us to us the Project Data Sheet (Attachment C) to submit project information. There is no Project Data Sheet.

Gov’t response: The PPQ Attachment C is included as external attachment to solicitation N4008019R0309 loaded to FBO on 29 July 2019 which was titled J-0200000-05 Past Performance Questionaire (PPQ) for N4008019R0309. The same attachment reattached to this amendment and the page titled Attachment C is in RED.

22. Work Management: The solicitation requires:

Provide diagrams showing the proposed organization and Workforce Project Management plan including overall level of effort identifying direct labor hours by trade assigned to major task in the proposed project plan. Provide a short rationale for the direct labor hours consistent with the technical approach. Offeror to indicate number of productive hours per week of year for each full time and part time employee.

With the solicitation dictating direct labor hours to offerors, what is the government requesting?

Gov’t response: The government is not dictating the management, supervision, quality control and/or safety management of this procurement. Please provide the necessary information requested in Factor 1 on page 199.

23. Key Personnel: Please confirm the requirement to provide certificates, documentation and Letters of Commitment for each Guard I and II.

Gov’t Response: See government response in question #9 above.

24. Govt provided pricing schedules J-0200000-08, allows hrly rate input by ELIN for Base year only. Follow-on year’s hourly rates are calculated by applying an annual escalation factor to the prior year’s hourly rate. The formula applies to all hourly rates by post. Since we will be able to request a SCA increase for employees covered by WD, are we allowed to enter each Option Year's annual amount separately, without using the global escalation?

Gov’t Response: J-0200000-08 is general template. It is the contractor’s decision to include annual escalation option year and their responsibility to validate calculations in their propose cost estimate. In addition, the SCA is adjusted annually in accordance with FAR 52.222-43. The escalation in the ELIN table should only apply to non-labor categories.

25. Govt Formula errors in file J-0200000-08, on tab Ex A, cell H13 (no formula) and tab Ex E, cell H28 (does not pick up rows 26 & 27.

Gov’t Response: It the contractor’s responsibility to validate calculation formulas in their propose cost estimate.

26. Description of ELINs on pages 8-12 show Recurring and Non-Recurring Medical Waste Removal & Disposal Services? We believe this is a typo.

Gov’t Response: In deed it was a typo and has been corrected for the CLIN Descriptions beginning on page 8 of the solicitation in this amendment.

27. Post Exhibit for NAVSEA Post 11 shows 5 days a week at 18 hours and Sat-Sun for 8 hours, but does not indicate if staffed on holidays? If staffed on holidays, are the post hours 18 hours or 8 hours?

Gov’t Response: Refer to page 122. ATTACHMENT J-0401060-02.1.7

POST ORDERS FOR POST 11 – BUILDING ROVING PATROL, BUILDINGS 104 AND 21

This post is manned 18 hours per day (0600-0000), Monday through Friday, and eight (8) hours per day on Saturdays and Sundays (0800-1600) and excluding Holidays. Guards shall be uniformed, armed, and have a SECRET security clearance.

28. The post hours at CLIN 103 AB for Naval Support Facility Carderock indicates 43 hours a week.

However, calculation shows 45 hours a week (9 hrs day x 5 days a week). Please advise which is correct.

Gov’t Response: 45 hours a week. See revised J-0401060-14 Post Manning Requirements

29. All posts at Naval Support Activity Bethesda are 8.50 hours a day. Does this include an unpaid half hour lunch?

Gov’t Response: Refer to page 191: Hours of Operation for Bethesda.

30. The RFP included 3 WDs. WD 2015-4265, Rev 10, 4/25/19, for Anne Arundel, Baltimore, Baltimore City, Carroll, Harford, Howard counties in MD does not appear to cover any locations. Please confirm which location uses this WD.

Gov’t Response: The WD 2015-4265 Rev 11 included in this amendment is for NRLCBD located on Calvert County Maryland. It is to be utilized for all other labor categories that may be required at the locality except for the categories listed in CBA 2019-12622.

31. The RFP requires all guards, whether armed or unarmed, to be weapons qualified. According to J- 0401060, Training Requirements updated, unarmed guards, site supervisors and project managers do not need to be firearm qualified. Please confirm which is correct.

Gov’t Response: All guards, whether armed or unarmed, to be weapons qualified. See revised J-0401060- 10 Training Requirements.

32. Page Limitations: The solicitation provides for page limitations on Letters of Commitment and Resumes, but it does not provide a page limitation for the Key Personnel section. Please confirm that there is no page limitation for Key Personnel.

Gov’t Response: This is no longer required. The government will remove the requirement for resumes and commitment letters as basis of evaluation criteria for Factor 1 Technical & Management approach.

However, it will retain it as part of the award requirement to be provided 15 days after award.
