AMENDMENT THREE

CLARIFICATION SPECIFICATION

Bidder(s) Questions/Answers 14-29

Question 14

CLIN 002AC requests pricing to provide and install all services required to accomplish the requirements of the task order (within 60 mile radius of Mayport Naval Station, at contractor facility). Due to a variety of unknown cost factors for basic services, security requirements, unknown travel costs, unknown safety/environmental requirements, unknown work site/berthing requirements and unknown insurance and liability requirements, request the government provide which contractor (or government) facilities the barge may be moored at (it should be noted that when berthing barges accompany a ship into a contractor/plant facility that these temporary service items are usually included in a separate work item included in the ship’s repair package). Without exact contractor facility identification, this CLIN will be difficult to estimate.

Answer:

Work will occur at the Mayport Naval Station, BAE dry dock, or North Florida Shipyard dry dock. The temporary service items are usually included in a separate work item included in the ship’s repair package

Question 15

Several CLINs (0001AB, 0001AD, 0001AF, 0003AC, 0003AF) request pricing information for an APL class berthing barge. The sizes and characteristics of the APL class vary depending on which barge is actually assigned.

In order to provide accurate pricing, request provide the APL barge number(s) and the physical characteristics

(length, width, height, waterline to highest structure, displacement, temporary service requirements, capacity:

officer/CPO/enlisted, etc.) for each APL class barge expected to be covered under this contract.

The APL Class expected is the APL 29 Class.

Question 16

Paragraph C.8.1 on page 12 of the solicitation (Amendment 0001) CLIN AE-AF states; “Remove barges from

Mayport Basin, relocate and secure in safe shelter when directed by the SUPERVISOR after hurricane condition II is set.”

Please provide clarification as to the definition of “safe shelter” so offerors can accurately identify regulatory and/or property owners within the defined zone in order to obtain the required pricing and evidence of permission required by the RFP.

The “safe shelter” is being removed from Paragraph C.8.1 under the SOW. A revised SOW will be provided on a future Amendment.

Question 17

The answer provided to Bidder’s Question 001 may need to be reconsidered based on the following. The requirement for submitting a firm price for a one-way, up to 1400 mile ocean tow for CLINs 0001AC and 0001AD will be substantial as the tow CLIN prices must reflect the maximum distance the barge will be towed.

Since a key element of Contract Award is based on price as well as past performance, providing a price for a lengthy tow that may not ever be executed is of concern. As stated in previously submitted Bidder’s Question 001, all past tows have been limited to approximately 700 miles based on tows executed to and from Mayport, FL to Norfolk, VA.

Request reconsiders reducing the 1400 mile tow requirement to a 700 mile tow requirement. This will substantially reduce the pricing for these CLINs.

SERMC has reconsidered the 1400 mile tow requirement and agrees to reduce to a 700 mile tow requirement. A revised SOW and ELINS will be provided on a future Amendment.

Question 18

A. Requirement: CLINs OOOIAE and OOOIAF require "shelter barges from hurricane". The solicitation, page

157, paragraph 4, subparagraph 25, requires a "mooring plan and a letter of permission by a regulatory and/or property owner (if applicable) to use a safe harbor location".

B. Background: Recent discussions with the Jacksonville Port Authority (JPA) officials disclosed the Navy has in place a standing Memorandum of Understanding and an annual contract (currently funded) to lease 1,700 ft of sheltered berth/pier space up-river at the JPA Talleyrand docks. This Navy contract includes the required liability insurance coverage and indemnification from damage or loss. The JPA indicated they will not enter into any additional temporary mooring/safe harbor contracts while the current contract is in effect.

C. Attempts to find suitable/available up-river safe harbor mooring/berthing that meet the requirements of the solicitation have been unsuccessful.

1. Given the fact that local safe harbor mooring/berthing is already in place, and contracted and funded by the Navy, request the safe harbor berthing requirements be deleted from the solicitation and CLIN sheets. This will save the government from having to fund this requirement twice.

2. If the safe harbor requirement remains in the solicitation, request the government define the requirement for "safe harbor berthing barge mooring/berthing". This definition should include: what is an adequate safe harbor location, minimum/maximum distance up-river, proximity to physical navigation objects, such as bridges, causeways, railroad bridges, etc. Height restrictions are a limiting factor.

3. Will the government provide the required release from liability and letter of release and indemnification from damage or loss and barge/facility security requirements?

4. It should be noted that in the past, the Navy has made arrangements for and has been responsible for, up-river safe harbor mooring/berthing of ships and craft from Naval Station Mayport. Shifting this responsibility to a private contractor can be very costly and will result in a variety of legal, inability and security issues which must be defined and resolved prior to contract award.

5. If additional information and discussion is required concerning this issue, recommend a bidder’s conference be held to resolve these issues.

The “safe shelter” is being removed from Paragraph C.8.1 under the SOW. A revised SOW will be provided on a future Amendment.

Question 19

Item 24 of the Pre-award Data request contractors that are working at a site where there is not a MSR, ABR or

Remote Site Plan to submit information. May those with an ABR and approved site plan submit approval letters for this item?

Yes

Question 20

CLIN numbers 0001AE and 0001AF request the contractor to provide an upriver safe harbor shelter for barges when hurricane conditions are set. Will the government, as a precaution, require a stand-by tugboat to be present while the berthing barges are at the safe harbor shelter location?

Whether or not a stand-by tug will be required affects pricing for the berthing barge safe harbor shelter CLINs.

A stand-by tug, once the barge is towed to a specified location, will not be required.

Question 21

Pg. 100: 0013AH calls out 009-32 Table - 3 Line- 4, 5,5A or 6.

Pg. 94: Identifies 009-32 FY14 CH1:

009-32 CH-1 Cleaning and Painting Requirements; accomplish 07 NOV 2013

There is no line 5A in table -3 FY 14 CH-1, 009-32.

Please advise.

Below please find revised wording for ELIN 0013AG and 0013AH. STD Items FY14 CH-1 changed line number from 5A to 6 in ELIN 0013AH and changed Line 7 to 8 in ELIN 0013AG.

0013AG Interior preservation (In accordance with 009-32, Table 3, Line 8)

0013AH Interior preservation (Wet Spaces in accordance with 009-32, Table 3, Line 4, 5, 6, or 7)

A revised SOW/ELINS will be provided on the next Amendment.

Question 22

For what percentage of availabilities does the government anticipate requiring performance at the contractor’s facility versus on the Naval Base? And, how much availability is anticipated during a typical year?

It is not a requirement for the Contractor to perform availabilities at another facility other than the need for docking.

At this time we have no requirement for docking in the upcoming year. During the past contracts there have been approximately three availabilities for each of three barges, usually one maintenance period and two to three additional for support and maintenance during ship’s crew aboard.

Question 23

QUESTION NO: 4, submitted on March 7, 2014 requesting clarification of definition of “safe shelter” so offerors can accurately identify providers has not yet been answered.

QUESTION NO: 5, submitted on March 11, 2014 requesting clarification on missing line 5A in table -3 FY14 CH-

1,009-32 has not yet been answered.

Especially with regard to the “safe harbor” clarification/definition, insufficient time remains prior to the current closing date of 3/24 to allow contractors to identify potential partners within the defined zone and negotiate terms for use of the required mooring location. Accordingly we respectfully request a two week extension of the closing date to 4/7/2014.

Proposals will be extended to 16 May 2014. The “safe shelter” is being removed from Paragraph C.8.1 under the

SOW. A revised SOW will be provided on a future Amendment.

Question 24

RMC L-2-0009 GOVERNMENT FURNISHED FACILITIES AND EQUIPMENT, (a) states: “The Government will provide for use in connection with and under the terms of this contract the following: (b) (1) Access to the vessel at: Naval Station Mayport”

Question: Will all “availabilities” be accomplished pier side at Naval Station Mayport, or must offerors show evidence of access to a commercial pier at which to perform “availabilities”?

In accordance with paragraph C.1.7 of the SOW, "under normal conditions, work shall be accomplished within a 60 miles radius of Mayport Naval Station, Jacksonville, FL." Non-docking work is typically performed at Mayport

Naval Station, Jacksonville, FL.

Question 25

If ELINs 0001AA-AF, 1001AE-AF, 2001AE-AF, 3001AE-AF, OR 4001AE-AF are invoked on any task order, will

ELINS 0001AA-AD, 1001AA-AD, 2001AA-AD, 3001AA-AD, OR 4001AA-AD, AND 0002AA-AG, 1002AA-

AG, 2002AA-AG, 3002AA-AG, OR 4002AA-AG respectively also be invoked, or will the cost of these requirements need to be included in ELINS 0001AE-AF, 1001AE-AF, 2001AE-AF, 3001AE-AF, OR 4001AE-AF?

Please clarify.

Per recent agreement across the base, AE and AF are deleted. A new scope of work be provided in future

Amendment.

Question 26

ELINS 0013AC-AD, 1013AC-AD, 2013AC-AD, 3013AC-AD, AND 4013AC-AD require contractor to near white metal blast or water jet and paint exterior surfaces above the boot top. How is this supposed to be accomplished with the vessels being waterborne/pier side with respect to containment and water contamination prevention? Please clarify.

These CLINs will only be invoked during docking availabilities.

Question 27

What cost values is the contractor supposed to enter in ELINS 0017AA, 1017AA, 2017AA, 3017AA, AND

4017AA? The government has already entered a dollar value in the est. qty column. Are we supposed to offer a percent mark-up in the unit price column? Please clarify.

A revised ELINS will be provided in a future Amendment.

Question 28

By having values entered into the unit price column for ELINS 0016AA-AC, 1016AA-AC, 2016AA-AC, 3016AA-

AC, and 4016AA-AC, is the government trying to dictate what the contractor can offer for pricing for these efforts?

This highly unusual. Please clarify.

No, changes to the ELINS spreadsheet will be provided in a future amendment.

Question 29

Based on the description of work for ELINS 0002AC, 1002AC, 2002AC, 3002AC, and 4002AC, is the contractor required to have waterfront facilities for the accomplishment of any work required by this solicitation? i.e. – will the contractor have to take the barges from Mayport Naval Station to a waterfront facility within a 60 mile radius of

Mayport naval station to accomplish maintenance and repairs? Please clarify.

The 60 mile radius includes Mayport. This exists, for example, in case barge is accompanying a ship at another facility within 60 miles.
