NOTE A - TRAVEL COSTS

Travel costs are not fee-bearing costs under this contract*. The Contractor shall obtain prior written approval by the Contracting Officer per trip occurrence. Travel shall be funded under a task order with separate SLIN under each CLIN. All estimated and incurred travel costs shall be in accordance with FAR 31.205-46.

*This is applicable to the Prime contractor in support of the cost-reimbursable CLINs and all cost-reimbursable subcontractors.

NOTE B – SCHEDULE OF PRICES / RATES: SHIP REPAIR LABOR RATE (FULLY BURDENED) IN

SUPPORT OF PERFORMANCE WORK STATEMENT (PWS) 4.5 AND CLINS 0004, 1004.

1. The Contractor’s fully burdened ship repair labor rate will be used for negotiating ship repair work to be performed under this contract per PWS 4.5 and CLINs 0004 and 1004. The contractor agrees that the number of hours included in its price proposal for the orders shall include only direct production hours. For these purposes, direct production hours are for skilled labor at the journeyman level expended in direct production in support of

PWS 4.5.

2. The fully burdened ship repair labor rate is a fixed hourly rate that includes all wages, overhead, all other indirect costs, general and administrative expenses, Facilities Capital Cost of Money (FCCOM) and profit. The fully burdened vessel modification labor rate represents a blended rate including labor transferred between divisions, subsidiaries, or affiliates of the contractor under a common control.

3. Consumable materials are goods used in the ordinary course of work performance such as office supplies, paper, rags, vehicle or equipment fuel costs, cleaning chemicals, disposable tools, welding rods, paint buckets, paint brushes, protective clothing, etc. that are consumed/used in the process of repair and do not become an integral part of the repaired vessel. Consumable material shall be included in the contractor’s fully burdened ship repair labor rate and not separately priced.

5. Physical materials are goods that become an integral part of the repaired vessel in the course of the repair, such as equipment, replacement steel, pipes, paint, and fasteners. The material burden rates apply to physical materials but not to consumable materials. The material burden rate will be applied to the actual cost of the physical material.

Actual cost does not include handling charges, general and administrative cost, overhead, profit, or any other indirect cost.

6. For contract changes involving subcontractors, subcontractor quotes will be treated as Other Direct Costs (ODCs) and will be subject to the contract material burden rate shown in paragraph (7) below. Subcontractor quotes must be competitively acquired and submitted with the contractor’s proposal in response to Contracting Officer’s request for quote. At no time will the proposed total to be performed by the prime contractor combined with subcontractor quote, material quote, and applicable burdens be allowed to cost more than it would have, had the prime contractor directly provided all material and labor. The proposed total pricing restriction addressed in the preceding sentence does not apply in any case where the work is required to be performed by Original Equipment Manufacturers (OEMs), Government directed subcontractors, Government authorized vendors, or any other work at the sole discretion of the Contracting Officer. Proposals that are subcontracted for material only (no associated labor required) shall not be subject to the Material Burden Rate.

7. The contract fixed fully burdened ship repair labor rate and material burden rate are shown below. These fixed rates shall be used for negotiating the vessel modification work per PWS 4.5.

PERFORMANCE WORK STATEMENT

MATSS HM&E Performance Work Statement

1 Purpose

1.0 Pearl Harbor Naval Shipyard (PHNSY) supports the operation of the Mobile At-sea Sensor System (MATSS) platform. MATSS is home ported at Joint Base Pearl Harbor Hickam (JBPHH), Oahu, HI. The MATSS platform is a towed vessel owned by the Pacific Missile Range Facility (PMRF), which is used to support PMRF at sea testing several times a year.

MATSS is a 256-ft long manned-ocean-going-towed vessel used by PMRF to provide over-the-horizon data collection and range safety operations from remote locations in the Pacific Ocean. The vessel primarily operates in a 1,000 nm radius from Oahu.

The MATSS Hull, Mechanical and Electrical (HM&E) program falls into three broad categories of maintenance, operations, and configuration control. Historically, all of these were accomplished by collaboration between PMRF, Naval Surface Warfare Center Carderock Division (NSWCCD), and the O&M Contractor. Moving forward, it is expected that the Operational and Maintenance (O&M) Contractor shall perform the maintenance and operations tasking with the Government performing configuration control efforts. In recent years, MATSS has come into a normalized DON Technical Authority (TA) construct with PMS 325 Planning Yard (BPY) established as the vessel planning yard and the SEA 05D Technical Warrant Holder (TWH) for Combatant Craft and Boat established as the TWH performing oversight.

1.1 TASK ORDER REQUIREMENTS

Task Orders (TOs) may provide more detailed requirements than those provided in the basic contract award. If a TO does not provide a specific requirement, the terms and conditions of the basic contract shall apply. Each TO Request for Proposal (RFP) will include technical documents such as work specifications, standards, drawings, publications or other documents and performance work statements of work to allow the contractor to prepare proposals.

Whenever specifications, standards, drawings, publications or other documents are cited without issue number, revision, date or amendment number identified, the revision, date or amendment in effect as of the date of the TO issuance shall apply. Wherever specific issue number, revision, date or amendment number for specifications, standards and publications are specified, the issue specified shall apply.

In the execution of this contract, specific references for individual items and associated referenced technical documentation shall be identified in each TO.

1.2 TASK ORDER MODIFICATIONS

Unless a TO specifies otherwise, the following processes shall be strictly followed. Adherence to the process will be assessed and documented, as applicable, in contractor’s past performance evaluations (e.g. CPARS).

1.2.1 IDENTIFICATION OF REQUIRED PARTS AND MATERIALS

The contractor shall immediately identify and report necessary repair parts and materials for the in-port operations and at-sea mission support, maintenance, and repairs that are not provided by the Government and not included in the task orders (CLINs 0005, 1005, 1005 or 1006) to the Technical POCs and the Contracting Officer (KO) or Contracting Officer’s Representative (COR). Material procurement shall not proceed without a TO, TO modification, or Authorization to Proceed from the Contracting Officer.

1.2.2 – IDENTIFICATION OF CONDITION FOUND

The contractor shall identify needed repairs and recommend corrective action during TO performance for work or deficiencies discovered which are not covered by the existing TO to the Technical POCs and the KO/COR. The contractor shall provide the government with a corrective action report that includes the impacts, cost and schedule for the required repairs (REPORT 11). Work shall not proceed without a TO, TO modification, or Authorization to Proceed from the Contracting Officer.
