About this file
This is Amendment 0003 to Solicitation N3220526R6049, issued by MSCRO Norfolk on August 7, 2026, with an effective date of August 7, 2026. The amendment addresses clarifications and responses to offeror questions regarding the procurement of harbor support services and ship handling at Naval Base Guam, Guam, which requires two U.S. flag tugs. Key clarifications include: Jones Act-Qualified Vessels are not required, but U.S. Flag vessels are mandatory and must be crewed and meet all solicitation requirements; vessels must carry valid USCG Certificate of Inspection (COI) documents under USCG Subchapter M, submitted at the time of offer; Attachment 8 is reserved and not included; the government cannot guarantee an award date prior to October 1, 2026, even for newly built tugs with February 28, 2027 delivery dates; all offerors must provide specific documentation and certification at proposal submission for evaluation purposes, with shipbuilder information and as-built drawings alone being insufficient for technical capability determination; the acquisition is full and open competition, therefore no longer eligible as a small business set-aside despite potential small business or HubZone offerors; and award will be made to the responsible offeror whose offer represents the lowest priced, technically acceptable offer. The amendment references Attachment 1 TUGTIME 2026 (6-26) GUAM PROFORMA A0001 for all Performance Work Statement requirements and evaluation factors in Part XI. The contracting officer is Stephanie Ricker, and the hour and date for receipt of offers is not extended. All other terms and conditions of the original solicitation remain unchanged.

SUMMARY OF CHANGES
Block 14 (Description of Amendment/Modification): This Amendment answers additional questions/clarifications submitted as shown below:
Q7: Unfortunately, the Q&A provided [on July 29, 2026] did not necessarily answer the specification question related to Jones Act requirements as applicable, or not, to the Vessels servicing this contract. To be clear, can MSC please advise - Are Jones Act-Qualified Vessels required, or are US Flag, Crewed and otherwise in line with all Vessel requirements deemed suitable?
Response: A0002's correction, posted on 30 July 2026, addressed the above concern about the release of A0001. MSC requests two U.S. flag, tugs to provide harbor support services and ship handling at Naval Base Guam, GU. Tugs and crew should be in line with the requirements as outlined in the Attachment 1 TUGTIME 2026 (6-26) GUAM PROFORMA A0001 Performance Work Statement (Part I) and any other parts of the PROFORMA.
Thus, Jones Act-Qualified Vessels are not required. US Flag vessels are required. Vessels shall be Crewed and otherwise in line with all requirements deemed suitable for this solicitation.
Q8: Do the Vessels need to carry valid USCG Certificate of Inspection documents under Subchapter M or any other USCG Subchapter?
Response: Vessels needs to carry valid USCG Certificate of Inspection (COI) documents under USCG Subchapter M and should be submitted at the time of offer per Attachment 1 TUGTIME 2026 (6-26) GUAM PROFORMA A0001 Part X, Technical Proposal (2), Section 3(b).
Q9: Is there an Attachment #8?
Response: No. Per Attachment 1 TUGTIME 2026 (6-26) GUAM PROFORMA A0001 Part IX, Attachment 8 is marked Reserved
Q10: If the offeror intends to provide newly built tugs with a delivery date of February 28, 2027, would the Government be able to award this contract prior to October 01, 2026?
Response: The Government cannot guarantee an award date.
Q11: If an offeror plans to provide newly built tugs, can the official documentation and certification be submitted after the build is complete? In lieu of immediate certification, the offeror can provide the shipbuilder's name and location, estimated build time, as built drawings, and a list of compliant equipment meeting the vessel's required characteristics. Would this be acceptable for bid consideration?
Response: No, the government requires all Offerors to provide specific documentation at the time of proposal for evaluation purposes to support the award decision. Please refer to Attachment 1 TUGTIME 2026 (6-26) GUAM PROFORMA A0001 Part X Technical Proposal. The items proposed above in lieu of the COI and COD would not be sufficient to be able to find the vessel technically capable for award.
Q12: Does the "Rule for Two" apply on this bid if there are 2 contractors who bid that is Small Business and HubZone? Will the acquisition type change as a result of the rule for 2.
Response: As the acquisition has been determined to be full and open competition as described under the pre-solicitation notice posted on SAM.gov, the acquisition can no longer be a small business set-aside.
Q13: Is this bid based on Best Value or Best Price? How is the offers rated?
Response: Please see Attachment 1 TUGTIME 2026 (6-26) GUAM Proforma A0001 Part XI for all evaluation factors. Award will be made, if at all, to the responsible offeror whose offer represents the lowest priced, technically acceptable offer.
All other terms and conditions remain unchanged.
