SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

CHANGES MADE BY A0004

The responses to the questions presented below constitute an amendment to this solicitation:

1. C-3.3.1 - Does DFARS 252.204-7019 that was issued 9/29/20 and effective 11/30/20 apply?

A: Section C-3.3.1 does not contain a reference to DFARS 252.204-7019. However, DFARS 252.204-7019 has been added into Section I accordingly.

2. C.1.2.3.1 - What make/model/type of ECDIS do each the ships carry?

A: All ships use paper charters, other than the USNS Howard O Lorenzen. The information is specified below.

The hardware is all Sperry.

Product: C-Map Professional+ Region: Zone 0 Expiration Date: 01-06-2020

3. C-1.4.1.1, C-1.7.7.3.a & Line 23 of Training Matrix - Is the requirement for the MPIC for 2 LDO or specifically the CM and 2M?

A: There shall be one M-PIC per ship at all times, which is not required to be the Chief Mate or the Second Mate. Wording adjusted for clarity at section C-1.7.7.3.1. Additionally, language added to same section: “M-PICs shall be licensed officers.”

4. C-1.7.1, C-1.7.1.a - Section C-1.7.1 references a manning scale for ROS and RAV in Table C- 1.7.1.a, but the table does not have those numbers. Please provide.

A: Column added for ROS status for clarity. There is no expectation of any vessel on this contract going into a ROS status at this time. At this time, offerors should not provide any pricing for ROS and RAV statuses. ROS and RAV crew will meet USCG minimum standards and be adapted to meet Host Nation, AT/FP, and mission essential crewing needs. ROS and RAV crew to be determined by the awardee operating company and submitted to MSC program office for approval/funding authorization.

5. Page 74-76 - The Manning Schedules for T-AGOS 23, T-AGM24, T-AGM 25 have manning totals that conflict with the individual billet numbers, making it unclear what actual crewing is required. Please provide corrected Manning Schedules.

A: FOS numbers have been verified and updated to reflect correct total manning numbers and updates from this amendment (See response to question #25). Additionally, the USCG Minimum for the Total Deck Department numbers have been updated to reflect the correct total to include the Master. The updated total sections are updated in the applicable total sections under Section C-1.7.1.a.

6. Reference: RFP page 2, Section B-1.2 - Question: The offeror is required to include the pre-manning familiarization costs for both the shore staff and the ship’s crew in the per diem rate.

Will these costs be included in the price evaluation?

A: Yes, these familiarization costs should be included in the per diem rate and will be part of Government’s price evaluation. Please reference #7, which discusses further.

7. Section C-3.10.3.3.3 requires that the cost of the familiarization period on the ships be included in the contractor’s fixed rate. 1. Does this include the transportation for joining crew or is that reimbursable as crew travel under Section C-1.7.3?

Section F-2 lists location for delivery as TBD. It is not possible to price the cost of familiarization if we do not know where it will take place? (Note: F-2 includes the LMSR USNS POMEROY in the list.)

If COVID ROM restrictions are still in place at the time of delivery, will ROM expenses for the familiarization crew and office staff be reimbursable?

A(a): Transportation for joining crew is not reimbursable.

A(b): Section F-2 is now updated to reflect the locations of delivery. The USNS Pomeroy was added in error and is removed from the list of ships.

A(c): COVID-19 ROM expenses will be addressed at time of delivery based upon ROM requirements at that time.

8. Reference: RFP page 243, L-7, A. (3) Price Proposal - Question: The price sheets requirement for submission we understand it is one for each vessel for each year is that correct for a total of seven (7) separate pricing sheets?

A: Attach L contains seven (7) tabs for individual ships.

9. Reference: RFP page 227, Section J list of attachments - Question: RFP lists an attachment V, Awardee Subcontracting Plan under the “Solicitation Only Attachments” list but this attachment was not included in the RFP package.

A: Mention of Attachment V has been removed from the Attachments section in Section J.

However, please note that offerors are required to submit Small Business Subcontracting Plans in accordance with Section L(A)(12), if applicable.

10. Attachment L Pricing form requires a rate for ROS and RAV, but the crew compliment is not defined in the RFP. Please provide the crew compliment for ROS and RAV.

A: Reference response to question #4.

11. Please clarify section C-1.1.2.1 “The contractor shall support the requirement listed in Error!

Reference source not found and Error! Reference source not found.”

A: Reference response to question #20 in A0003.

12. Please clarify section C-1.1.2.1 “The contractor shall support the requirement listed in Error!

Reference source not found and Error! Reference source not found.”

A: Reference response to question #20 in A0003.

13. Please confirm that the cost to support PEP listed in section C-1.3.2.a is to be included in FOS only.

A: Reference response to question #9 in A0003. The cost of berthing and messing the PEP shall be included in the fixed price, in accordance with Section C-1.3.2.

14. Section C-1.7.1.a has a manning scale for all of the vessels, except T-AGM 25, of four licensed deck officers (Master, Chief Mate, Second Mate and Third Mate). The Chief Mate is classed as a day worker. Please confirm that this is correct and that the Chief Mate does not stand watch at sea. If he/she does not then there is excessive overtime as the remaining mates would stand 6 and 6 working 12 hours a day just for watches. We have been told by other sources that are familiar with the ships that the Chief Mate does stand a watch.

A: The Chief Mate was incorrectly classified as a day worker. The day worker classification at C-1.7.1.a is removed.

15. Section C-1.5.3 requires stand-alone world-wide internet system for the crew to have access to email and the internet. Please advise if the hardware (i.e. antenna & wiring) are in place.

A: No, the contractor is not required to install hardware to support installation of an internet system, as all internet and communication systems hardware is controlled by the sponsor.

Section C-1.5.3 is corrected to reflect this.

16. Reference: RFP page 72-76, C-1.7.1.a: On most of the ships the contract manning requirements for AB’s under the FOS column, is less than the USCG minimum. Does the C.O.I./Safe Manning Certificate dictate which one should be followed?

A: The AB/Bosun positions, Able Seamen, and the Ordinary Seamen together fulfill the USCG minimum. The COI allows for this, and as such, offerors should reference the FOS numbers at Section C-1.7.1.a. in preparing their proposal.

17. Section C-1.7.1.a, manning scales do not clearly state the requirements for ROS and RAV.

Please provide required manning scales for both of these vessel statuses.

A: Reference response to question #4.

18. Section B-1.7 states any bonuses should be included in the FOS per diem rates. However, follow-on section B-1.7.1 Ammo Bonus Surge Ships states that the government will pay the contractor at the FOS ammo bonus rate when applicable. Pricing Attachment L does not provide an avenue to supply FOS ammo bonus rate information with our bid submission. Please clarify how FOS Ammo Bonus per diem rate should be captured for each vessel in the total evaluated price on Attachment L.

A: Reference responses to question #26 and #35 in A0003. Additionally, this amendment removes the language referencing any ammo bonus in Section B-1.0.

19. Section B-1.2 states all familiarization costs must be included in the fixed price per diem, however, section F-2 Place and Date of Delivery lists the projected delivery locations for all vessels as TBD. Please provide projected delivery locations for each vessel as this will impact familiarization costs submitted for this RFP.

A: Reference response to question #7.

20. C-1.7.1.a. Manning Scales This section indicates the Chief Mate is a dayworker. However, that would leave only 1, 2nd mate and 1, 3rd mate to stand watch. Please clarify if the Chief Mate is in fact a day worker and the other mates stand 12 hours of watch per day, or, if the “(day worker)” notation is in error.

A: Reference response to question #14.

21. The FOS Manning scales in C-1.7.1.a. Manning Scales list 3 Able Seaman, 1 Bosun/AB, and 2 Ordinary Seamen. However, the this is in conflict with the 6 AB requirement from the USCG column. Please clarify if Ordinary Seamen are acceptable. If so, is there documentation from USCG to substantiate such allowance?

A: Reference response to question #16.

22. Section C-1.7.3.a restricts change out of the Master and CM, CE and 1AE, and Master and CE within thirty days. However, our understanding of the operational profile of the ships is that there may only be 3-4 opportunities per year for crew changes that can be planned well in advance due to the secrecy of the ships’ locations while conducting missions. Those few opportunities may be less than 30 days. If relief of all top 4 officers needs to be accomplished during a 14 day window between two 100 day missions, will this be allowed?

A: Although missions may be 100 days, there are brief stops for fuel, food, and personnel rotations approximately every 30-45 days. Fourteen (14) day windows are not anticipated at this time.

23. If MSC restricts the crew to the ship due to a pandemic, will Restriction to Ship Wages be reimbursable?

A: The contract’s clauses and terms and conditions address the circumstances that may arise as a result of COVID-19. In the event the contractor believes it may be entitled to an equitable adjustment to the contract price, it may submit a request for equitable adjustment using the standard FAR clause or other appropriate and applicable FAR clause. Requests for equitable adjustment will be considered on a case-by-case basis, in consideration of the particular circumstances of each contract.

24. Reference: RFP page 77, C-1.7.7, C-1.7.7.1- 3 - Question: This section only listed three Key Shipboard Personnel (EO, Storekeeper and Medical Support), please confirm that these are the only Key Shipboard positions.

A: Section C-1.7.7.1 – Electronics Officer/Technician is not applicable to this requirement and has been removed. Section C-1.7.7.1 has been renamed “Key Shipboard Personnel Identified” and lists the key shipboard positions for this requirement. They are as follows: Master, Chief Mate, Chief Engineer, First Assistant Engineer, MDR, and if applicable, Store Keeper. The Store Keeper position is only on USNS Howard O. Lorenzen.

25. Reference: RFP page 78, C-1.7.7.1 references an Electronics Officer and RFP page 72, C- 1.7.1.a Manning Scales lists an Electronics Technician - Question: Is the Electronics Officer the same as the Electronics Technician?

A: Removed references of Electronics Officer/Technician as not applicable to this requirement.

Additionally, removed from C-1.8.1.a. Training Matrix and at B-1.9.

26. Reference: RFP page 78; C-1.7.7.1 - Question: RFP only specifically references a clearance needed for EO position. Can a detailed list be provided for other shipboard/afloat positions that require a clearance?

A: Section C-1.7.7.1 has been updated in accordance with question #25. All key shoreside and shipboard billets shall have clearances Section C-3.7.2.1 has been updated to reflect security clearance and citizenship requirements.

27. Reference: RFP page 141, C-3.13.1 Question: Will CAC’s be required for all other personnel not considered Key Personnel, afloat and ashore?

A: At this time, CACs are required for all key shoreside and key shipboard personnel for T- AGOS ships. For both T-AGM ships, the USNS Invincible and the USNS Howard O Lorenzen, CACs are required for all personnel aboard the ships. Section C-3.13.1 has been updated to reflect this requirement.

28. Section C-1.7.4 and Section C-1.7.7 reference Key Shipboard Personnel. From following sections we can deduce that Electronics Officer and Storekeeper are both Key Shipboard Personnel. Please provide a complete list of Key Shipboard Personnel for FOS, ROS, and RAV statuses.

A(1): Reference response to question #24 – 25.

A(2): Reference response to question #4.

29. Reference: RFP page 79 & 80, C-1.8.1. a / Question: According to MSC Training Centers, the Afloat Environmental Protection Coordinator course, SAMS medical training and the Security Refresher trainings no longer exist. Will these be removed as required trainings?

A: According to the MSC Training Coordinator Office, the Afloat Environment Protection Coordinator, SAMS medical training, and Security Refresher trainings are no longer a requirement and have removed from this solicitation.

30. G-3 (o) & C-2.5.10.3.5 - Do the requirements for progress payments, as noted in section C- 2.5.10.3.5, also apply to other Transalts, services in support of RAV/DDX, LLTM, and other large IA projects such as ME/SSDG overhauls?

A: Progress payments are authorized in accordance with C-2.5.7.3.5 for TRANSALTS, services in support of RAV/DDX, LLTM, and other large IA projects such as ME/SSDG overhauls that are 30 days or longer in duration.

SECTION B - SUPPLIES OR SERVICES AND PRICES

The following have been modified:

SECTION B

B-1.0 General. The rates for services provided under this contract shall be payable at the applicable, fully burdened per diem rates stipulated in the Section B rate schedule. Said payments shall be considered payment in full for all services, equipment, supplies, operation and maintenance of Government equipment, and all contractor personnel under this contract, including all penalty time, bonuses, payments, and emoluments payable to contractor personnel for services under this contract, irrespective of the geographic scope of said services, vehicular cargoes, bulk cargoes, general cargoes and the carriage of hazardous cargoes. Said payments do not include those items specifically identified as reimbursable under this contract, which will be reimbursed in accordance with (IAW) Section G below. The periods of this contract are not tied to any specific fiscal year and may not align with the fiscal year. No adjustments will be made to the per diem rates for startup costs or Collective Bargaining Agreement (CBA) wages.

B-1.1 Per Diem Rate for Operation and Maintenance. Per diem rates shall cover the cost of daily operation, maintenance, equipment, personnel, and services required to operate and maintain the ships and ships’ equipment, unless an expense is specifically listed in the contract as being reimbursable.

B-1.2 Familiarization. The Contractor’s fixed price per diem shall include all costs associated with the ship familiarization period (IAW Section C) for the specified timeframes prior to ship deliveries. Familiarization costs include, but are not limited to: crew wages & fringes, travel cost, travel wages, lodging, subsistence, training, insurance, administrative cost and any other costs associated with start-up costs not otherwise included in the offeror’s per diem rate.

B-1.3 Reimbursable Items. See Section G.

B-1.4 Estimates. All quantities within this contract and its attachments are estimates, unless this contract expressly states a specific quantity is a “guarantee.” If a stated quantity does not state it is a “guarantee,” then it shall not serve as the basis for additional compensation under the contract.

B-1.5 Holidays. Holidays referenced in this contract are those days listed in 5 USC 6103(a) Holidays.

B-1.6 Continuing Rate. See Section F-1(b) regarding voyage in progress on the date of contract expiration.

B-1.7 Full Operating Status (FOS) Per Diem. The FOS per diem rates shall include an on board turnover period as required in Section C when replacing shipboard key billets listed in Section C. The FOS per diem rates shall include the full wages and fringe benefits for each crewmember IAW Section C. In addition, any overtime incurred for the purpose of maintaining required “watches” IAW Section C shall be part of the per diem rate. This includes the routine gangway watch, also referred to as the gangway security watch, which includes roving patrol duties. The FOS per diem payment shall be considered payment in full for all FOS services, equipment, supplies, operation and maintenance of the ship and Government equipment, and all contractor personnel under this contract, including but not limited to, all penalty time, bonuses, payments and emoluments payable to contractor personnel for services under this contract.

B-1.8 Reduced Operating Status (ROS) Per Diem. The firm-fixed-price ROS per diem rates provided under this contract shall be payable at the applicable, fully burdened per diem rates stipulated in the Section B rate schedule.

The ROS per diem rates shall include an on board turnover period as required in Section C when replacing shipboard key billets. The ROS per diem rates shall include the full wages and fringe benefits for each crewmember IAW Section C. The ROS per diem rates shall also include the full wages and fringe benefits to fulfill security/watch requirements listed in Section C while the vessel is in a non-FOS status. Gangway security-watch overtime, when required, will be reimbursable when the COR preapproves the expenses; therefore, it should not be included in the firm-fixed-price per diem. The ROS per diem payment shall be considered payment in full for all ROS services, equipment, supplies, operation and maintenance of the ship and Government equipment, and all contractor personnel under this contract, including but not limited to all penalty time, bonuses, payments and emoluments payable to contractor personnel for services under this contract.

B-1.9 Adjustments to ROS Crew Size. The Government reserves the right to make minor crew adjustments during periods of ROS (e.g. reduction of steward crew when ROS ships are nested and multiple ships crews are fed on one ship or the addition of crew for enhanced security). During times in which the ROS crew is modified, the per diem rate will be increased or decreased by the total amount of the crew member’s Total Wages/Fringes/Payroll Taxes as depicted in Attachment P, Pricing Form A for ROS (also see Sections B and F). If the requested crew billet is not listed on Pricing Form C for ROS, the Contractor shall provide a union-approved rate for that billet, adjusted only by the addition of contractor-provided fringe benefits and payroll taxes. The Government will not consider or pay adjustments to the per diem rate for Contractor overhead, general and administrative cost, material handling costs, profit, fees, or any other cost with the exception of reasonable direct expenses for:

Subsistence for the crew member(s) remaining onboard with the prior written approval of the Contracting Officer;

Transportation costs of crew members leaving or returning to the ship because of a Government directed ROS crew size adjustment; and

Any extraordinary expense incurred with the Contracting Officer’s prior approval. The Contractor shall exercise prudent judgment to minimize all such direct costs and shall request the Contracting Officer’s prior approval of any action affecting such costs, including crew members remaining onboard, whenever practicable.

B-1.10 Alternate ROS. The Government has the right to designate an alternate ROS based upon an activation timeline of more or less than five days (e.g., ROS-4, ROS-30). During an alternate ROS, the per diem rate will be increased or decreased by the total amount of the crew member’s total wages/fringes/payroll taxes, as depicted in Attachment P, Pricing form A for ROS (Also see Pricing form Sections B and F). Other direct costs will be negotiated using the costs identified by the Contractor on Form A as the basis for negotiation.

B-1.11 Repair Availability (RAV Per Diem). The RAV per diem rates shall include full wages and fringe benefits for each crewmember IAW Section C. The RAV per diem rates shall also include the full wages and fringe benefits to fulfill security/watch requirements listed in Section C. The crew shall reside onboard the vessel for the duration of the shipyard availability unless the Contracting Officer approves shoreside accommodations due to special circumstances. Per diem payment shall be considered payment in full for all RAV services, equipment, supplies, operation and maintenance of the ship and Government equipment, and all contractor personnel under this contract, including but not limited to all penalty time, bonuses, payments and emoluments payable to contractor personnel for services under this contract.

B-1.12 Transition Costs. When transitioning a ship from ROS to FOS, FOS to ROS, FOS to RAV or RAV, ROS to Alternate ROS, Alternate ROS to ROS, Alternate ROS to FOS, or RAV to FOS to meet the requirements in Section C, expenses incurred to make the transition are reimbursable.

B-1.13 Dock Trials. See Section C for dock trial requirements. The Government anticipates Dock trials shall be conducted at a minimum of once per quarter for any vessel in ROS status. Additional expenses incurred above the designated status per diem rate will be reimbursable when the COR preapproves the expenses.

B-1.14 Ship Turnover. See Contract Clause 52.237-3 (Continuity of Services) and Section C. All reimbursable costs under Contract Clause 52.237-3 shall be reimbursed by the Government at the ship’s per diem status in effect during the turnover process.

B-1.15 Contractor’s Expense. All overtime, penalty time, bonuses, and other emoluments, payable for whatever reason, shall be at Contractor’s expense except those expressly authorized by the contract or pre-approved by the Contracting Officer.

B-1.16 Contract Line Item Number (CLIN) Structure. The CLIN structure may be unilaterally changed by the Government anytime during the life of the contract to accommodate the funding format.

B-1.17 Operational Commanders, National Command Authority, Fleet Commanders, and MSC Area Commanders.
