REVISED ANSWER TO REQUEST FOR SPECIFICATION CLARIFICATION #34
SPECIFICATION ITEM NO.: 0021_A
PARAGRAPH / SECTION NO: 7.3 & 7.5,
TITLE: Clean Gas Free Tanks Voids and Cofferdams
Paragraph 7.3 states, “Provide a clean storage facility with a capacity of approximately 600,000 gal of fuel oil, 0 gal of JP-5 and 20,000 gal of lube oil.
Paragraph 7.5 states, “When directed by the MSCREP, return all fuel oil and lube oil to the vessel”.
Contractor notes the following, Due to strict environmental regulations in San Diego, CA, contractor repair facilities do not possess the regulatory permissions to store fuel onsite in the specified quantities identified in para 7.3. Consequently, no local fuel barge operators are available to store quantities listed within the specification.
With these environmental constraints, government vessels in San Diego use the Point Loma, CA Fuel Depot prior to entering a contractor repair facility and also following their departure from a repair facility for fuel offload and onload needs.
MSC can use Defense Logistics Agency SEA Card System as a low cost solution.
Contractor notes the following if required to propose fuel requirements in San Diego, IAW JFMM Volume VII, COMUSFLTFORCOMINST 4790.3 REV C CH-3, Paragraph 7.6.6 that states, “Fuel Off-Load Prior to an Industrial Availability. Surface force ships and aircraft carriers should enter any significant availability with a maximum fuel load of 15-20 percent unless there is an approved waiver to enter with more fuel onboard”.
600,000 gal of fuel oil is about approximately 190,266 gal above 20% of the vessels total fuel capacity based on the data provided in ENCLOSURE 2.2.1.
A San Diego contractor having to propose the additional costs to procure an out of town barge, including transit, tankermen, and storage services, adds undue cost and risk to submitting a competitive proposal, as well as, introducing schedule risk if awarded in San Diego CA.
QUESTION (1):
Due to onsite storage restrictions and prohibitive costs of out of town barges, Will MSC make fueling requirements, as outlined in the specification, for out of port San Diego bidders only and utilize the Point Loma CA. Fuel Depot?
If no, and required to propose fuel requirements in San Diego, QUESTION (2):
Will the vessel enter the contractor’s facility in accordance with the JFMM, a maximum fuel load of 15-20 percent, and will an Errata be issued revising paragraph 7.3 to reflect an approximate quantity (gallons)?
QUESTION (3):
To mitigate costs in San Diego CA, can Ship’s Force make arrangements with the government’s Point Loma CA Fuel Farm, to provide barges, hoses, and tankermen to offload/transfer and return/replenish ships fuel oil and lube oil?
ANSWER: After extensive research, MSC does not have a risk-acceptable alternative for offloading fuel prior to arrival at the shipyard or while the ship is at the shipyard. Schedule requirements, operational commitments and unknown conditions made alternatives unacceptable. JFMM does not apply to MSC vessels. WI revised to change fuel oil quantity to 900,000 gallons.

SPECIFICATION ITEM NO.: 0288_A
PARAGRAPH / SECTION NO: 7.7.1
TITLE: MAIN CONDENSER CLEANING AND INSPECT (5 YR)
Paragraph 7.7.1 states, “Perform an Eddy Current inspection of tubes”.
Contractor notes, Item 0516_A, Condenser Eddy Current Testing REV1, paragraph 7.1 states, “7.1 Contractor to provide the services of a Level III certified/qualified technician in accordance with the requirements of American Society of Non-Destructive Testing, SNT-TC-IA, 2011 Edition, to perform Eddy Current testing on Twelve (12) Condensers identified in 3.2.1 through 3.2.4 in accordance with 2.2 through 2.5.” and duplicates the requirements of Item 0288_A paragraph 7.7.1 for the Main Condenser.
QUESTION: Can the Customer provide clarification regarding if the contractor is to provide separate pricing the EDDY Current Testing identified on Items 0288_A and 0516_A for the Main Condenser or does the Contractor preformed testing under Item 0288_A that is more detailed than detailed then the requirement provided in Item 0516_A

Contractor notes upon reviewed references 2.1.3 that this location does not exist within the boundaries provided however upon review of Item 0610_A, PRC Deck Replace, Enclosure 3.1 identifies Compartment (03-53-4-Q) ADMIN LCPO Office.
QUESTION: Can the Customer provide clarification that the Compartment identified in 3.2 is correct and if so provide applicable Structural Repair references and if not provide the correct location of work and will an Errata specification be issue with applicable references provided?

SPECIFICATION ITEM NO.: 0001_A
PARAGRAPH / SECTION NO: 8.2.1, 8.2.3
TITLE: Intent Scope General Conditions And Definitions
Item 0001 Para 8.2.1 states, “The USS Emory S. Land (AS-39) is known to have a considerable amount of asbestos. Additionally, the coating system may contain lead. The Contractor should expect this condition and factor in removal and remediation time requirements into his overall planning schedule. Contractor shall be responsible to follow all international, national and US Federal regulations in the containment, removal, and disposal of these wastes as encountered.”
Item 0001 Para 8.2.3 states, “The contractor may find materials aboard the ship which are hazardous to health. These include, but are not limited to, asbestos, coatings containing lead compounds and zinc chromate, and ventilation gaskets and electrical cable containing PCBs. In the event that hazardous materials are identified, the contractor shall notify the MSCREP immediately and in writing.”
Contractor notes Item 0603_B Lead Abatement Para 3.1 states, “For bidding purposes assume 5,000 sq ft of surfaces to require ‘Lead Abatement’.”
Contractors believes that based on the paragraphs above, that we are to price the 5,000 square feet of Lead Paint Abatement, and all other abatement labor and material costs related to containment, removal / remediation of asbestos, coatings containing lead compounds and zinc chromate, and ventilation gaskets and electrical cable containing PCBs will be subject to equitable adjustment when and if discovered.
Contractor also believes that disposal cost for the above listed Hazardous Material / Waste will be covered by Item 0023_A, Hazardous Waste Disposal paragraph 7.4.1 that states, “Contractor’s offer shall include $50,000 towards the cost of hazardous waste disposal, plus the total price for contractor management and handling fees”.
QUESTION: Can the Customer validate the Contractors understanding of the requirements of Item 0001_A Para’s 8.2.1, 8.2.3 and Item 0023_A Para 7.4.1 and Item 0603_B and if different provide clarification to all bidders?
ANSWER: Work item 0603 is an option item which, if activated on a pro-rated basis, compensates the contractor for all lead abatement activities (labor, materials, equipment, testing, etc.) except for disposal. Disposal is charged against WI 0023. Price work item 0603 on J-3 Category “B” Items form by entering the price per square foot.

Hardie-Tynes is no longer in business. Internet searches do not provide a replacement OEM for this equipment.
Can MSC provide a recommended replacement OEM for the equipment listed in this item?

Paragraph 7.2.1.1 states, “Crop out deteriorated steel as marked. Steel plate and shapes are to be cropped back to sound material. For bidding purposes, approximately 600 linear feet of steel plate to dealt with”.
Contractor notes that both paragraphs 3.2 and 7.2.1 state 600 Linear Feet of steel plate and not Square Feet.
QUESTION: Is it the Customers intent for bidders to approximately 600 Square Feet of steel plate and will an Errata be issued correcting Para’s 3.2 and 7.2.1.1?
ANSWER: Paragraphs 3.2 and 7.2.1.1 are Linear Feet. These are horizontal and vertical stiffeners.

TITLE: Anchor Chains and Lockers (5YR)
Paragraph 7.4 states, “Accomplish the following surface preparation on the anchors and chains”.
· Contractor notes and assumes based on 3.1.1 through 3.2 that identifies a total of 3 each 18,000 lbs Anchors and 7.5.8 that appears to identify a total of 18 each Shot of Anchor Chain = (6 each Shot X 3 each Anchors).
· Contractor notes the specifications and references provided appear to not clearly identifies the Anchor Chain diameter (size).
QUESTION: Can the Customer validate Contractors assumption of 18 each Shot of Anchor Chain and provide the Anchor Chain diameter (size).
ANSWER: 12 15-fathom shots on the port, and 12 on starboard (24 total shots) of 3.5" HD chain, and 10 shots of 3" HD chain on the stern. WI revised.

QUESTION:
1. 2020 Specification:
7.3 Provide a clean storage facility with a capacity of approximately 600,000 gal of fuel oil, 0 gal of JP-5 and 20,000 gal of lube oil.
2018 Specification:
7.3 Provide a clean storage facility with a capacity of approximately 42,000 gal of fuel oil, 0 gal of JP-5 and 0 gal of lube oil.
Due to the logistical issues of storing 600,000 gal of fuel oil, 0 gal of JP-5 and 20,000 gal of lube oil. Can MSC attempt to get closer to their 2018 arrival conditions?
ANSWER: No. 2018 was a pier-side Mid Term Availability and we did not need to empty all the tanks. Revised WI to offload 900K vice 600k to maintain a safe margin of GM for stability. Refer also to RFC #34 above.
2. 7.4 Removals: The ship will pump down tanks to low suction, either to other tanks onboard or to shore storage facilities.
ANSWER: Revised WI
Item 124 Stability Test
7.14 All tanks shall be both dry and empty or pressed full.
ANSWER: Paragraph 7.14 of WI states “The CONTRACTOR shall provide hard copies of all of the raw data (deadweight survey, inclining weight certificates, freeboard measurements, draft readings, pendulum measurements, plot, etc.) to the MSCREP and REG BODY immediately following the Stability Test.
3. 2020 Specification:
7.4.1 Provide for the disposal of 800,000 gal of oil contaminated fresh water ballast from the tanks listed in Enclosure 2.2.1.
2018 Specification:
7.4.1 Provide for the disposal of 15,000 gal of oil contaminated fresh water ballast from the tanks listed in Enclosure 2.2.1.
Due to the logistical issues for the disposal of 800,000 gal of oil contaminated fresh water ballast Can MSC attempt to get closer to their 2018 arrival conditions?
ENCLOSURE 2.2.1 2018 & 2020 do not list fresh water ballast tanks, oil contaminated or not.
Is this requirement in error?
ANSWER: Freshwater Water Ballast Tank are: 8-50-1, 8-50-2, 8-62-1, 8-62-2, 8-74-1, 8-74-2, 8-86-1, and 8-86-2. Revised WI
4. 7.11 All Tanks and spaces included in enclosure 2.2.1 shall be opened, cleaned and prepared for gas free certification within 10 days of the shipyard availability start.
Considering the above questions, and if the quantities listed above are correct, can MSC designate/prioritize a more reasonable list of tanks and spaces to be opened, cleaned and prepared for gas free certification within 10 days of the shipyard availability start.
ANSWER: No priority of tanks. Work item revised to read “30 days”.
5. As an extreme cost saving measure, is it possible MSC can minimize the extensive storage and disposal requirements required in WI 0021?
Bidders having to provide pricing for the handling of these excessive amounts of fuel storage and disposal will add significant amount of cost to their proposals.
ANSWER: No. Refer to RFC #34 above.
