PM51 SEALIFT
TANKER PERFORMANCE WORK STATEMENT (PWS)
MSC TANKTIME 10/13
1. VESSEL(S) REQUIRED:
a) Offerors shall provide TANKTIME Charter Boxes identifying the vessel(s) and providing the Offeror’s DUNS, CAGE, and TIN. Offerors shall complete and provide all applicable Charter Boxes information (not including pricing details from Boxes 13-18).
b) Offerors shall provide the Technical Evaluation Worksheet completed for the vessel(s) offered for this procurement.
c) Offerors shall submit a General Arrangement Plan, one reproducible set of the ship’s capacity and stowage plans (1/16th inc to the foot scale). This is to include cargo piping. Offerors are to provide narrative description to accompany the drawings showing the proposed locations of all required spaces and compartments listed in the PWS.
d) Offerors shall provide evidence of the vessel’s most recent USCG and ABS and International Association of Classification Societies (IACS) inspections within 12 months.
e) Offerors must warrant it meets, or will meet by start of contract performance, the requirements of Quality Management System ( QMS). If an offeror does not currently have the required systems in place it will provide a narrative describing how it will have these required systems in place by the contract performance start date.
f) Offeror warrants to provide one clean, U.S. flag vessel, if a foreign flagged vessel is offered, it must be reflagged U.S. flagged no later than upon delivery, (non-Jones Act acceptable IAW 46 U.S.C. § 12111), approved double hull tanker with Segregated Ballast Tanks (SBT) that is capable of carrying a minimum of 40,000 BBLS of clean petroleum products (intentions JP5, JP8, or F76) within the vessel’s natural segregation in designated cargo tanks with double valve isolation and with the following minimum particulars:
g) There is a classified requirement in conjunction with this RFP that may eliminate offerors. Offerors who are affected will be given the opportunity during discussions to read/address this requirement provided that affected offerors have appropriate security clearances in place. Offerors not affected will not have a need to know about the requirement regardless of appropriate security clearances being in place.
h) Vessel must be a party to the Oil Companies International Marine Forum’s Ship Inspection Report (SIRE) System and owner must provide a current Q-88 with offer (no more than 60 days old). Q-88 must detail current acceptances and dates of inspection. A new Q-88 must be provided after each SIRE inspection.
i) Owner must provide date of last SIRE report on the vessel which has been registered in the revised SIRE register. This SIRE report must be less than 6 months old at all times during the performance of this contract.
j) Owner must confirm acceptances received and/or retained by the vessel since the last sire report.
k) Owner must confirm that the vessel has not been rejected or refused by any Charterer since the inspections leading to the said SIRE report.
l) Owner must confirm vessel has vetting approval from at least two oil majors (Exxon Mobile, Chevron Texaco, ConocoPhillips, etc.) providing date of vetting and name of major, at least one vetting approval must be less than 6 months old at the time of the offer.
m) Vessel’s age shall be less than 20 years for the duration of the charter, vessels that will exceed 15 years during the charter period must be enrolled in their classification society’s Condition Assessment Program (CAP) and be rated CAP 2 or better.
n) Vessel cannot exceed a maximum LOA (Length Overall) of 108 meters.
o) Vessel cannot exceed a maximum manifold height of 16 meters.
p) Vessel cannot exceed a maximum DWT (Dead Weight Tonnage) of 9,000 metric tons, re-measuring is allowed, any re-measurement cost to be for owner’s account.
q) Vessel must be Double Hulled.
r) Vessel must have a Segregated Ballast Tanks (SBT).
s) Vessels must be in compliance with current IG requirements in SOLAS regulations.
t) Owner must provide a copy of vessel’s current Class Society issued Safety Management Certificate.
u) Owner must provide a copy of vessel’s current Flag State issued International Ship Security Certificate.
v) Owner must provide vessel stowage plan demonstrating vessel’s ability to load minimum 40,000 BBLS of JP5, JP8, or F76 not to exceed a laden draft of 8.2 meters.
w) Owner must provide vessel stowage plan demonstrating vessel’s ability to load minimum 33,000 BBLS of JP5, JP8, or F76 not to exceed a laden draft of 6.7 meters.
x) Vessel must have a minimum of 3 segregations with double valve isolation.
y) Vessel must have a 5-ton boom for lifting cargo hose(s) with cruciform bits at the manifold (capable of reaching both port and starboard manifolds).
z) Vessel’s rail at the manifold (port and starboard) to be of the same height as the bottom of manifold and of sufficient strength to support the weight of a six-inch cargo hose during cargo operations at offshore mooring facility.
aa) Vessel must be able to machine wash cargo tanks, as applicable, while underway.
ab) Vessel must be able and equipped to perform cargo operations pier side.
ac) Vessel must have on board a minimum of 8 mooring lines total (4 on the bow and 4 on the stern) on power drums available for securing the vessel at loading and discharging terminals.
ad) Owner must confirm vessel’s minimum SOA (Safe Operating Area) fully laden of 12 knots in moderate weather (Force 5).
ae) Owner must provide vessel warranty from offer to arrival laydays at load port.
af) Vessel must report fully bunkered when the Master submits the Notice of Readiness at the port of delivery.
ag) Owner must confirm vessel’s ability to carry one complete undecanted tank washing in dedicated slop tanks.
ah) Owner must confirm vessel’s ability to hot wash all cargo spaces with water not to exceed 58 degrees centigrade prior to presenting for initial acceptance and inspection. All cargo tanks must be free of loose rust, previous cargo residues and films (including dyes), significant salt deposits and other impediments that could impact the quality of the cargo to be loaded.
ai) Owner must confirm vessel will arrive at load port in a clean, gas-free condition, and be ready for internal tank inspection by Quality Assurance Representative (QAR). Ensure any adjacent tanks are also clean and gas free. Contractor shall provide (Owner's account) a certified marine chemist to certify tanks safe for entry for internal tank inspection by Government / Charterer representative. Certified marine chemist must enter all cargo tanks in advance of the QAR and perform a full four corner entry inspection. Certified marine chemist’s inspection must include all tank pockets identified by the QAR to the satisfaction of the QAR. If a prior (last and next to last) cargo contained a percentage of benzene, owner’s certified marine chemist must arrive equipped with benzene detection tubes to measure toxicity for Benzene content. All safe for entry / toxicity / flammability assessments will be performed in the presence of the inspecting QAR. Contractor will provide time needed to re-inert after inspection.
aj) Owner must confirm vessel is free of copper and copper alloys (brass, bronze, etc.) in vessel compartments, pipelines, heating coils, fittings, etc. as it is not permitted in vessels chartered by MSC to carry petroleum products, unless vessel possesses a current DLA – Energy waiver.
ak) Owner must provide, if vessel cargo tanks have heating coils, coil type or composition (such as stainless steel, copper, etc.). Owner must provide, if vessel cargo tanks have heating coils, the date heating coils were last pressure tested and the results of the test (passed or failed). Date of last pressure test cannot exceed 12 months for duration of this charter. Vessel tanks with copper or yellow metal compounds are normally not acceptable for Jet Fuel cargoes.
al) Owner must provide, if vessel cargo tanks are internally coated, the coating type (epoxy, inorganic zinc, etc.). Coal tar coating is not acceptable. If tanks are not coated then state “none”. Coatings that are incompatible with the fuel to be carried will be rejected.
am) Owner must provide copies of Certificates of Quality for vessel’s last three cargoes. These Certificates should contain all test data required by specification for the products that were previously loaded (last three). Vessel Certificates of Quality from vessel post-load samples are preferred, but if unavailable shore tank Certificates of Quality representing quality of product loaded are acceptable. The Certificates of Quality should contain the test data required by the specification for the product which were loaded. They shall be submitted for each shore tank as well as the vessel tanks after loading (composite sample). Results of “typical” are not acceptable. Additionally, the following are required for the specific products mentioned:
a. Naphtha / Condensates: Mercaptan Sulphur, reported in “parts per million” (ppm) or “mass percent”, or Doctor Test (ASTMD 4952). Otherwise, Certificates of Quality should contain the test data required by the specification for the products which were loaded.
b. Gasoline (Motor or Aviation): It must be stated whether the previous product was “leaded” or “unleaded”. This is needed to determine cargo tank “safe entry” testing requirements.
an) Owner must confirm whether or not the last three cargoes carried contained FAME (Fatty Acid Methyl Esters).
ao) Owner must confirm, in the event any of the vessel’s last three cargoes did contain FAME, that vessel cargo tanks were cleaned / conditioned in accordance with the guidance in accordance with Energy Institute HM50.
ap) Owner agrees where cargo is carried after contract award and prior to delivery to provide cargo type/description prior to loading, and applicable Certificates of Quality (to include all test data required in the initial RFP) for review within 48 hours after loading said cargo. Test shall be on a sample taken from the ship versus a representative sample from a shore facility. Any rejection of the Certificates of Quality by the Government shall result in the Government cancelling this contract at no cost to the Government.
aq) Owner must confirm that vessel is be able to take upper, middle, lower, bottom, and all-level samples of the cargo (to include OBQ & ROB) without contaminating them from the sampling location. If unable to do so or if the sampling location is contaminated or suspected to be contaminated, Charterer will require open sampling on a tank by tank basis, consistent with safety and local terminal regulations.
ar) Owner agrees vessel must meet all MSC requirements for reporting. Vessel shall provide position/status reports in-port and at-sea every six (6) hours daily at 0000, 0600, 1200, and 1800 hours GMT (Zulu) and 72/48/24/12 hr pre-arrival notifications for all ports to the appropriate Area Command and COMSC HQ Tankers.
as) Owner agrees master to submit the attached MONTHLY VOYAGE ABSTRACT form on a monthly basis and emailed to COMSC.TANKERS@NAVY.MIL later that the 1st day of the month following the month of performance. For time charters that complete prior to the end of the month, the report must be received no later than two calendar days after completion of charter (off-hire). Entries must start with the date the ship presents NOR and is accepted on hire. All columns must be completed as noted. Pull down menus for columns C, X and Y are the only comments to be use. Built in macros/formulas are not to be altered.
at) Contractor Facility Clearance. The Contractor shall possess a SECRET facilities clearance at time of proposal submission (See Part X and Part XI for proposal instructions and award criteria), which shall be incorporated at contract award in the required DD 254 (See Attachment D).
au) Personnel Clearances: The Master, Chief Officer, and an additional officer (deck or engineering) shall have a completed investigation comparable to at least a National Agency Check and adjudication indicating eligibility for access to SECRET.
av) Chemical, Biological and Radiological Defense (CBR-D) and Force Protection (FP) Requirements.
a. CBR-D Requirements.
i. General. All FP and CBR-D material is centrally managed by Military Sealift Command in the Consolidated Support Facility. All CBR-D and FP Gear will be provided by the Government. At no time should the Contractor procure an off the shelf commercial CBR-D or FP equipment unless otherwise directed by the Charterer. The Contractor shall contact the Program Office to request replacement of FP and CBR-D items that have been expended, damaged or have exceeded their shelf life or require calibration. The request must include the Shipping address and the point of contact name and phone number. The Master will submit a FP and CBR-D complete inventory in the format designated by MSC of all FP and CBR-D equipment required by the allowance equipage list in accordance with the required reports, records and log (CDRLs).
ii. Upon receipt of all FP and CBR-D material the Ship will sign and date the receipt document, annotate material received and fax a copy to the Shipper (MSC Central Storage Facility) within ten (10) days of material receipt.
b. CBR-D Equipment and Training. The Contractor shall adhere to MSC’s standard provisions concerning CBR-D found in Attachments K through L. The Contractor will assign a licensed Deck Officer as CBR-D Officer who shall perform the duties as described below and in accordance with COMSCINST 5530.3 (series). The Contractor shall train crewmembers as specified in Attachment G. The Vessel will be fitted with a Water Washdown System (WWDS) as specified in Attachment L, within six (6) months after vessel delivery. The Contractor will reconfigure a space as necessary to function as a decontamination station as specified in Attachment L. Any transfer or disposal of CBR-D equipment will be reported to the cognizant MSC Area Commander and Squadron Commander in accordance with FAR CLAUSE 52.245-1, entitled ‘Government Property’.
c. CBR-D Officer Duties. The CBR-D Officer will perform the following duties:
a. Ensure all CBR-D equipment is properly stored and maintained at authorized levels in accordance with COMSCINST 5530.3 (series).
b. Ensure all CBR-D equipment is inspected at least quarterly, with results of inventory entered into the deck log.
c. Replace and/or update deficient, missing or out-of-date equipment; submit RADIAC meters for calibration when due.
d. Advise the Master on procedures required as outlined in COMSCINST 3541.5 (series) (Damage Control Manual).
e. Provide MSC Program Office with annual CBR-D inventory.
d. CBR-D Officer Training. The Vessel’s CBR-D Officer shall be trained as specified in Attachment G.
e. Government Tests and Inspections. The Government has the right to periodically inspect the Vessel’s CBR-D equipment, the CBR-D Officer’s qualifications and crew members’ training records, and test the operability of installed CBR-D systems. A report of the inspection will be provided to the Master, cognizant MSC Area Commander and Squadron Commander.
aw) The contractor shall be responsible for Controlled Cryptographic Instruments (CCI), such as a STE-III telephone, issued by the MSC operational or administrative Commander. The Contractor shall provide a secure space onboard the ship for use of CCI equipment and shall designate accountable personnel as specified by DODINST 5520.22 Series (National Industrial Security Program Operating Manual). The Contractor may also be issued COMSEC keying material which requires two-person integrity (TPI) be maintained onboard the ship as specified in DODINST 5520.22 Series. Any two ship's officers who hold a SECRET clearance granted by DISCO are acceptable as COMSEC keying material users. Physical safeguards for all classified material shall be provided by Contractor personnel as specified in DODINST 5220.22 Series. "The Contractor shall install, maintain, and operate COMSEC equipment for the U.S Government as well as electronically communicate classified national security-related information by COMSC protected means."
ax) Contractor performance requires that designated personnel employed onboard the ship have access to SECRET information regarding the operational employment and safe navigation of the ship. For operational matters, the Master, Chief Mate, and any additional officer (deck or engineering) shall have a completed National Agency Check and a SECRET clearance granted by DISCO. Only U.S. citizens have access to classified material. The Contractor shall, on a semi-annual basis, provide COMSC N15 an updated list of all crewmembers who are designated to have access to classified information. The Contractor shall ensure any classified information disclosed to its employees is not further released or made available to other employees, or any other person who does not have a comparable clearance and a "Need to Know."
ay) The MSC Operational Commander designated for the contract will be responsible for releasing classified information to the Contractor's shipboard personnel and will provide the Master with a Security Classification Guide (SCG).
