18R3003 Q&A #3

1. Attachment O-Column E has links that are not working. Can they be fixed or do we just ignore

Column E?

A: Please see Amendment 0005, attachment 18R3003 Attachment O Pricing Sheets- ESD-0005.

2. Section1.2 This section references that we need to provide a breakdown of Familiarization costs in

Attachment O. Where in Attachment O do you want these?

A: Please see Amendment 0005, attachment 18R3003 Attachment O Pricing Sheets- ESD-0005, Tab

Form A-1.

3. Section 1.1.13.4 states that travel expenses for the Ship Handling experts are reimbursable. Is the Ship

Handlers compensation also reimbursable?

A: A: Please see Amendment 0005, attachment 18R3003 Attachment O Pricing Sheets- ESD-0005, Tab Form A-1.

Travel expenses for the SHE (lodging, per diem, local transportation, CONUS and OCONUS travel) will be reimbursable within the limits of the Joint Travel Regulations (JTR) with prior COR approval.

The SHE Service will be at a Fix Per Diem rate per day once on board to assigned vessel, in addition to the OPHIRE Fix Per Diem rate.

4. Attachment B-The only wage information provided in Attachment B is Fringes. Please provide the current compensation and overtime information.

A: Please see Amendment 0005, attachment 18R3003 Attachment B - DOL CBA Wage Determination

– 0005.

5. Attachment O Form C FOS is missing the QMED Electrician that is shown on Section 19.

6. Please provide current collective bargaining agreements. The Wage Determination refers to CBAs that appear to have terminated on October 1, 2017. We therefore cannot be sure that the Fringe information listed for October 1, 2017 is still in effect.

7. 3.3.4 Is the incumbent operator managing any layberth contracts at this time?

A: No Expeditionary Transfer Dock (ESD)Vessel is in Layberth.

8. TM6/15 – there are numerous references missing and instead “Error! Reference source not found., CError! Reference source not found.”

A: Please see Amendment 0005, attachment 18R3003 Attachment A Tech Man-0005.

9. Row 43 and Row 34 on Form B are currently not working. Please fix and reissue a new Attachment O.

10. In the answer to Question 14, you reference that the SHE service will be at a Fix Per Diem rate per day once on board the vessel. I do not see a place for this on the Per Diem on the pricing Sheets. Please tell us where we are supposed to provide this Fix Per Diem in our proposal.

A: Please see Amendment 0005, attachment 18R3003 Attachment O Pricing Sheets- ESD-0005, Tab

Form A-2.

11. Considering that no labor rates were included in Amendment 1 and many submitted questions remain to be answered, we request you reconsider and provide a 3 week extension.

A: The response submission date has been extended to 27 February 2018.

12. L-14 C Price Proposal- Attachment O is described as a linked spreadsheet. This section ask that we only submit Forms B and Section B and that Pricing Forms A and C shall be provided after award as a deliverable. Paragraph 3 asks that we provide a CD ROM of its pricing proposal. Given the fact that

Attachment O contains all forms, we are unclear how we provide only Form B and Section B in excel form on a CD ROM. Please provide guidance on how we only include Forms B and Section B in excel when Attachment O contains all the pricing sheets. In addition paragraph 3 of this sections reference a 6 month option period, however the pricing forms do not include a 6 month option period.

A: -Individual tabs can be exported to a new workbook.

-The 6 month option period (52.217-8) is totaled on Form A, Row 185. This data is copied from

Option Year four rates and divided in half, which are typically the same.

13. Where is the cost of the SHE (wages) priced? Section 1.1.13.4 addresses travel expenses being reimbursable but is silent on SHE wages. Pricing forms do not include wages either.

A: Please see Amendment 0008, attachment 18R3003 Attachment O Pricing Sheets- ESD-0005, Tab

A-2.

14. As of this date, we are still not in receipt of CBA’s for all operating unions and therefore cannot conduct a proper pricing evolution within the allotted time frame therefore, we respectfully request a 2 week extension to the response date.

A: The response submission date has been extended to 27 February 2018.

15. Despite the Q&A of Amendment 0002, it is still not clear if SHE wages should be part of the fixed price, but if so, it is not clear how many days we should cover (says 2 x 10 days or more) and where we shall reflect those wages. Will you please provide better clarification on the SHE requirements?

A: Please see Amendment 0008, attachment 18R3003 Attachment O Pricing Sheets- ESD-0005, Tab

A-2 and Section B-1.3.2.

16. L-13.A says “Initial Offers must be submitted by mail only (including commercial express delivery services)…” Is hand delivery by Company courier or representative acceptable and allowed as it was in the past?

A: Initial Offers must be submitted by mail only (including commercial express delivery services) and should be enclosed in a sealed package. E-mailed submissions are not allowed for initial offers.

Offerors, couriers, and other delivery services may encounter unpredictable and lengthy delays or denied access when attempting to enter that facility. In all cases, offerors are responsible for the risks associated with the chosen delivery method and for ensuring that the Government receives the complete proposal at the appropriate designated location prior to the due date and time for proposal submission. Hand delivery by Company courier or representative is not acceptable.

17. L-13.G says “…The electronic copies of the proposal shall be submitted in a format readable by

Microsoft Office version 2007 or later.” Because certain files are not possible to provide in MS Office format, will you please revise this to state “…Microsoft Office 2007 and Adobe Reader 8.0 or later version.”?

A: Please see Amendment 0005.

18. Complete wage determinations have not yet been provided for the subj. RFP. Once we receive them, it takes time for labor organizations to provide CBA proposals, then more time for us to review them for compliance with SCLS and concur with or negotiate the terms. Once finalized, besides putting together the Pricing Sheets for L-14.B.II.C Price Proposal, then we must use the final figures for L-14.A Cash

Flow and L-14.B.III Small Business Participation. With all this in consideration, will you please extend the due date by 30 days if wage determinations are provided by Amendment this week, or else appropriately more if wage determinations are not provided this week?

A: No consideration will be made for extension to the response date.

19. I have downloaded and attached a copy of the Wage Determination provided with Amendment 003

(attached). Please see that this WD remains incomplete and insufficient for submission of bids due on

February 27th. While the wage determination now includes the predecessor contractors wage information for the unlicensed ratings, it does not include the predecessors contractual wage information for the licensed officers.

A: A: Please see Amendment 0005, attachment 18R3003 Attachment B - DOL CBA Wage

Determination – 0005.

20. Will MSC issue a revised, current Wage Determination Attachment B? The wage determination

(Attachment B) posted on FBO on Jan. 16, 2018 was last issued on Jan. 26, 2017 and shows an effective date until Oct. 1, 2017. The reason we ask is that Section H-13 “LIMITATION TO SERVICE

CONTRACT LABOR STANDARDS (SCLS) STATUTE APPLICABILITY” states:

“It is possible that ships under this contract could be forward deployed for the entire contract period.

Although (in accordance with FAR 22.1003-2) SCLS statute compliance is not required for work performed outside the U.S, in the interest of attracting and retaining the best qualified/ experienced civilian mariners and to reduce performance risk, the contractor is required to pay its mariners at the minimum wage and fringe benefit levels contained in the Department of Labor (DoL) Wage

Determination included in Attachment B under Section J of the Contract. The contract per diem rate for all contract periods shall be inclusive of anticipated escalation for all price components, to include wage and fringe benefits and associated costs.”

If the current union agreements have been renegotiated since Oct. 1, 2017 and will be in effect prior to the award of the current procurement, those rates will be effective against a successor contractor under

Section 4(c) of the SCA.

21. As of this morning the above solicitation has not been amended to include the required Service

Contract Act (SCA) wage portion of the Wage Determination. The Wage determination is incomplete since it only includes the SCA fringe benefit rates and not the SCA wage rates that are currently being paid in support of this existing contract.

22. I respectfully request that the wage portion of the Wage Determination be included as soon as possible and that the solicitation be extended at least an additional three weeks from the current closing date so that proposals can be formulated once the SCA wages from the predecessor agreements are provided.

– 0005. No consideration will be made for extension to the response date.
