SUMMARY OF CHANGES
SECTION SF 1449 - CONTINUATION SHEET
SOLICITATION/CONTRACT FORM
The required response date/time has changed from 30-Apr-2018 03:00 PM to 04-May-2018 03:00 PM.
The following have been modified:
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF
1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the
Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.
Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database.) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting
Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.
(End of provision)
52.212-1 (ADDENDUM) ADDITIONAL INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS
Any inconsistency between FAR Provision 52.212-1 and the Addendum to FAR 52.212-1 shall be solved by giving precedence to the Addendum to FAR 52.212-1.
SUBMISSION PACKAGE
Proposals may be only hand delivered or mailed. Hand delivered and mailed proposals shall be sent to the following location and must be received, and the Government must acknowledge timely receipt there, prior to the due date and time for proposal submission: May 04, 2018 3:00pm local time Norfolk, VA.
Military Sealift Command
Attn: Timothy Lewis
471 C Street
Naval Station Norfolk, VA 23511-2419
In the case of a base closure or delay (inclement weather, government shutdown, etc.), Offerors shall follow the same guidance issued to the Government. It is the Offeror’s responsibility to check media outlets for this information. Questions may be directed to the Contracting Officer in this event.
Access to the Naval Station Norfolk is restricted. Offerors, couriers, and other delivery services may encounter unpredictable and lengthy delays or denied access when attempting to enter that facility. Similarly, mailed proposals may encounter unpredictable and lengthy routing delays. In all cases, Offerors are responsible for the risks associated with the chosen delivery method and for ensuring that the Government receives the complete proposal at the appropriate designated location prior to the due date and time for proposal submission.
https://www.acquisition.gov/
The proposal must demonstrate an understanding of and ability to meet all of the requirements set forth in the
Procurement Specification referenced herein. Throughout the proposal, the Offeror shall provide sufficient detail to substantiate the validity of all statements. The Offeror shall demonstrate that the proposal is in compliance with the requirements, terms, and conditions of the solicitation.
Comprehensive responses to the requirements of this solicitation are required to enable the Government to evaluate the Offeror’s understanding of and capability to accomplish the requirements of the Procurement
Specification. The proposal must clearly demonstrate the Offeror’s ability to meet the requirements of the solicitation and successfully accomplish and manage all requirements of the solicitation. General statements that the Offeror can or will comply with the requirements, that standard procedures will be used, that well known techniques will be used, or paraphrasing the solicitation’s requirements in whole or in part, will NOT constitute compliance. Failure to conform to any of the requirements of the solicitation may form the basis for rejection of the proposal.
Brochuremanship is not desired; clarity, completeness, and conciseness are essential and the overall quality of the proposal will be evaluated in the context of being representative of the Offeror’s services. An Offeror’s proposal is presumed to represent the best efforts to respond to the solicitation.
Only the proposal submitted in response to this solicitation will be evaluated. Offerors should make certain that their proposal is complete with regard to the information provided. Data previously submitted, or presumed to be known, e.g., previous projects performed for the Government, will not be considered in the evaluation unless that information is physically contained in the proposal.
Proposals shall be presented in three (3) separately bound volumes:
Volume I (Technical)
Volume II (Past Performance)
Volume III (Price)
Four (4) hard copies of Volume I; and one (1) hard copy of Volumes II and III shall be provided.
Additionally, one electronic copy each of Volumes I, II and III shall be provided. The electronic copies shall be in either Microsoft Word or Portable Document Format (PDF) and shall be provided on a CD. (Please note that other forms of electronic media, such as USB flash drives, will not be accepted.) If there is a discrepancy between the hard copy and the electronic copy, the hard copy will prevail. Volume I shall not contain any pricing data. The pages are to be typewritten; no less than 1 1/2 line spacing, and no smaller than 12 point type.
Past performance data may be single-spaced. Volume I shall not exceed 120 pages. All Offeror documentation, such as foldouts, charts, figures, tables, are included in the 120 page limit. Tables of contents, dividers, pages intentionally marked as blank for ease of reading. All material in excess of the page limits will neither be read nor evaluated.
Each volume of the proposal shall be clearly marked as to the volume number, the solicitation number, and the
Contractor’s name. Pages shall be numbered consecutively within each volume showing volume and page. For example, page 19 of Volume I would be numbered I-19 and page 10 of Volume II would be numbered II-10.
Offerors are advised that the Government may selectively verify any information provided in the proposal.
Offerors are cautioned that they are responsible to ensure that material that they desire to have evaluated for a particular section is contained in that specific section.
Proposals shall not contain classified material. Any portion of a proposal which the Offeror considers business sensitive should be clearly marked as such in accordance with FAR 52.215-1.
VOLUME I - TECHNICAL VOLUME REQUIREMENTS
Volume I shall consist of proposal information for evaluation of the Technical Factor. Volume I shall consist of a separate section for each of the below factor, addressing the specific solicitation requirements of each factor.
Offerors are cautioned that they are responsible to ensure that material that they desire to have evaluated for a particular section is contained in that specific section.
To facilitate the evaluation of an Offeror’s compliance with the requirements of the Procurement Specification and its capability of meeting those requirements, Offerors shall include the information below in their proposals
FACTOR 1: TECHNICAL CAPABILITY/UNDERSTANDING OF THE PROCUREMENT
SPECIFICATION
The technical capability must demonstrate an understanding of and an ability to comply with all requirements covered in the Procurement Specification. Offerors shall not simply rephrase the requirements, but instead shall, where appropriate, provide relevant examples and references to demonstrate how they meet the requirements.
The Offeror shall describe in its submittal its overall understanding of and approach to the type of material that needs to manufactured as a result of the award of this contract. The narrative should not be a rephrasing of the
Procurement Specification, but instead, should concentrate on the Offeror's understanding and approach to the
Procurement Specification. In this discussion, the Offeror should convey the Offeror’s understanding of the overall requirements of the system elements and scope (both in breadth and depth) of material and work, which are required. The Offeror's quote should at a minimum discuss the following areas:
1. A detailed description of Offeror’s approach including a detailed step-by-step methodology that would be used in accomplishing each task required by the Procurement Specification.
2. Demonstrate ability to mitigate any technical risks that may impact successful performance. Offerors shall address their ability to manage and identify any technical risk and their planned actions to mitigate or eliminate the risks.
The Offeror’s technical approach shall demonstrate its understanding of the Procurement Specification sections 1 thru 8; its ability to perform the work; and its capabilities, expertise, and relevant experience for each section.
VOLUME II: PAST PERFORMANCE
Offerors are requested to provide information on up to three (3) Government contracts whose effort is/was recent and relevant to the effort required by this solicitation.
A. “Recent” is defined as a contract in-progress for at least a full year or completed within the last three (3) years. If the offeror has not had three (3) Government contracts within the last three (3) years, information on recent and relevant subcontracts and/or commercial contracts may be submitted.
B. “Relevant” is defined as a contract that is of similar scope, magnitude, and complexity to the requirements as set forth in this solicitation.
i. Scope: Experience in the areas defined in the Procurement Specification.
ii. Magnitude: The measure of the similarity of the volume, dollar value and/or duration of the work actually performed under the Offeror’s submitted contracts to the Procurement Specification.
iii. Complexity: The measure of the similarity of technical difficulty, managerial intricacy and/or required coordination of efforts and disciplines performed by the Offeror in its submitted contracts to the Procurement Specification. For complexity, not only will the tasks performed by the
Offeror be considered, but also the Offeror’s ability to coordinate tasks (e.g., concurrent performance requirements).
A Past Performance Data Sheet is requested to be submitted for each contract to be considered as past performance. Offerors shall provide a detailed explanation demonstrating the similarity of the contracts to the requirements of this solicitation; a detailed description of the work performed for the contract; and the role performed, including whether the Offeror acted as a prime contractor or a subcontractor. Offerors are responsible for the accuracy of all data provided. Past performance information regarding predecessor companies, key personnel who have relevant experience and subcontractors that will perform major or critical aspects of the requirement may be provided as past performance submissions.
The past performance evaluation will assess the offeror’s probability of meeting the solicitation requirements.
To develop an overall rating, the Government’s evaluation will take into account relevant information submitted by each offeror as part of its proposal and the Government’s assessment and evaluation of other sources of information. Other sources of information for past performance may include, but are not limited to, Past
Performance Information Retrieval System (PPIRS) reports, the Federal Awardee Performance and Integrity
Information System (FAPIIS), Electronic Subcontract Report System (ESRS), other databases, questionnaires and interviews. The following ratings will be used in the past performance evaluation:
RATING DESCRIPTION
ACCEPTABLE
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown
UNACCEPTABLE
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
(1) The Government will consider how recent and the relevancy of past performance information compared to the requirements detailed in the Procurement Specification, the source of the information, the context of the data and general trends in the offeror’s performance and any associated risk. “Recent” is defined as a contract in-progress for at least a full year or completed within the last three (3) years. If the offeror has not had three (3) Government contracts within the last three (3) years, information on recent and relevant subcontracts and/or commercial contracts may be considered.
(2) The Government will consider the extent of the offeror’s ability to perform a previous contract successfully in the areas of; (a) quality of product or services; (b) timeliness or scheduling of supplies/deliveries; (c) business relations/customer satisfaction.
(3) For all offerors, the Government will consider historical compliance with the requirements of FAR Part
52.219-8 (Utilization of Small Business Concerns).
In accordance with FAR 15.305(a) (2) (iv), an offeror without a record of relevant past performance or for whom information on past performance is not available, will not be evaluated favorably or unfavorably on past performance.
For each of the contracts the Offeror describes in a Performance Data Sheet, the Offeror is requested to provide a Past Performance Questionnaire to a reference at the organization that awarded the contract. It is requested that the reference, not the Offeror, email or mail the completed Past Performance Questionnaire BEFORE THE
DUE DATE FOR PROPOSALS directly to Timothy Lewis at timothy.lewis6@navy.mil and Christina McCloud at christina.mccloud@navy.mil or Military Sealift Command, 471 C Street, Naval Station Norfolk, VA 23511-2419, e-mail; Fax submittals will not be considered. The Offeror, NOT THE GOVERNMENT, is responsible for ensuring that the Government receives a sufficient number of questionnaires.
