VERBIAGE & TERMINOLOGY
For clarification purposes, throughout this solicitation, Cost-Plus-Fixed-Fee (CPFF) Term, Cost-Plus-Fixed-Fee (CPFF) Level of Effort, and Cost Plus Fixed-Fee (CPFF) Non-Performance Based are used interchangeably. For clarification purposes, throughout this solicitation, Cost-Plus-Fixed-Fee (CPFF) Completion and Cost-Plus-Fixed- Fee (CPFF) Performance Based are used interchangeably.
PRODUCT SERVICE CODE
The basic contract of this Single-Award Indefinite Delivery/Indefinite Quantity, Cost-Plus-Fixed-Fee and Cost Reimbursable vehicle will have an associated Product Service Code (PSC) of AC63, Defense System – Electronics/Communication Equipment (Advanced Development).
CONTRACT TYPE
This solicitation is a Small Business set-aside and the resulting contract will be a Single-Award Indefinite Delivery/Indefinite Quantity contract utilizing Cost-Plus-Fixed-Fee (CPFF) CLINs for Labor (Term and Completion) and Cost Reimbursable CLINs will be used for Other Direct Costs (Travel and Material). The anticipated ordering period is five (5) years.
ANTICIPATED NUMBER OF TASK ORDERS/CLINS:
The following information is the Government’s best estimate and is provided for situational awareness only.
-CPFF Labor Term tasking demands may yield approximately 10 Task Orders (TOs) per year with 15 CLINs on each TO for a total of 150 CLINs. The total number of CLINs for the duration of the contract will be approximately 750 CLINs.
-CPFF Labor Completion Tasking demands may yield approximately 3 Task Orders (TOs) per year with 6 CLINs.
The total number of CLINs for the duration of the contract will be approximately 90 CLINs.
-The Government anticipates that the first Task Order (TO) will be issued approximately 30 days after Contract award.
NOT SEPARATELY PRICED CLINS
Not Separately Price (NSP) Appropriation Type CLINs and a NSP Data CLIN will be on the Basic IDIQ Contract, whereas, at the Task Order Level, CLINs will be separately priced along with NSP Data CLINs. At the IDIQ level, CLINs 0001, 0006, 0011, 0016, and 0021 will contain the overall ceiling for CLINs 0002-0005, 0007-0010, 0012- 0015, 0017-0020, and 0022-0025, respectively.
COLLABORATION LANGUAGE
The Government expects a significant amount of interplay between three large acquisitions (Irregular Airborne Platform Engineering (IAPE), Advanced Sensor System Development and Execution (ASSDE) and Advanced Software, Computer, and Network Development and Integration (ASCNDI)) being procured by Naval Air Warfare Center Aircraft Division (NAWCAD) Webster Outlying Field (WOLF), Airborne Systems Integration (ASI) Division. The demands of the projects and the inherent nature of rapid technological development necessitates cooperative contractor interaction to achieve the successful completion of each individual effort and an overall unified outcome. Therefore, while these efforts represent three distinct contracts, offerors are advised that all awarded contractors and their subcontractors will be expected to collaborate and work with the contractors and subcontractors for the other efforts.
Furthermore, it is anticipated that ASI Division will have additional acquisitions other than the three large acquisitions identified above. All awarded contractors and their subcontractors supporting any of the ASI Division procurements are expected to collaborate and work with the contractors and subcontractors for the other ASI Division procurements.
AMENDMENT 0001
Responses to questions from industry are outlined below. All submissions shall be made in accordance with Block 9 of the Soliciation cover page.
1. Question 1: Proposals are due at noon on 2 December 2019, the Monday after Thanksgiving. As this solication is a small business set aside, and many of our personnel have made plans to spend time with friends and family during the holiday, would the Government consider extending the proposal period by at least one week in order to enable offerors to provide a high quality proposal?
Answer 1: The Government agrees to extend the due date of proposals to Thursday, 05 December 2019 at 12:00 p.m. Eastern Standard Time. Please note that all other submission requirements remain the same.
2. Question 2: On pages 131-2, paragraph 1.3.7 and subparagraphs, the Government specifies the requirements for offerors to provide their Small Business Utilization Strategy (Annex 1) as a part of their overall Management Approach. Since “This requirement is being set-aside for small business,” (per page 137, paragraph 3.3.7), would the Government consider eliminating the requirement for a Small Business Utilization Strategy?
Answer 2: This procurement is a small business set-aside; however, offerors are still required to provide their Small Business Utilization Strategy (Annex 1) as a part of their overall Management Approach. A Small Business Utilization Strategy is not the same as a Small Business Subcontracting Plan that a large business would be required to submit in a full and open competition.
AMENDMENT 0002
Changed made to Solicitation N00421-19-R-0069 and responses to questions from industry via Amendment 0002 are outlined below. The proposal due date has changed. All submissions shall be made in accordance with Block 9 of the Soliciation cover page.
1. Question 1: On page 2 of the solicitation, the Government indicates that Cost-Plus-Fixed-Fee (CPFF) Term is interchangeable with CPFF Level-of-Effort and CPFF Non-Performance Based; and that CPFF Completion is interchangeable with CPFF Performance Based; but the Government does not define “Term” or “Completion” in this or any other context. Can the Government further clarify these terms?
Answer 1: For the purpose of this contract, we will defer to the definitions in the FAR. Per FAR 16.306(d)(1) a cost-plus-fixed-fee contract may take one of two basic forms-completion or term. The completion form describes the scope of work by stating a definite goal or target and specifying an end product. This form of contract normally requires the contractor to complete and deliver the specified end product (e.g., a final report of research accomplishing the goal or target) within the estimated cost, if possible, as a condition for payment of the entire fixerd fee. However, in the event the work cannot be completed within the estimated cost, the Government may require more effort without increase in fee, provided the Government increases the estimated cost.
Additionally, FAR 16.306(d)(2) states that the term form describes the scope of work in general terms and obligates the contractor to devote a specified level of effort for a stated time period. Under this form, if the performance is considered satisfactory by the Government, the fixed fee is payable at the expiration of the agreed-upon period, upon contractor statement that the level of effort specified in the contract has been expended in performing the contract work. Renewal for further periods of performance is a new acquisition that involves new cost and fee arrangements.
2. Question 2: The P1 – Past Performance Information Form seems to have a flaw that causes the following text blocks to auto-populate with the same data: “Offeror Name,” “Division Name,” “CAGE Code,” “DUNS Number,” and “PSC.” As a result, you cannot put different (correct) data in these different lines.
Would the Government replace the P1 with a form that does not have this flaw?
Answer 2: The Government has identified the errors in the P1 and has replaced the attachment.
3. Question 3:. Can the Government confirm Offerors are to provide 1 original, 1 paper copy, and 1 electronic copy or are offerors only required to provide 1 electronic copy of the SOW/PWS for each contract reference listed in Volume 2? See Section L, Part A, 3.3 and Section L, Part B, 2.1.3.
Answer 3: The Government confirms that the language in Section L, Part A, paragraph 3.3 of the RFP is correct. Offerors are to provide 1 original, 1 paper copy, and 1 electronic copy of the SOW/PWS for each contract reference listed in Volume 2. Section L, Part B, paragraph 2.1.3 of the RFP is updated to state “Offerors shall provide the Statement of Work (SOW)/Performance Work Statement (PWS) in Annex 2 for each contract reference and cross reference how each provided contract aligns to the RFP SOW/PWS.”
4. Question 4: Can the Government confirm the Cross Reference Matrix (CRM) included in Volume I:
Technical is to cross reference the proposal volumes (i.e., Volumes 1, 2, and 3) and paragraphs or is the CRM only intended to cross reference Volume I paragraphs? See Section L, Part A, 3.5.
Answer 4: In Section L, Part A, paragraph 3.5 of the RFP, the Cross Reference Matrix (CRM) included in Volume I: Technical is to cross reference only Volume I: Technical paragraphs. The language in Section L, Part A, paragraph 3.5 of the RFP is updated to state that the CRM in this section is applicable to Volume I:
Technical only.
5. Question 5: On page 132, volume L, Section 2, paragraph 2.1.2.1 states that offer my choose one of two options for the attachment P1. If the offer chooses option ii, is there a page limit on that contract description, or is it unlimited?
Answer 5: In Section L, Volume 2, paragraph 2.1.2.1 of the RFP, if the Offeror chooses option ii, there is no page limit requirement.
6. Question 6: Due to the complexity and length of the sample tasks, and the sample tasks not being part of the draft RFP that was released we are requesting that the proposal due date be extended until December 12th.
Answer 6: The proposal due date has changed. Please see Block 9 of the RFP for the updated due date.
7. Question 7: Will the Sample Tasks be awarded with the overall IDIQ?
Answer 7: No, the Sample Tasks are for evaluation purposes only and will not be awarded with the overall
IDIQ.
8. Question 8: Will any task order be awarded with the initial IDIQ award?
Answer 8: A Task Order fulfilling the minimum guarantee, as stated in NAVAIR Clause 5252.216-9506, will be issued at contract award or the following day; however, per Section A of the RFP, the Government anticipates that the first Task Order will be issued approximately 30 days after Contract award.
9. Question 9: Are offerors required to include a price proposal in Volume 3 for the sample tasks? Section L, Part B, 1.1.1.1.1.8 & 1.1.1.2.1.8.
Answer 9: No, Offerors shall not include any price information in Volume 3 for the Sample Tasks.
10. Question 10: Please clarify this section should be 1.1 and that this a mis numbering. Page 124, Section 3.3, Volume I Section 1.1.1.
Answer 10: The Government confirms that in Section L, Volume 3.3 chart, Volume 1, paragraph 1.1.1 Understanding of the Work-Sample Tasks in the RFP is a typo. The paragraph should be 1.1. The Government corrected Section L, Part A, Paragraph 3.3 chart, column “Volume 1”, paragraph/subgraph 1.1 instead of 1.1.1 in the RFP.
11. Question 11: Is there a preferred template for this letter of consent? Please provide. Page 132, Section L, 2.1.2: Past Performance.
Answer 11: There is no formal template and the Contractor format is acceptable.
12. Question 12: Please confirm that an SB Joint Venture, bidding as a prime contractor, is limited to submitted two past performance references for each of the Prime Joint Venture members. Page 132, Section L, 2.1.2: Past Performance.
Answer 12: If the Small Business Joint Venture has previous past performance records for the same Joint Venture, then no more than five Past Performance Information Forms may be submitted for that Joint Venture. However, each Joint Venture member may also submit two additional Past Performance Information Forms that are specific to the individual member. In a case of a Small Business Joint Venture without a record of relevant past performance, the Small Business Joint Venture is limited to two past performance references for each of the Joint Venture members. The Government has updated the language in Section L, Volume 2, paragraph 2.1.2 of the RFP to better clarify this requirement.
13. Question 13: If bidding as an unpopulated joint venture prime, should both members submit their respective Total Professional Employee Compensation Plans? Page 155, Section M, paragraph 3.2.
Answer 13: Yes. If an Offeror is bidding as an Unpopulated Joint Venture Prime, then both members shall submit their respective Total Professional Employee Compensation Plans.
14. Question 14: Section L, paragraph 1.5 defines a principal subcontractor as a subcontractor who provides at least 20% of the total price/cost. Because all ODCs will be bid by the prime will the Government consider updating the definition to be 20% of the labor cost only. Given that this is a small business set aside and the small business prime must do 51% of the total labor cost there is the potential for conflict between this definition and the set aside limitation. Please clarify.
Answer 14: The Government considers these as two separate definitions. Section L, paragraph 1.5 of the RFP correctly defines “principal subcontractor” as a subcontractor who provides at least 20% of the proposed total price/cost (excluding the Offeror’s profit/fee), for the contract or provides one or more Key Personnel. It is also correct that this requirement is being set-aside for a small business. As such, each Offeror’s proposal shall comply to 52.219-14 Limitations on Subcontracting (Deviation 2019-O0003)(JAN 2019).
15. Question 15: Section L, Sample Task 1 requires detection and tracking of multiple targets simultaneously, this requirement has a significant impact on the sensors and processing required. Are there threshold and objective requirements on the numbers of the targets to be simultaneously detected and tracked?
Answer 15: Yes. The threshold requirement is a minimum of three (3) targets to be simultaneously detected and tracked. The objective is ten (10) targets to be simultaneously detected and tracked. The Government has updated Section L, paragraph 1.1.1.1, Sample Task 1, paragraph b of the RFP to state “The expected product deliverable’s threshold requirement is a minimum of three (3) targets to be simultaneously detected and tracked. The objective is ten (10) targets to be simultaneously detected and tracked.”
16. Question 16: Based on the above and the impact of the changes/non-changes we are requesting a two week extension to the proposal due date.
Answer 16: As stated in Answer 6 of Amendment 0002, the proposal due date has changed. Please see Block 9 of the RFP for the updated due date.
17. Question 17: We are also unable to access the beta SAM site now that is taking the place of FBO. Can you provide a status for when we will be able to access the beta SAM site to receive solicitation updates? Please also take this into consideration when reviewing the request for proposal due date extension.
Answer 17: As of 12 November 2019, beta.SAM.gov is up and operational. Contractors are required to have a beta.SAM.gov account in order to see RFP activity as of the transition date. Should contractors have issues using beta.SAM.gov, they should contact the Federal Service Desk at www.fsd.gov.
18. Question 18: The past performance table in section L paragraph 2.1.3 include a reference to SOW Paragraph 3.3.7.4. However, the SOW does include a Paragraph 3.3.7.4. Please clarify.
Answer 18: The Government has updated Section L, Part B, paragraph 2.1.3 chart in the RFP by removing
3.3.7.4 from the N00421-19-R-0069 SOW/PWS Paragraph column.
In addition to addressing the questions from Industry, it was determined that the following revisions were necessary to the Solicitation.
Additional Changes Made by the Government:
1. Section L, Part B, Volume 2, paragraph 2.1.4 of the RFP has been updated from “The primary source of past performance information will be PPIRS. If a Contractor Performance Assessment Report (CPAR) exists for multiple years for the same contract/order, all periods of performance for that contract/order will be used for evaluation. In the event a CPAR does not exist for a past performance reference, the Offeror shall submit a Contractor Performance Assessment Questionnaire (CPAQ), Attachment P2, to the Program Manager who is the Assessing Official. The Offeror shall include instructions for the Program Manager to send completed questionnaires within two weeks of its receipt via e-mail to Sarah Erly, Contract Specialist, at sarah.erly@navy.mil AND Carolyn Emmart, Contracting Officer, at carolyn.emmart@navy.mil thereby allowing the customer approximately two weeks to complete their response. All CPAQs should be received by Sarah Erly and Carolyn Emmart by the solicitation due date” to now state:
“The primary source of past performance information will be PPIRS. If a Contractor Performance Assessment Report (CPAR) exists for multiple years for the same contract/order, all periods of performance for that contract/order will be used for evaluation. In the event a CPAR does not exists for a past performance reference, the Offeror shall submit a Contract Performance Assessment Questionnaire (CPAQ), Attachment P2, to the Program Manager, who is a Government employee and the Assessing Official. All CPAQs should be received by Sarah Erly and Carolyn Emmart by the solicitation due date.”
2. Section K, Clause 52.204-8(2)(iv)and(v) of the RFP has been updated to remove the X next to both subparagraphs of this clause.
3. Section L, Part B, paragraph 3.3.7 of the RFP has been updated from “This requirement is being set-aside for a small business. Provide a breakout to demonstrate how the prime contractor or the prime contractor combined with a similarly situated entity will perform at least 50% of the cost of the contract incurred for personnel with its own employees for each period of performance in accordance with FAR clause 52.219-
14. Cost of contract incurred for personnel includes direct labor cost, overhead that has only direct labor as its base, and the small business’s General and Administrative (G&A) rate multiplied by the labor cost” to now state:
“This requirement is being set-aside for a small business. Provide a breakout to demonstrate how the prime contractor or the prime contractor combined with a similarly situated entity will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded.”
4. Section M, Part B, paragraph 3.3, (specifically the 2nd paragraph) of the RFP has been updated from
“Because this is a set-aside competition, the contractor’s compliance to FAR Clauses 52.219-14 “Limitation on Subcontracting” will be assessed as an element of responsibility. An Offeror’s proposal that fails to meet the limitation on subcontracting during each period of performance shall not be considered for award” to now state:
“Because this is a set-aside competition, the contractor’s compliance to 52.219-14 Limitations on Subcontracting (Deviation 2019-O0003)(JAN 2019) will be assessed as an element of responsibility. An Offeror’s proposal that fails to meet the limitation on subcontracting during each period of performance shall not be considered for award.”
5. Section K, Clause 52.219-1(b)(1)and(2) of the RFP has been updated to state the NAICS code for this RFP and the small business size standard for this RFP.
AMENDMENT 0003
Question 1: In reference to Q&A #5 - is it the intention of the Government to potentially review and evaluate hundreds of pages of past performance information? By making the page count unlimited it is and based on how broad the SOW is, it is certainly possible to provide extremely long and detailed responses describing similar work we have performed in the past.
Answer 1: Section L, Part B, Volume 2, paragraph 2.1.2.1(a)(ii) allows offerors to submit a second PDF or MS Word document to provide the required information for the Contract Description Box of the Attachment P1. While Amendment 0002 of this RFP gives no page limit to this document, the Government reminds Offerors that the narrative on each Past Performance Information Form, Attachment P1, in the “Contract Effort Description” should clearly describe how each contract reference has relevant work effort that matches the relevancy definitions specified in Section M of the solicitation.
Section M, Part B, 2.0 Past Performance, specifically the second paragraph, states “The second aspect of the past performance evaluation is to assess how relevant the past performance being evaluated is to the requirements of this solicitation. When evaluating relevancy, which includes the similarity of scope, complexity, and magnitude of the past performance to the current solicitation, the Government will focus on performance similar to the SOW/PWS paragraphs. . .” Based on those restrictions the Government believes that while there is no page limit specified, an offeror can provide a detailed response within a reasonable amount of pages.
Further, Offerors are also advised to review Section L, Part A, paragraph 1.2, which emphasizes clarity, brevity, and logical organization during proposal preparation. The Government’s intent is to receive quality responses to the RFP regardless of page restrictions.
Question 2: On beta.sam.gov to the ASSDE active Notice ID: N00421-19-R-0069 as of Nov 15 access is allowed to only 2 documents: N00421-19-R-0069_Amendment_0002.pdf and Attachment P1_-_P1 Past Performance Information Form.pdf. How does one obtain access to the other documents such as Attachments, Exhibits and ASSDE_SOW from Nov 15?
Answer 2: Beta.SAM allows you to access all previous attachments and links associated with the subject Solicitation. To see all previous information, after searching for the subject RFP, you will see a link on the left hand side that says “history” which you can click on to access the original RFP posting and attachments. Additionally, in the “attachments/links” tab, also on the left hand side of the page you should be able to access all previous attachments posted for this RFP. Should an Offeror have issues using Beta.SAM for the new contracting opportunities functionality, they should contact the Federal Service Desk at www.fsd.gov.
Question 3: In regards to Question 8, Amendment 0002, when the Government stated in Answer 8 “the first Task Order will be issued approximately 30 days after Contract award” does the Government mean the “first” Task Order for actual tasking of this contract?
Answer 3: Yes. The Government plans to issue the first Task Order, which will have actual tasking related to this contract, approximately 30 days from Contract award.
AMENDMENT 0004
The Government has made the following changes to the RFP:
1. Attachment 03 - OCI List, specifically the supplier/contractor title "Cherokee Nation Technologies" and address "777 West Cherokee St., Catoosa, OK 74015" have been changed to "Cherokee Nation Strategic Programs" and "10838 E. Marshall St. Ste 200 E, Tulsa, OK 74116.”
AMENDMENT 0005
1. Question 1: Answer 2 from Amendment 2, referenced that “The Government has identified the errors in the P1 and has replaced the attachment.” The Attachment P1 on beta.sam.gov still has an error in the Task/Delivery Order entry field on page 1. It is directly linked to the entry field underneath Demonstrated Systemic Improvement Information text on page 2, such that when you enter text in one field the PPIF form automatically populates the other field with the same text – and vice versa. In other words, the PPIF form does NOT currently allow separate text entries in these two separate fields. Is the Government correcting this matrix/data entry issue?
Answer 1: The Government agrees and has resolved the error described above in the Attachment P1. The Attachment P1 has been replaced. Offerors should use the P1 attachment associated with Amendment 0005 so that all separate fields can be completed correctly.
2. Question 2: On page 6, under additional changes by the Government, #1, the requirement that a CPAQ must be completed by a Government employee. This eliminates the possibility of using contracts, even those that closely mirror the ASSDE SOW, that were funded commercially (although in support of capture of Government contracts). Will the Government remove the requirement that all past performance references must be completed by a Government employee?
Answer 2: The Government confirms the revised language in Section L, Part B, Volume 2, paragraph 2.1.4 of the RFP as communicated in solicitation amendment 0002 on page 6, under Additional Changes Made by the Government, number 1, is accurate. The Government will not remove the requirement that the Contract Performance Assessment Questionnaire (CPAQ), Attachment P2, is to be completed by a Government employee.
3. Question 3: I would like to confirm you will be accepting proposals for Advanced Sensor System Development and Execution (ASSDE) through 16 DEC 2019.
Answer 3: Proposal submissions must be received by the date and time specified in Block 9 of the most current solicitation amendment cover page. The Government did not revise the proposal due date or time as a result of this solicitation amendment.
AMENDMENT 0006
1. Question 1: For P1 – is the TOTAL in the table supposed to be the contract value for the POP? Is INVOICED supposed to be the total invoiced for that POP? For the labor hours – it is total ceiling labor hours or total labor hours invoiced for the specific POP?
Answer 1: The P1 for this RFP has been updated; however, no substantial change was made. When submitting a proposal, Offerors may use the P1 in Amendment 0005 or the P1 in Amendment 0006 so long as the information in the chart on the P1 is filled out with the appropriate information. The Government has updated the headers on the chart within the P1 to be more clear. That is the only change to the P1. The same information shall be inserted into the proper column regardless of which P1 version (from either Amendment 0005 or Amendment 0006) the Offeror is submitting.
The “TOTAL” column in the chart within the P1 from Amendment 0005 shall be filled out using the same information as the “Total Contract Value for PoP” from the P1 of Amendment 0006; the “INVOICED” column shall be filled out using the same information as the “Total Invoiced for PoP” from the P1 of Amendment 0006; and “Labor Hours” column shall be filled out using the same information as the “Level of Effort for PoP” from the P1 of Amendment 0006. The “Period of Performance START” and “Period of Performance END” columns remain the same in both the P1 from Amendment 0005 and Amendment 0006.
2. Question 2: In Section C – Statement of Work – 3.3.4.4 - the Government references Hyper-spectral and multi-spectral detection systems in the title of the paragraph, but then states “Human Signature Imaging” and “Mechanical Systems Intelligence” in the body of the paragraph. Can the Government provide clarification?
Answer 2: Section C, Statement of Work (SOW), paragraph 3.3.4.4, has been updated. The previous language, “Human Signature Intelligence (HSI)” has been changed to “Hyper-Spectral Imaging (HSI)” and “Mechanical Systems Intelligence (MSI)” has been changed to “Multi-Spectral Imaging (MSI).”
3. Question 3: The BLS SOC Code for the Software Developer, Journeyman, 15-1252 appears to be an error. 15-1252 no longer exists for 2018 Bureau of Labor Statistics 2018 Standard Occupational Classification System. Should it be replaced by 15-1132? Please provide clarification.
Answer 3: The BLS SOC Code for the Software Developer, Journeyman, 15-1252 is correct. This specific SOC Code is new and was created in 2018. As a result offeror’s may not find any data in the “Occupational Employment Statistics” on the BLS.gov website specific to this SOC code, 15-1252. Section C Statement of Work, paragraph 3.4.7 (specifically below the Chart), references that the labor categories are described in “Bureau of Labor Statistics 2018 Standard Occupational Classification System” and the Government has confirmed that the title, code, and functional description for BLS SOC Code 15-1252 is included there and accurate. Offerors shall propose in accordance with the labor categories as stated in the RFP.
4. Question 4: The BLC Code for the Information Security Analyst, Journeyman, 15-1212 appears to be an error. Should this be BLS SOC Code 15-1122 instead? Please provide clarification.
Answer 4: The BLS SOC Code for the Information Security Analyst, Journeyman, 15-1212 is correct.
This specific SOC Code was updated in 2018, which affected the code number, definition, and illustrative examples. As a result, Offeror’s may not find any data in the “Occupational Employment Statistics” on the BLS.gov website specific to this SOC Code, 15-1212. Section C Statement of Work, paragraph 3.4.7 (specifically below the Chart), references that the labor categories are described in “Bureau of Labor Statistics 2018 Standard Occupational Classification System” and the Government has confirmed that the title, code, and functional description for BLS SOC Code 15-1212 is included there and accurate. Offerors shall propose in accordance with the labor categories as stated in the RFP.
5. Question 5: We are requesting that the page limitation for Section 1.3 Management Approach be increased by 2 pages for a total of 12 pages.
Answer 5: The page limitation for Section L, Part B, Paragraph 1.3 Management Approach remains unchanged. Offerors should propose in accordance with the page limitations as stated within the chart in Section L, Part A, Paragraph 3.3.
6. Question 6: Based on the additional questions and the clarifications please extend the due the date by at least one week.
Answer 6: The Government is not extending the proposal due date or time. Proposal submissions must be received by the date and time specified in Block 9 of the most current solicitation amendment cover page.
AMENDMENT 0007
Change made to Solicitation N00421-19-R-0069 and responses to questions from industry via Amendment 0007 are outlined below. The proposal due date has not changed. All submissions must be received by the date and time specified in Block 9 of the most current Solicitation amendment cover page.
1. Question 1: Could the Government please clarify why the education requirements in SOW 3.4.7 Labor
Qualifications paragraph d. for a Senior Engineer and paragraph g. for an Engineering Technician are identical since one is an Engineer and the other is a technician. Further, the education requirements listed in the BLS SOC descriptions are not aligned with the technician requirements for a Masters in Engineering.
Answer 1: The Government confirms that Section C, SOW, paragraph 3.4.7, specifically “g. Electrical and Electronic Engineering Technician, Senior, SOC 17-3023” education requirements in the RFP are correct. Offerors shall refer to Section C, SOW, paragraph 3.4.6.5 in the RFP, to determine what education substitutions are allowable for each labor category. While the BLS SOC provides generic descriptions for education requirements, it does not specify them for each classification within that labor category (e.g. Senior, Journeyman, Junior). Therefore, Offerors shall propose in accordance with the labor categories in the RFP.
2. Question 2: Can you please confirm that each Annex should be submitted as a stand alone document in its own binder, and not packaged as an attachment to the volume to which it corresponds. For example, do you prefer Annex 1 be submitted as its own volume, separate from Volume I, or included as a tabbed annex in the binder with Volume I, where the Management Plan is included? Similarly, shall offerors submit separate binders/volumes for Annex 2 and Annex 3, or should they be tabbed sections in the original volume 2 binders?
Answer 2: The Government has no preference; however, Offerors shall submit proposals in accordance with Section L, Part A of this RFP. In regards to an Annex, Offerors shall refer to Section L, Part A, paragraph 3.3 of the RFP.
In addition to addressing the questions from Industry, it was determined that the following revisions were necessary to the Solicitation:
Additional Changes Made by the Government:
1. Section C, SOW, paragraph 3.4.6.3 of the RFP has been updated from “SENIOR: A Senior labor category has over ten (10) years of experience and a Master of Arts (MA) or Master of Science (MS) degree. A Senior labor category typically works on high-visibility or mission critical aspects of a given program and performs all functional duties independently. A Senior labor category may oversee the efforts of less senior staff and/or be responsible for the efforts of all staff assigned to a specific job.”
To: “SENIOR: A Senior labor category has over ten (10) years of experience and a Master of Arts (MA) or Master of Science (MS) degree, unless otherwise stated in Section C, SOW, paragraph 3.4.7, “Professional Services Labor Qualifications” of this RFP. A Senior labor category typically works on high-visibility or mission critical aspects of a given program and performs all functional duties independently. A Senior labor category may oversee the efforts of less senior staff and/or be responsible for the efforts of all staff assigned to a specific job.”
AMENDMENT 0008

5. Updated Section J to add Attachment P8 - DoD SAFE Help.
6. Updated Section J Attachments P3 – P3 Hourly Burdened Composite Labor Rates to remove the previous period of performance. Offerors are reminded to update their Attachment P3 submission so that the proposed Fee Per Hour, Fee Percentage, and Composite Rates reflect their revised pricing submitted within their Attachment P6.
7. Updated Section L, Part A and Part B, to include instructions for electronic communications and proposal delivery. Specific paragraph revisions and additions to address electronic proposal delivery are noted below:

AMENDMENT 0009
Changes made to the solicitation are outlined below. The proposal due date and time shall be in accordance with Block 9 of the solicitation cover page.
The purpose of this amendment is to attach an updated P7 Subcontractor Cost Summary. The new attachment updates cells K76 and L76 on the CPFF Term Summary and the CPFF Completion Summary tabs. These cells incorrectly referenced Year 3 when they should have referenced Years 4 and 5.
Section B - Supplies or Services and Prices
B-1 I. Hourly Burdened Composite Labor Rates (excluding fee) and Streamlined Ordering Procedures for
Cost Plus Fixed Fee (CPFF) Labor Term CLINs and/or Orders
(a) Hourly Burdened Composite Labor Rates (provided within the tables in paragraphs (c) and (d) below) applicable to CLINs 0001-0005 only:
(1) The rates below are the Hourly Burdened Composite Labor Rates for each labor category, exclusive of prime fee on both prime and subcontractor labor.
i. Hourly Burdened Composite Labor Rates shall include direct labor rates plus all applicable burdens, to include indirect rates, applicable escalation, subcontractor fee on subcontractor labor, and subcontractor pass-through costs (exclusive of prime fee on subcontractor's labor).
ii. Hourly Burdened Composite Labor Rates shall not include prime fee on prime labor, prime fee on subcontractor labor, Foreign-Area Allowances, Other Direct Costs (ODCs) such as Travel and Material, and Cost of Money costs (if proposed).
iii. The Hourly Burdened Composite Labor Rate would be the sum of both the prime and all subcontractor labor costs, as described above, for that labor category divided by the total number of labor hours for that labor category.
(2) The Hourly Burdened Composite Labor Rates in paragraphs (c) and (d) are estimates, and invoicing will be based on actual costs incurred.
(b) Task Orders (TOs) that include CPFF Labor Term CLINs will be issued under this contract using the following streamlined ordering procedures:
(1) For each proposed order that includes CPFF Labor Term CLINs, the contracting officer will provide the contractor a TO and an Independent Government Cost Estimate (IGCE). The IGCE is an estimate of labor hours by labor category utilizing the Hourly Burdened Composite Labor Rates provided in paragraphs (c) and (d) below, to calculate the total estimated cost for the proposed CLINs and/or TO.
i. The TO fixed fee is calculated using Section G Clause 5252.232-9510 PAYMENT OF
FIXED FEE (NAVAIR).
ii. Ceiling for ODCs will be priced in accordance with the Government estimate.
iii. TOs crossing multiple years will be estimated by the Government using the Hourly
Burdened Composite Labor Rates for each year in proportion to the Period of Performance (PoP) of the TO.
(2) Within three (3) working days of receipt of the TO and IGCE, the contractor shall respond:
i. If the contractor agrees that it can perform the TO within the parameters of the IGCE, they will sign and return the DD 1155 to the contracting officer. If the requirement remains valid, a priced order will be issued to the contractor.
ii. If the contractor does not agree with the TO and/or IGCE, the contractor shall acknowledge its disagreement within three (3) working days. Additionally, a proposal shall be submitted to the contracting officer within five (5) working days of receipt of the TO and IGCE, addressing only the specific areas of difference in labor categories and/or hours in the IGCE. Once the differences are resolved between the contracting officer and the contractor, and the requirement remains valid, a priced order will be issued to the contractor.
