N00167-16-R-0014 Question Set 3

1) In regards to the fixed fee, is this fee viewed as a research and development contract or is it considered an Architecture and Engineering contract that would be limited to 6% fee?

The Government cannot direct a Contractor on how to propose. This will be a Cost Plus Fixed Fee contract and will be subject to the weighted guidelines method outlined in DFARS 215.404-71.

2) Our proposal will have subcontractors for the some of the labor categories. Are we required to issue cost plus contracts to our subcontractors or will time and materials contracts be acceptable?

There is no requirement for subcontracts to be the same type as the parent contract. FAR 44.202-2 provides Contracting Officer Considerations for consent to subcontracts.

3) Payment for Overtime Premiums: Can the government clarify its position on overtime. “the use of overtime is authorized under this contract if the overtime premium cost does not exceed $0* or the overtime premium. * Insert either “zero” or the dollar amount agreed to during negotiations. How much overtime does the government anticipate on this contract?

The Government neither anticipates nor expects overtime. Any proposals for overtime shall be made in accordance with FAR 52.222-2, Payment of Overtime Premiums.

4) What is the impact of removing a subcontractor from the team?

It would depend on the roles and responsibilities of the subcontractor; the various processes for adding a subcontractor can be found in FAR 52.444-2. FAR 49.502(e) and 49.503(c) provide guidance for clauses to use regarding termination of a subcontract.

5) What approval process will be required to add subcontractors for future work?

The process for adding a subcontractor can be found in FAR 52.244-2, in Section F of the solicitation.

6) Are we only approved to subcontract work to companies included in the original proposal?

No, subcontractors can be replaced in accordance with FAR 52.244-2.

7) What is the process to get an EVMS system approved?

The Contractor should submit an EVMS plan to the Contracting Officer for review. DFARS 234.2102 provides policy regarding a contractor’s EVMS.
