Paragraph 4.1 states, "Known source for Technical Representative and parts:
Wartsila Defense Incorporated"
The contractor suspects that the Errata 04 change of paragraph 3.1 on both 243- 11-003 and 243-12-002 should have been to the entire paragraphs scope of work, not just to delete the 009-09 "Process Control Procedure (PCP); provide and accomplish" and add the 009-90 "Technical Representative; provide" requirement clause without changing paragraphs work scope. The contractor notes that the historical work scope for the Shaft Seal work items the 009-90 paragraph states, "Accomplish the requirements of 009-90 of 2.1 for the services of a qualified technical representative to provide on-site technical assistance, each drawing, special tool and guidance for disassembly, inspection, repair, assembly, testing and adjustment of the equipment listed in 1.3.1 and located in 1.2.1."

(a) For purposes of paragraph (h) of the clause entitled "Government Property" (FAR 52.245-1) in addition to those items of property defined in that clause as Government Property, the following shall also be included within the definition of Government Property:
(1) the vessel; (2) the equipment on the vessel; (3) movable stores; (4) cargo; and (5) other material on the vessel
(b) For purposes of paragraph (b) of the clause entitled "Government Property", notwithstanding any other requirement of this contract, the following shall not be considered Government Property:
(1) the vessel; (2) the equipment on the vessel; (3) movable stores; and (4) other material on the vessel
52.245-1 Alt I Government Property (JAN 2017) Alternate I APR 2012 As stated in FAR 52.245-1 Alt I (h)(1) The Contractor assumes the risk of, and shall be responsible for, any loss of Government property upon its delivery to the Contractor as Government-furnished property. However, the Contractor is not responsible for reasonable wear and tear to Government property or for Government property properly consumed in performing this contract.
C-228-H002 MINIMUM INSURANCE REQUIREMENTS (NAVSEA) (JAN 2019)
(a) In accordance with the clause(s) of this contract entitled "Insurance--Work On a Government Installation" (FAR 52.228-5) and “Liability and Insurance” (DFARS 252.217-7012), as applicable, the Contractor shall procure and maintain insurance, of at least the kinds and minimum amounts set forth below:
As stated in DFARS 252.217-7012 Liability and Insurance:
Please refer to Section I - Contract Clauses, CLAUSES INCORPORATED BY REFERENCE, DFARS 252.217-7012 – Liability and Insurance. The contract must comply with DFARS 252.217-7012 in its entirety.
IAW Section C - Descriptions and Specifications, SCOPE OF WORK, 2. LOCATION:
which states, "The required place of performance for the Availabilities shall be the Contractor’s facility." Additionally, attachment J-3 Execution Milestones and Key Event Date document also identifies the first milestone as, "Avail Start at MSR Facility on Monday, October 4, 2021." These appear to be generalized statements prepared for a coast wide bid for out of homeport (San Diego) bidders.
Work Item 992-11-014 "Temporary Service; provide" Paragraph 3.30.4 states, "Provide ships force a dedicated crane and rigging services at Naval Station for 2 weeks (including weekends), 8 hours per day to support ships force moving off ship from anywhere on the ship. Provide pallets on board the ship for offloading materials."
The contractor has reviewed previously awarded contracts, both Coast wide and SDMAC, and notes that availabilities accomplished in the Port of San Diego start pierside at NAVSTA 32nd Street for the first 14 Calendar days. This allows the customer and ship's force time to prepare the ship to enter contractor’s facility as validated by paragraph 3.30.4 of work item 992-11-014 stated above.
Activities listed are not all inclusive: Ship's Force movement to Berthing Barge and Ship's Force off-load of stores, material, and portable equipment. This also allows the contractor an opportunity to set-up temporary services; installation of staging, drain, disposal, and dewatering of specific water systems; installation of the AN/SPY-1D Antenna Protective Covers and installation of deck protection prior to arrival in the contractor’s facility.
Bidder's Question:
1) Can bidder's assume that if the contract is awarded to a bidder for
If awarded in San Diego, the first 14 days of the avail will be preformed in NAVAL San Diego 32nd Street, then move to the contractors facility.
81 RFP Section C
IAW Section C - Descriptions and Specifications, SCOPE OF WORK, 5.4 PAINT ABATEMENT: which states, "Abatement work will be conducted in accordance with NSI 009-32. Paint abatement will be included as part of offerors proposed pricing and is not subject to additional growth."
Bidder's Questions:
1) Since the ship was last painted in a US Shipyard, has there been any paint applied outside of the United States?
2) If so, verify that all paint applied outside of the United States met NAVSEA Standard Item FY21 Change 0, 009-32, table 1 thru 8 requirements?
USS PINCKNEY has not been painted outside the United States.
82 RFP Section C
C-211-H016 SPECIFICATIONS AND STANDARDS (NAVSEA) (OCT 2018)
(a) Definitions.
(i) A "zero-tier reference" is a specification, standard, or drawing that is cited in the contract (including its attachments).
(ii) A "first-tier reference" is either: (1) a specification, standard, or drawing cited in a zero-tier reference, or (2) a specification cited in a first-tier drawing.
(b) Requirements. All zero-tier and first-tier references, as defined above, are mandatory for use. All lower tier references shall be used for guidance only unless specifically identified below.
None
Bidder's Question:
It is the Contractors understanding that all required references listed in paragraph 2 of a zero-tier specification (work item) are "first tier" references.
However, when a zero-tier specification directs to use a first-tier reference as "guidance", bidders should not estimate the reference and only use it to aid in the development of an estimate of references that are to be accomplished.
1) Please concur or advise on this interpretation.
All zero-tier and first-tier references are mandatory for use in accordance with C-211-H016.
The contractor is responsible for ensuring compliance with mandatory references.
83 RFP Section B
NOTE E: SPECIAL AGREEMENT FOR GROWTH WITH A PRICE OF $25,000 OR LESS
1. To make administration of small dollar value growth more efficient and less costly, both parties (Government and Contractor) agree to a pre-priced value for individual growth items with an estimated price of $25,000 or less. The Contract will include a firm fixed price for growth valued at $25,000.00 or less. Zero-dollar changes and administrative contract changes (for example, drawing revision change where no additional work is required) shall not be executed using the Small Dollar Value Growth procedures, but will follow the change process.
Bidder’s Question:
1) In NOTE E, will the Government clearly identify changes in drawings when they have determined that "no additional work is required"?
A drawing revision change where no additional work is required is being provided as an example of an administrative change which will follow the change process. In the event a change requires growth (which has an estimated price of $25,000 or less), resolution will follow the Small Dollar Value Growth procedures. The Government will not respond to requests for blanket assertions regarding drawing revisions.
84 RFP Section B
NOTE A: LEVEL OF EFFORT TO COMPLETION – SHIP REPAIR
9. The information received in the consolidated final report required by Section C paragraph 6.6 will be used by the ACO in the issuance of one contract modification based on the information received in the final report identified in Section C below, which will be a final settlement for all LOE to Completion labor hours and material dollars. Once the number of labor hours and materials for directed work has been settled, neither party shall be entitled to an adjustment because the expended labor hours and materials differ from the settled price.
This shall not preclude an adjustment otherwise permitted by law and regulation; e.g. fraud, product substitution, defective workmanship or materials.
Each directed work shall receive approval by the SUPERVISOR and the ACO.
(“SUPERVISOR” as defined in NAVSEA Standard Item (NSI) 009-01, paragraph 4.3, refers to the local Government activity responsible for the execution and contract administration of Navy maintenance and modernization work.)
Bidder's Questions:
1) Are these approvals separate from the OQE required by the TIP's?
2) If yes, will the customer define the mechanism by which the ACO will approve
OQE?
3) If not, will the customer define the approvals sought by the Government, The criteria for such approvals, and the mechanism by which the will be approved by the SUPERVISOR and the ACO?
Please refer to the procedures outlined in Section C, para 6 regarding Accountability of LOE to Completion Growth. The SUPERVISOR AND ACO, after agreeing to scope, approve the GMR and the work is then authorized by the ACO. OQE required by TIPs is outlined in NSI 009-04. TIP submissions are made to the SUPERVISOR, not ACO. NSI 009-04 is a Category I NSI required by Section C paragraph 1.1. As such, compliance with 009-04 is base scope, and Section B Note A is not applicable to the base contract requirements to comply and satisfy all requirements of 009-04.
85 J-1 (Work Spec Package) 120-11-001
Work Item 120-11-001 paragraph 1.1 states, "Structural; repair and preserve".
The J-4 Pricing Workbook, USS PINCKNEY - WI Pricing TAB identifies Work Item 120-11-001, Item Description as "Structural Repair and Preservation;
accomplish". The contractor suspects that the item description for 120-11-001 was inadvertently copied from work item 120-11-002 which is correctly identified as "Structural Repair and Preservation; accomplish".
The contractor recommends that the J-4 Pricing Workbook, USS PINCKNEY - WI Pricing TAB be revised to correct the Item Description for Work Item 120-11-001, to state "Structural; repair and preserve" which will than match the J-1 specification title.
Bidder's Questions:
1) Does the customer concur with the contractors above assessment?
2) Will a revised J-4 Pricing Workbook be issued to correct the disparity on the USS PINCKNEY - WI Pricing TAB for the Item Description on Work Item 120-11- 001?
The WI title for WI 120-11-001 has been corrected on the updated J-4.
86 J-1 (Work Spec Package) 251-30-001
Work Item 251-30-001 "Air Intake and Exhaust Louver; preserve" Paragraph 3.6 states, "Accomplish the requirements of 009-32 of 2.1, including Table 2, Line 39, for fluidized bed application for each louver assembly."
The contractor has reviewed 009-32, Table 2, Line 39 and notes that it is for "ALUMINUM SURFACES on SURFACE SHIPS" for "EXTERIOR SURFACES ABOVE BOOTTOP, WITH EXCEPTION OF AREAS RECEIVING NONSKID" where as 009-32, Table 2, Line 31 is for "STEEL SURFACES on SURFACE SHIPS" for "EXTERIOR PORTABLE/BOLTED LOUVERS FOR INTAKES AND UPTAKES" which is normally referenced for louvers.
The contractor recommends that paragraph 3.6 of Work Item 251-30-001 be revised to state, "Accomplish the requirements of 009-32 of 2.1, including Table 2, Line 31, for fluidized bed application for each louver assembly."
Bidder's Questions:
1) Does the customer concur with the contractors above assessment?
2) Will an Errata be issued to correct the disparity on paragraph 3.6 of Work Item 251-30-001?
Do not concur. FY22 NSI shows line 36 and 39 for Louvers interior and exterior.
87 J-2 (References) 262-40-001
Work Item 262-40-001 "Main Reduction Gear (MRG) Lube Oil Cooler; clean and inspect" Paragraph 3.8 states, "Accomplish the requirements of Paragraphs 505-11.1.3.2 through 505-11.1.3.4.2 of 2.6, for each equipment identified in 1.3.1."
The contractor has reviewed reference 2.6 identified in paragraph 3.8 and notes that the referenced paragraphs do NOT exist, but they are in reference 2.7.
The contractor recommends that paragraph 3.8 of Work Item 262-40-001 be revised to state, "Accomplish the requirements of Paragraphs 505-11.1.3.2 through 505-11.1.3.4.2 of 2.7, for each equipment identified in 1.3.1."
Bidder's Questions:
1) Does the customer concur with the contractors above assessment?
2) Will an Errata be issued to correct the disparity on paragraph 3.8 of Work Item 262-40-001?
Concur. Para 3.8 has been corrected. See errata 17.

98 J-1 (Work Spec Package) 721-90-001
Work Item 721-90-001 "ShipAlt DDG51-91735K, MK41 VLS BLVII DDG (Partial);
accomplish"
Paragraph 2.6 identifies "RLAR 91735/DDG91/1198336, Correct Frame Callout (E15)" Paragraph 3.1 states, "Accomplish the requirements of 2.2 through 2.4, including each General Note, Rip-out Note, Special Note and Test Note, in each location listed in 1.2, using material provided in 5.3. (E15)"
The contractor suspects that during the implementation of the changes for Errata 15 to Paragraph 3.1 a typographical error developed resulting in the exclusion of references 2.5 thru 2.6 from accomplishment. The contractor thinks that the intent of the customer was that Paragraph 3.1 should state, "Accomplish the requirements of 2.2 through 2.6, including each General Note, Rip-out Note, Special Note and Test Note, in each location listed in 1.2, using material provided in 5.3. " (E15)
Bidder's Questions:
1) Does the customer concur with the contractors above assessment?
2) Will an Errata be issued to correct the statement in paragraph 3.1 of Work Item 721-90-001 to include reference 2.6 in the work scope?
Concur. WI para 3.1 has been updated to reflect references through 2.6. See errata 17.
99 J-1 (Work Spec Package) 251-30-001
100 Attachment J-2 471-90-001
Work Item 471-90-001 "ShipAlt DDG51-79521K, AN/SLQ-32(V)7 Hardware;
accomplish (OPTION ITEM)" Paragraph 3.2 states, "Accomplish the requirements of 2.2 through 2.35, and
2.57 through 2.67, including each General Note, Rip-out Note, Special Note and Test Note, in each location listed in 1.2, using material provided in 5.3."
Paragraph 2.62 identifies, "LAR 79521/DDG91/1194267, ELECTRICAL, WIRE
CONNECTION, CABLE ROUTING UPDATES FROM REVIEW COMMENTS (E1)"
Its noted that on ref 2.62, page 2 of 214, under the Question or Action Required section it states, "MATERIAL IMPACT: YES" and under the Answer or Action Taken section it states, "THERE IS NO MATERIAL IMPACT BY THIS LAR.
SUBSEQUENT RLAR'S HANDLE MATERIAL IMPACT". The contractor has reviewed ref 2.62 and found that the MATERIAL LIST on page 39 and 40 of 214 does indicate that some materials are GFM, but there are changes throughout the LAR which are not all captured on the noted MATERIAL LIST. For example, page 3 of 214 Zone 8-D, shows changes to the cables and subsequently changes connectors and back shells. On the basic they were all identified as GFM, but the LAR doesn’t specify material sourcing. Additionally, pages 198 thru 214 of 214 identify that RLAR's 1191972 and 1192303 will implement the changes of this LAR, but neither RLAR is identified in this work item or in any item in the specification package.
Bidder's Questions:
1) Are the "SUBSEQUENT RLAR'S HANDLE MATERIAL IMPACT" stated on Ref 2.62, page 2 of 214, the same RLARs identified on pages 198 thru 214 of 214 (RLAR's 1191972 and 1192303)?
1192303 is for the AIT only and not for use by the KTR. The 4720 is a active document that will provide GFM to specific spec. If no parts arrive and they are needed the work will be cancelled. Missing reference(s) will be available upon request and sent via DoD SAFE.
Requests for missing reference(s) shall be directed to Diana L Hutchinson, Contracting Officer and Danene Henry, Contract Specialist, at Diana.L.Hutchinson@navy.mil and Danene.Henry@navy.mil, respectively.

Ref 2.13. RLAR 79521/DDG91/1191973 instructs ktr to incorporate the PPE chill water flow alarm which is to be implemented in its entirety under RLAR
79521/DDG91/1191972.
Is it the Govt's intent to have ktr include pricing to accomplish the installation of the PPE chill water flow alarm under initial estimate for 437-90-001?
If so please provide required RLAR 79521/DDG91/1191972 and associated dwgs for estimating purposes.
