Page 79, Clause H-209- H004
Clause H-209-H004(c) states “It is recognized that the effort to be performed by the Contractor under this contract may create a potential organizational conflict of interest on the instant contract or on a future acquisition. … the right of the Contractor to participate in future procurement of equipment or services that are the subject of any work under this contract shall be limited …”. Organizational Conflict of Interest restrictions for performance on current and future work are typically limited when a Contractor is under contract to provide systems engineering and technical assistance activities. This proposal is largely for manufacturing activities. Should this clause apply, or be removed? If it applies, please clarify the specific scope which creates the need for this restriction and to which this clause applies?
This Organizational Conflict of Interest clause is not limited to only systems engineering or technical assistance activities. The Government does not intend to remove this clause. In the event that the Contractor believes an area of contract scope creates an OCI, it is expected to identify it and a mitigation plan shall be submitted to the Contracting Officer in accordance with FAR 9.5.

Page 139, DFARS 252.209-
DFARS 252.209-7008 subsection (b) states "This solicitation is for the performance of systems engineering and technical assistance for a major defense acquisition program or a pre-major defense acquisition program." Offeror requests this clause be struck as the removed of work does not meet the systems engineering and technical assistance definitions detailed in 48 CFR § 9.505-1.
The clause DFARS 252.209-7008, Notice of Prohibition Relating to Organizational Conflict of Interest—Major Defense Acquisition Program (DEC 2010), has been removed. Please reference Solicitation Amendment 0004.
