About this file
This document provides responses to bidder questions for solicitation number N00024-19-R-5519 from the Department of the Navy Naval Sea Systems Command. The solicitation seeks offers for the Surface Electronic Warfare Improvement Program Block 3 Electronic Attack subsystem production and integrated AN/SLQ-32(V)7 system. Responses clarify that the contractor shall inspect government furnished information and property within 60 days of award rather than 20 days as originally stated. Additionally, the list of government furnished property has been updated to reflect that furnished items are in condition code A except for specific Block 3 systems which are provided "as is" but expected to be in condition A.

RFP Section C 4.0 requires "The Contractor shall inspect GFI and GFP within 20 working days of receipt" but Exh. A CDRLs A057 identifies date of first submission as "60 DAC". Offeror requests that the clauses be reconciled. Offeror also requests, due to the complexities of the GFP, that each clause be updated to require reporting X days after discovery that GFP is deficient.
In accordance with CDRL A057, the contractor shall inspect GFI within 60 days after contract award. Section C para 4.0 has been updated, however, no further changes to GFP reporting.

Each Government Furnished Property item is provided "as-is". Per RFP clause FAR 52.245-1, Government Property, subsection (d)(2)(iii), the contractor has an "opportunity to inspect ...
[but] [a]ny repairs, replacement, and/or refurbishment [of such items] shall be at the Contractor's expense."
Similar to the statement in Delivery Note 3, the Offeror requests that GFE is only provided “as is” if the Offeror was the same contractor who delivered to the United States Government that GFE item. Additionally, due to the complexity of these parts, there is a low likelihood a Contractor will be able to fully inspect these items and a significant risk that a failure will negatively impact Contractor performance despite the identified items not being furnished by the contractor.
Attachment J-3, GFP List, has been updated to add Block 3 systems as GFP for the integration CLINs. These systems are the systems which would be delivered under corresponding production CLINs from this same contract. Block 3 systems are listed as being provided "as is" which is expected to be "A" condition. For all other GFP, the attachment has been updated to reflect that the condition is not as is, and condition code A has been assigned.
