Work Item revised via Errata 2.

8 992-31-002 Work Item 992-31-002 “Ship Defuel and Refuel; accomplish (OPTION ITEM)” Paragraph 3.1 states to, “Coordinate the off-loading and transferring of fluids through the ship's Damage Control Assistant (DCA), via the SUPERVISOR, to maintain ship's stability and to prevent flooding.”

Paragraph 3.1.3 states to, “Provide a fuel barge capable of holding and storing up to 250,000 gallons of fuel from the ship at the contractor’s facility. Any fuel removed from the Ship will be sent to and stored in this barge.”

Paragraph 3.1.4.1 states to, “Submit one legible copy, in hard copy or approved transferable media, of a report listing results of the requirements of 3.1.3 to the SUPERVISOR, which indicates capacity (gallons) and registration number of conveyance within four hours of off-loading petroleum products.”

Paragraph 3.2 states to, “Remove and dispose of liquids, including compensating sea water from compensating fuel tanks, sludge, and debris in accordance with federal, state and local environmental requirements. Contact and coordinate with Environmental Department prior to generating and disposing of hazardous waste.”

Paragraph 3.2.1 states to, “Remove up to a total of 250,000 gallons of distillate fuel (MARINE), 250,000 gallons of contaminated sea water, 2,000 gallons of lubricating oil, and 10,000 gallons of JP-5, using 2.2 through 2.4 for guidance, when directed by the SUPERVISOR. The total quantities of petroleum removed greater or lesser than the quantities listed will be subject to an equitable adjustment.”

Paragraph 3.2.1.7 states to, “Provide storage for fuel removed until completion of availability.”

Paragraph 3.2.4 states to, “Provide assistance to ships force to refuel the Ship, using the fuel stored in paragraph 3.2.1.7 when directed by the SUPERVISOR.”

Contractor notes that in the port of San Diego, CA naval vessels are typically defueled prior to arrival at the Contractors facility and are typically refueled after departing the Contractor facility.

Bidder's Questions:

1. Is it the government’s intent to defuel and refuel the ship in the Contractor’s facility?

Due to contradictory and inconsistent direction provided, the contractor requires clarification of this specification’s intended scope of work.

WI is revised via Errata 2 as follows:

Q1: It is the governments intent to defuel and refuel the ship in the contractor’s facility if the contract is awarded outside of san diego. This Option Item will not be placed on contract if the contract is awarded within San Diego.

2. Paragraph 3.1.3 directs contractor to provide a (1 EA) fuel barge capable of holding up to 250,000 gallons of fuel for storage, paragraph 3.1.4.1 directs to provide a report indicating capacity (gallons) within four hours of off-loading petroleum products, how is this report to be generated when defueling has not yet taken place and the fuel is directed for disposal IAW paragraph 3.2? Q2: The intent of Para 3.2 is to task the contractor with the removal and disposal of liquids other than fuel, which is to be stored. The intention of Para 3.2 is revised:: "Remove and dispose of compensating sea water from compensating fuel tanks, sludge, liquids other than fuel, and debris in accordance with federal, state, and local environmental requirements. Remove and store distillate fuel (MARINE) in the barge provided under 3.1.3. Contact and coordinate with Environmental Department prior to generating and disposing of hazardous waste."

Paragraph 3.1.4.1 may be worked out of sequence. The report must simply be submitted within 4 hours of off-loading petroleum products.

3. Paragraph 3.2 directs contractor to remove and dispose of liquids and paragraph 3.2.1 clarifies quantity and type of fluids for disposal which includes 250,000 gallons of distillate fuel (MARINE). Why is the contractor providing fuel storage for the duration of availability IAW paragraph 3.2.1.7 and 3.1.3 then paragraph 3.2 directs the fuels disposal?Q3: With the revision to para 3.2, fuel will not be disposed of, it will be stored. Paragraph 3.2.1.7 will be revised to state: “Provide storage for distillate fuel (Marine) fuel removed until completion of availability or until directed by the SUPERVISOR to refuel”.
4. Paragraph 3.2.4 directs contractor to assist ships force to refuel ship using fuel retained in paragraph 3.2.1.7, but there is no fuel in the barge paragraph 3.2 directed that it be disposed of. How is the ship to be refueled with no retained fuel, will the government be provide new fuel?

Q4: With the amendment above to paragraph 3.2, fuel will not be disposed of, it will be stored.

5. Paragraph 3.2.1 also directs the disposal of 2,000 gallons of lube oil and 10,000 gallons of JP-5. At some point during the availability, is the government going to provide new lube oil and JP-5 to be on-loaded?Q5: It is not the Government's intent to provide or load any additional Lube Oil or JP-5 other than that needed for the completion of other work items. Other work items shall specify if Lube Oil or JP-5 are needed to be procured by the Contractor.
9992-11-001 & 992-11-022“Messing and Berthing Barge Tow Service, Temporary Service, Equipment and Systems Test, Inspection and Repair in Contractor Plant; accomplish (OPTION ITEM)” and “Habitability Facility; provide (OPTION ITEM)”Work Item 992-11-001 Paragraph 3.1 states to, “This work item is only to be accomplished if contract is awarded within San Diego. If not awarded within San Diego, a separate work item to provide a barge will apply (Option item).”

Work Item 992-11-022 Paragraph 1.2.1 states that the Location of Work will be, “Pierside, Adjacent to the Ship.”

Paragraphs 1.3.1 thru 1.3.9 identify the following:

1. Quantity (One EA), Temporary Kitchen Facility

2. Quantity (One EA), Temporary Dishwashing Facility

3. Quantity (One EA), Berthing Facility, MALE ONLY

4. Quantity (One EA), Berthing Facility, FEMALE ONLY

5. Quantity (One EA), Sanitation Facility, MALE ONLY

6. Quantity (One EA), Sanitation Facility, FEMALE ONLY

7. Quantity (One EA), Multi-Purpose Facility

8. Quantity (3 EA), Office Space, 150 Square Feet

9. Quantity (6 EA), Office Space, 480 Square Feet Contractor notes that work item 992-11-022 does not have a geographical clause or note in the specification, but appears to capture the same requirements as work item 992-11-001, which stipulates that it is only to be accomplished if contract is awarded within San Diego.

Bidder's Questions:

1. Should work item 992-11-022 be identified with a geographical stipulation based on location of Contractor’s facility, as it is written in work item 992-11-001?

Q1: The intent of WI 992-11-001 is to provide services to support a Government furnished barge. If the contract is awarded within San Diego, this work item will be placed on contract.

2. Is it the government’s intent to exercise both or only one of these options based on location of winning Contractor’s facility? Q2: The intent of work item 992-11-022 is for the Contractor to provide a Habitability Facility if the contract is awarded outside of San Diego. This is due to a Government Barge not being available outside of San Diego.

One or the other will be exercised, not both; and is dependent on where the contract is performed.
