Government Responses to Bidder's Questions

Question Number:

Question Source:

(RFP, attachment #, GFI title, etc.)

Page number and paragraph header from source: Question: Government Response

1 Section B, Note C Page 6 of 164, Note C

Solicitation Instruction: The rates, by Government Fiscal Year (GFY), for each direct labor category and the indirect rates provided in Exhibits L0005 and L0006 of Attachment J-8 Cost Exhibits of the Contractor’s proposal shall be the maximum GFY rates allowed under any order placed under this contract.

Question: Based upon potential out-year workload fluctuations and the Navy's new "Contracting Strategy", proposing maximum GFY direct labor and indirect rates through GFY 2021 represents a significant financial risk to prospective bidders. Is this solicitation language focused on Delivery Order cost estimating/negotiations or incurred cost limitations? Request the Navy revise this maximum GFY rate guidance to eliminate the direct labor rates and out-year indirect rates from the Maximum GFY rate scenario. This GFY direct labor rate and indirect rate "MAXIMUM" language is considered unreasonable given the workload uncertainty and labor cost/expense issues associated with the out-years. Please advise soonest.

The inclusion of Note C, maximum rates, provides an appropriate means for the Government to competitively award to a single source now and facilitates reduced administrative effort to place orders under the IDIQ in the future. This maximum rate cap applies to cost estimating for negotiations, and does not limit incurred costs on cost reimbursable orders. On CPAF orders, all allowable and allocable costs are reimbursable. For FFP orders, the successful contractor will be limited to the total price agreed upon, including profit which will be appropriately negotiated commensurate to the scope and risk associated with each future order.

32. Sec C.Item 0002 and 0003.para a

Request a copy of the DDG 1000 Class Design Build Process Specification

(DBPS)

The DBPS is not being provided with the RFP; portions of the DBPS will be provided to the successful contractor as needed after award. All information required to evaluate the 4E specs for proposal purposes are contained within the 4E work specs themselves (J-201)

3 RFP, Section L Page 138, Paragraph A, Physical Format

In the table provided on the subject page, please verify that all items for which the page count is listed as N/A are excluded from the page count.

All items for which the page count is listed as N/A are excluded from the page count.

4 RFP, Section L Page 148, Section IV, Past Performance

The subject paragraph directs offerors to prepare and send out Past Performance Questionnaires (PPQs) provided as Attachment J-13. Due to push back from Government contracting officers/program managers concerning redundant effort, several recent solicitations have specified that PPQs need not be sent out if the availability/contract is already covered by a completed CPARS Report. Will the Government revise the solicitation to include this exception for submitting PPQs?

The RFP is not being amended to include exceptions for submitting PPQs. Please note, however, that as stated on page 148, "offerors will not be evaluated negatively for a lack of past performance questionnaires received in response to this RFP."

5 RFP, Section L Page 138, Paragraph A, Physical Format

The table provided on the subject page refers to a Craft/Trade Staffing Plan in the row for Non-Cost Section IV. The detailed instructions for Non-Cost Proposal Section IV on RFP pages 147 and 148 make no reference to a Craft/Trade Staffing Plan. Is the Craft/Trade Staffing Plan referred to in the table the same as the Manhour and Material Matrix (Attachment J-9) required by the instructions for Non-Cost Section II, Element 2, on RFP page 146? Please clarify.

The Craft/Trade Staffing Plan referred to in the table on page 138 is not the same as the Trade/Craft Hours and Material Exhibit (Attachment J-9) required by the instructions for Non-Cost Section II, Element 2, on RFP page 146. Attachment J-9 is specific to the hours proposed for CLIN 0002 Order 0001 (DDG 1000 Industrial Efforts).

Non-Cost; Section IV: Facilities/Production Capabilities requires Yard-Wide Facility Utilization Data. This data shall be presented in Yard-Wide Man- Power Loading Charts and Yard-Wide Craft/Trade Staffing Plans for the ordering period.

An amendment will be issued to clarify the requirement that yard-wide data shall be presented in man-power loading charts and craft/trade staff plans for the IDIQ ordering period.

Government Responses to Bidder's Questions

6 RFP

Section L, Page 140, (B) General Content Requirements (7th paragraph)

The subject paragraph states, "Submission to the Government of the Offeror's proposal, including the entire RFP…… will constitute an offer…….."

Question: Is it the intent of this paragraph that the Offeror submit the entire RFP with its proposal, or is the intent of this paragraph to just reiterate that the Offeror's proposal including the RFP will constitute an offer but only sections of the RFP requiring fill-ins and signatures are (as opposed to the entire RFP) are to be submitted with the proposal?

In accordance with page 140 (B) General Content Requirements, paragraph 7, "Submission to the Government of the Offeror's proposal, including the entire RFP [minus Sections L and M] and all of its attachments (completed as necessary) -- will constitute an offer and will indicate the Offeror's unconditional assent to the terms and conditions in this RFP and its attachments."

The intent of this paragraph is to instruct the offeror to submit the enitre RFP, minus Sections L and M, with its proposal.

7 RFP Attachment J-101 Attachment J-101 provides 6 work items for various management and support functions to support CLIN 0001. For pricing purposes, please clarify that no individual price breakdown is required for these work items since it appears that the requirements are subsets of the CLIN 0001 SOW in Section C and because, as stated in Section L, Offerors shall propose costs for the Government proovided hours for CLIN 0001 Order 0001."

No individual cost breakdown of the work items for CLIN 0001, Order 0001 is required. The requirements are subsets of the CLIN 0001 SOW in Section C and are provided for offerors to propose costs based on the Government-provided total labor hours expected for this order.

The labor mix for CLIN 0001 should be determined based on the provided CLIN 0001 statement of work and requirements of CLIN 0001- Order 0001, as provided in Attachments J-100, J-101, and J-102.

An amendment will be issued to edit Attachment J-8, L0004 to remove the cost breakdown by Work Item for CLIN 0001, Order 0001 only.

8 RFP

Section L, , Table L-4, paragraph (d) - Attachment J- 8 Exhibit L-4

The description of Exhibit L-004 states that it is specifically for listing subcontractors utilized for CLINs 0002, Order 0001 and CLIN 0001, Order 0001. Please provide clarification of what data requirements may be needed for subcontractors for the CLINs other than 0001 and 0002, in order for all subcontracts to roll up to the total subcontracts on Exhibit L001

In accordance with "Instructions for Attachment J-8 - Exhibit L0003 – CLIN Cost Element Breakdowns," subcontractor costs must also be included in the Offeror’s (prime contractor) cost exhibit. All Subcontractor costs shall be included in the ‘Subcontractors’ section of L0003. The elements identified as Subcontractor costs must exactly equal the cumulative bottom line totals from Attachment J-8-Exhibit L0003 submitted by the Subcontractor(s).

Data requirements for Subcontracts are included on page 155 - Section III: - Subcontractor Cost Data
