The Naval Air Systems Command intends to award an indefinite-delivery/indefinite-quantity contract in December 2020 for CLS services for 17 U.S. Navy and 2 U.S. Marine Corps C-40A aircraft. The solicitation follows earlier sources sought and draft documents. Offerors must submit any remaining questions by April 15th. Proposals are due by May 14th in response to requirements for maintenance, repair, and logistics support for the C-40A aircraft. The pricing for the majority of contract line items is firm-fixed-price.

CDRL CLIN Question/Comment Government Response
General Request further explanation from the Government regarding question number 59 of the latest released answers to questions:
Q: Since method number 1, Contracting Official Signed Certification (COSC), does not require submittal of Contractual Documentation Support (CDS) for Prerequisite, do the columns entitled "Supporting Contract Reference Document Name...," "Page Number," and "Paragraph" need to be filled in, or should they be removed altogether?
The Government's direction pertaining to the above was not made clear. Yes, the Offeror needs to fill-in the columns and “Provide the name, page numbers, and paragraphs of the documents provided in Volume 2 (Prerequisite) that show the contract reference meets each of the requirements identified in Section L, Part B, Volume 2 (Prerequisite) Paragraph 2.1.2.”
Section L Attachments L-2 (Contracting Official Signed Certification (COSC)) and L-3 (Table PREREQ-1 Contractual Documentation Support for Prerequisite (CDS-P)) have been revised in the forthcoming amended Solicitation.
Sec. B B: CLIN Various CLINS -- Per DFAS Memo on 6/12/19 regarding DFARS PGI 204.7103 (d)
| Will the Navy be amending the current "1" "Lot" unit of measure in the CLIN structure? | The quantity and unit of measure will remain as "1 Lot" at this time, as this does not affect proposed pricing. | |||||
| Sec. B | B: CLIN | 31.0 | Att. (1) | 0048 | Pricing for CLIN 0048 is FFP. |
In the event the DAH provides a quote and is not Firm Fixed Price but is a percentage of contract value, maintenance services, or some other non-fixed amount, will the Government update this CLIN to "NTE" to allow the reimbursement of all costs for data access?
| If not, how would the Government propose to handle DAH fees that are not quoted on a FFP basis? | CLIN 0048 will be priced on a monthly basis, regardless of the method by which the Contractor obtains or is charged for access to Non-ICA data. Should the CLS provider be charged in any other manner, the CLS provider is still required to propose in accordance with the Section B FFP CLIN type and provide pricing in Solicitation Attachment L-6, which will become IDIQ Contract Attachment (3), Annual Unit Pricing. | |||
| Sec. C | 11.0 | 11.2.1 | Ground Operating Procedures. |
Para ref NAVAIRINST 3710.1G which has been incorporated into DCMA INST 8210.1C.
| Will the Government please clarify if the GOPs will be derived from the matrix indicated in DMCA INST 8210.1C? | Yes, the GOPs will be derived from the matrix as applicable. | |||
| Sec. C | 30.0 | 30.1 | PWS 30.1, Over-and-Above Labor states: “The Contractor shall develop Contractor approved Local Engineering Directive (LED) repair procedures, that include applicable technical drawings and processes not specifically covered by approved C-40A repair manuals or other referenced documents listed in the Depot-Level Work Specification. The Contractor shall submit the LED in accordance with CDRL A00L, Repair Procedures. Repairs requiring a Form 337 (Major Alteration or Repair) shall be issued by the Contractor with the aircraft logbook entry.” |
This PWS requirement appears to conflict with 14 CFR regulations that directly affect Part 43 compliance:
Mechanic/Authorized Inspectors (IA) and Part 145 repair stations cannot approve work for return to service on an FAA Form 337 unless the work was done in accordance with technical data approved by the Administrator. Reference 14 CFR Sec. 65.95(a)(1) for Mechanic/IA and Sec. 145.201(c)(2) for Repair Stations.
Is it the Government’s intent that the Local Engineering Directive (LED) repair procedures be approved by an FAA Designated Engineering Representative (DER) on a FAA Form 8110-3, Statement of Compliance with Airworthiness Standards before submittal IAW CDRL A00L, Repair Procedures? Yes. The use of an FAA Designated Engineering Representative (DER) to approve Local Engineering Directive (LED) repair procedures is not in conflict with 14 CFR regulations.
Sec. I Section I -- Clauses.
Is performance in Afghanistan contemplated under this contract?
| If not, will the Government remove 252.229-7999? | The Government has removed this clause in the forthcoming amended Solicitation. | |
| Sec. I | Section I -- Clauses. |
Will the Government consider adding 52.232-29?
Alternatively, will the Government allow offerors to propose an "H" clause for addressing early commercial financing allowing the contractor to collect monies at a created event(s), rather than solely based on delivery of goods or services? The clause at FAR 52.232-29 has been added to the solicitation. Specific details of financing will be negotiated at the task order level if appropriate.
