Section H - Special Contract Requirements
H-1 REDUCED PAYMENTS
(a) If the Contractor fails to meet the required Performance Metric Missions Reliability Rate (MRR) in a calendar month on any individual task order, the Contractor's applicable monthly invoice for all Deployment
Services Contract Line Items on that task order shall be reduced based on the procedures identified in paragraph (d) below.
(b) Notwithstanding any reduction of payment under this clause, if delivery or performance is delayed or deficient under the requirements specified, the Government may terminate this contract in whole or in part under the terms of FAR clause 52.249-8, "Default (Fixed-Price Supply and Service)", as found in Section I of this contract.
(c) The Contractor shall not incur reduced payments when performance MRR falls below required levels as a result of causes beyond the control of the contractor and without the fault or negligence of the contractor as defined in FAR 52.249-8, "Default (Fixed-Price Supply and Service)", Section I of this contract.
(d) The following describes performance metrics and the calculation of the reduced monthly invoice for
Deployment Services Contract Line Item payments when performance metrics are not met.
MRR Decrement Factor MRR Decrement Factor
≥95% Full Payment
90% - 94.9% 5%
85% - 89.9% 10%
≤ 84.9% 15%
Performance Metric Missions Reliability Rate
MRR shall be used as the measure of effectiveness for mission performance. MRR is defined as the total credited mission hours completed over the course of a month divided by total scheduled mission hours scheduled over the course of a month. An MRR of 95% is the minimum threshold required for full payment, with a desired MRR of
100%. A credited mission is defined as having the appropriate sensor to accomplish the mission, at the designated location, within the specified time, with the capability of transmitting quality data, as defined in the PBWS, to the supported organization for the hours tasked in accordance with the mission. Total scheduled mission hours are the sum of the daily scheduled mission hours adjusted for cancellations by the Government due to factors outside the
Contractor’s control. The total credited mission hours are the difference between the daily scheduled mission hours minus the mission cancellation hours that result from circumstances that are within the Contractor’s control.
Example of Mission Reliability Accreditation and Calculation
The purpose of this example is to demonstrate the methodology for crediting Mission Reliability.
Mission 1 is a 10 hour Scheduled Electro-Optical (EO) mission. The camera fails in the last 1.5 hours of the scheduled mission resulting in 1.5 hours reduction to credited Mission time. The Contractor is credited with 8.5 hours.
Mission 2 is a 10 hour Scheduled EO mission. A sandstorm blows up during the last 1.5 hours of the mission and the Government cancels the remaining portion of the mission. A 1.5 hour adjustment is made to the scheduled mission changing it from 10 to 8.5 hours. The Contractor is credited with 8.5 hours.
Mission 3 is a 10 hour Scheduled EO mission. The Government extends the mission for an additional hour. The
Contractor is credited with the additional hour. The Contractor is credited with 11 hours.
Mission 4 is an unscheduled high value target of opportunity Infrared (IR) mission of a 4 hour length. The
Contractor successfully executes the mission and is therefore credited with an additional 4 hours towards the monthly total.
Mission 5 is a 10 hour scheduled IR mission. After 4 hours of mission time the UAV has an engine failure. As a result the Contractor loses 6 hours of mission time. The Contractor is credited with 4 hours.
Mission 5A is a follow-on to IR mission 5, with a replacement UAV. The Contractor completes the last 2 hours of the scheduled mission and is credited with the 2 additional hours.
Based on the example above, the credited hours for missions are as follows:
Mission 1: 8.5 hrs
Mission 2: 8.5 hrs
Mission 3: 11.0 hrs
Mission 4: 4.0 hrs
Mission 5: 4.0 hrs
Mission 5A: 2.0 hrs
Total Credited Mission Hours 38.0 hrs
Based on the example above, the adjusted scheduled hours for missions are as follows:
Mission 1: 10.0 hrs
Mission 2: 8.5 hrs
Mission 3: 10.0 hrs
Mission 4: 0.0 hrs
Mission 5: 10.0 hrs
Mission 5A: 0.0 hrs
Total Scheduled Mission Hours 38.5 hrs
Calculation:
MRR = Total credited mission hours completed over the course of a month divided by Total scheduled mission hours scheduled over the course of a month. This ratio (38/38.5) results in a monthly MRR of 99%.
Scheduled Mission Hours does not include transit time.
Credited Mission Hours includes actual hours of unscheduled missions performed.
Credited Mission Hours may include time for sensor data transmitted during transit if scheduled or requested by the
LNO or Mission Commander.
(e) The following is a sample Daily Situation Report (SITREP) to be used for documenting mission performance to be used in calculating the MRR.

H-2 CAT 3 FLIGHT CLEARANCE
A Task Order for Category 3 Interim Flight Clearance efforts will be awarded to each successful Offeror at a firm-fixed price of $100,000.00, Each successful Offeror will receive only one Category 3 Interim Flight Clearance Task
Order for these efforts at a firm fixed price of $100,000.00 regardless if it is awarded Sea-Based, Land-Based, or both and regardless of the number or types of air vehicles the Offeror proposes to use or the completeness of the supporting documentation.
The issuance of this Task Order is not a guarantee that the Contractor will obtain a NAVAIR Category 3 Interim
Flight Clearance. This Task Order contributes $100,000.00 towards the effort of obtaining a Category 3 Interim
Flight Clearance and any expense beyond the $100,000.00 that the Contractor expends to acquire the Category 3
Interim Flight Clearance is the responsibility of the Contractor. It is the responsibility of the Contractor to provide the necessary support and documentation to facilitate the flight clearance process. If the Contractor is unable to obtain the necessary NAVAIR Category 3 Interim Flight Clearance, it will not be able to perform the UAS ISR
Services as required under this contract.
H-3 SENSOR DATA
(a) In accordance with DFARS 252.227-7020 (Rights in Special Works), the Contractor assigns to the
Government the copyright in all sensor data the Contractor generates through its performance of this contract.
