About this file
This file is a Questions and Responses document for RFP 2016000096 Microwave Replacement, issued by the State of Colorado Office of Information Technology (OIT). The project involves design and build services for a microwave backhaul network replacement across five phases, with Phase 1 anticipated to run from June 2016 through July 2017, though these dates are subject to finalization in the resulting contract. The State requires a complete turnkey solution addressing all project systems, subsystems, components, and options. However, transmission lines and microwave dishes associated with critically loaded towers will be installed by the State, which will purchase this equipment from the Contractor. A mandatory pre-submittal conference was scheduled for January 14, 2016, to distribute confidential appendices and allow OIT staff to discuss the project. Prequalification submittals were due January 26, 2016, and selected teams would advance to Step 2 oral presentations and sealed cost proposals. The project must be complete no later than June 30, 2019, with funding provided over a five-year period and a lump sum design/build bid required for all five phases.
Qualifications and corporate experience will be weighted at 60 percent of the scoring matrix, while cost will comprise 40 percent. The State requires bidders to demonstrate prior design/build contracting services within the last five years for at least two projects each exceeding $10 million in hard costs, with all three most relevant projects valued in excess of $10 million. Equipment and labor warranty is three years after each phase is accepted. The project is funded through Capital Construction Funds. For new tower construction, contractors must use one of the State's pre-qualified tower vendors: EasTex Tower Inc., Rex Industries, Advanced Tower Services, and Hudspeth & Associates Inc. All permits will be obtained by the Contractor, and Davis-Bacon wages do not apply to this project. The State will provide a structural assessment of towers identified as 100 percent or above maximum member stress, and contractors are encouraged to minimize equipment loads on existing towers to achieve compliance with current TIA-222 standards.

33
Please clarify the bonding requirement. Isn’t this dictated by statue? And, isn’t the statutory requirement that the bond is sufficient to cover the cost of the project? For example, if the bid comes in at $20 million then the bond would be for $20 million. Further, if each phase will be completed before the next phase is approved and commences, doesn’t the bonding requirement become the amount to cover each phase?
The bonds must cover the full contract amount.
34
Will Davis-Bacon wages apply to this project?
No
35
Since the Appendices to Appendix D won't be available until the 14th of January, will you allow an additional round of questions beyond January 8th?
Yes
36
Appendix B1 and B2 General
The contract included in the RFP appears to be a form of contract which would cover a major design/build construction project such as a new office building. Although a limited number of towers will be built as part of this project, the main purpose of the RFP appears to be the purchase of a microwave backhaul network replacement, the basic design of which is included in the RFP documents, and not a construction project.
Would you consider using a contract form typically used for information technology systems such as the purchase of the microwave network? Differences between a System contract and a Construction contract include different types of warranty provisions. For example, a system contract typically includes both equipment and software warranties and also typically includes a warranty that the system will operate as designed. System contracts also include software license agreements under which the State would have the license to use the software that operates the system. In addition, rather than provisions discussing the right of occupancy or final inspection, typically a system contract will include System Acceptance provisions that describe system functionality tests and operational burn-in tests as discussed in Sections 7.6, 7.7, and 7.8 of Appendix D.
In addition, the construction contract form appears to have sections that are not applicable to a contract to build a microwave system such as the requirement in Section 2.5.13 for 30%, 60% and 90% construction documents. Certainly these are necessary for a construction project, but to build towers, which is the only “construction” element to this project, one round of drawings is typically sufficient.
No, at this time we anticipate using the standard construction contract attached.
37
Appendix D 2.6 This section describes a 70% weight factor applied to qualifications/experience and 30% applied to cost. However, Appendix A2 cites the ratio as 60% qualifications, 40% cost. Just noting this small discrepancy and seeking clarification.
60% qualifications, 40% cost
38
Appendix D 4.1.4 E This section states the contractor shall be responsible for coordination and licensing fees, if applicable. It's common for the contractor to perform frequency searches, assemble and populate information required on FCC applications, and submit completed forms to the customer. Is the State also requiring the contractor pay the FCC application/license fees? This fee is typically paid by the end-user customer.
We want the contractor to be responsible for these costs.
39
Appendix D 4.3.F.2 Are these two TDM drops intended for future TDM traffic after existing TDM traffic is migrated to IP?
Yes
40
Appendix D 4.3.F.5 Please clarify if both TDM and IP traffic need to support Encryption
Per RFP 4.3.F "The microwave radio shall meet the follow minimum requirements...supports Advanced Encryption Standard, Federal Information Processing Standards Publications, AES FIPS PUBS 197, using 256-bit cryptographic key to encrypt and decrypt data in blocks of 128 bits.
41
Appendix D 4.4.C Will Appendix D2 include a DS-1 channel plan, per site (e.g. T1, DS3, OC3), and will the information contain the end points for all existing TDM traffic?
No this information will not be provided as part of appendices. This will be provided to the awarded Contactor during contract negotiations.
42
Appendix D 4.7.A
Is it the State's intent to complete the five phases by June 30, 2019; or do you prefer the vendor to suggest the most realistic schedule based on the design, topology, past experience, etc.?
The State desires that the Contractors propose a schedule as part of the RFP response.
43
Appendix D 5.1.A
This section indicates the State will be responsible for installing all new tower-mounted antenna equipment and transmission lines ordered under this RFP. However, section 1.3.A indicates the State will install transmission lines and microwave dishes (antenna network) associated with critically loaded towers. Will the State install microwave antenna systems on all towers or just the critically loaded towers?
Just the critically loaded towers.
44
Appendix D 5.3.3.G
This section indicates the need for an independent inspection and testing firm. Will the State provide an independent verification entity, as is typical of past projects? Or, is this requirement intended to be performed by the Architect/Engineer and Construction Manager (superintendent) disciplines described in Appendices B1 and B2 RFP 7.4.G.1 states, "The State and the Contractor’s Project Manager shall conduct an inspection of each installation upon substantial completion, and shall document any deficiencies on a single punch list provided to the Contractor for resolution."
45
Appendix D 7.2.C.1 Is the State requiring only the Denver Metro ring/spurs to be staged, such that all other phases/rings/spurs are will not be staged?
All phases/rings/spurs are required to be staged, whether at the vendor's facility or locally. The Denver area equipment should be physically located close to the required vendor facility (per RFP 7.2.C). Please reference Appendix D 7.2.C.2 as for the intent of D 7.2.C.1.
46
Appendix D 7.2.C.2 7.2.C.9
These sections indicate staging will occur in the field (7.2.C.2) while also requiring the Contractor to fund the travel and per diem costs for State personnel to attend a remote staging event. Is it your intent to stage the system in the field, or do you prefer staging to occur at the Contractor's staging facility? If acceptable, we prefer staging to occur at our staging facility.
Per RFP 7.2.C.2 " Staging of the subsystems shall take place in the United States. The intent of the staging tests is to demonstrate to the State that the system is ready for shipment and installation."
47
Appendix D 7.5.B Will the State provide the storage facility for the removed equipment?
RFP 7.5 outlines specific vendor storage requirements answering this question.
48
Appendix D 7.6 7.7 7.8 Is it safe to assume Final Acceptance Testing, Final Documentation and 30-Day Burn-in events are to occur in conjunction with each phase?
Yes, for each phase and then final acceptance upon completion of the entire project.
49
Appendix D 7.9 Is acceptable to execute System Acceptance for each phase, followed by final system acceptance once all phases are complete?
Yes.
