About this file
This is a Minority Business Enterprise (MBE) Participation Acknowledgment form issued by the Rhode Island Division of Equity, Diversity and Inclusion, Minority Business Enterprise Compliance Office. The form is a pre-authorization document required for Multi-Project Agreements (MPAs) and applies to all state-funded and state-directed public construction programs, projects, and purchases of goods and services within Rhode Island. The form requires prime contractors to identify their business status regarding Minority Business Enterprise (MBE), Women Business Enterprise (WBE), and Veteran-Owned Business Enterprise (VBE) certification with the State of Rhode Island, and to provide contact information including an authorized representative's name, phone number, and email address. No specific project details, quantities, response dates, site visits, or award dates are contained in this compliance document.
Rhode Island General Laws 37-14.1 et al. mandate that a minimum of 15 percent of the dollar value of an entire procurement or project must be awarded to MBE/WBE certified businesses. By executing this acknowledgment form, prime contractors must confirm their understanding of and commitment to several compliance requirements, including submission of all executed subcontractor agreements to the MBE Compliance Office, monthly reporting and documentation of payments to MBE subcontractors, immediate notification of any changes in vendors or subcontractors, and immediate notification of all change orders. Failure to comply with these conditions may result in a determination of non-compliance and sanctions pursuant to Rhode Island General Laws 37-14.1 et al. The form requires five separate initials from the authorized signatory, along with a sworn declaration under penalty of perjury that the contents are true and correct.
