About this file

This document is Amendment No. 3 to Solicitation RFP LBNF-357777-JD for the Long-Baseline Neutrino Facility Internal Cryogenics project. The amendment addresses questions submitted by offerors and extends the proposal due date to November 12, 2024.

The scope of work includes engineering, manufacturing, packing, and delivering 30 vacuum insulated and uninsulated cryogenic transfer lines and supports for the first two cryostats at the Sanford Underground Research Facility in Lead, SD. The incoterms are DAP FRA Warehouse. Offerors can use alternate manufacturing facilities but must disclose them in the proposal. There is no on-site installation work required. The successful offeror will be responsible for lower-tier subcontractors. The solicitation is issued by the Department of Energy's Fermi National Accelerator Laboratory.

AMENDMENT TO SOLICITATION

AMENDMENT NO.

DATE OF AMENDMENT:

October 14, 2024

SOLICITATION NO.

RFP LBNF-357777-JD

DATE ISSUED:

September 13, 2024

PROJECT NO.

N/A

PROPOSAL DUE DATE:

November 12, 2024

TITLE OF PROJECT:

LONG-BASELINE NEUTRINO FACILITY INTERNAL CRYOGENICS

Offerors must acknowledge this Addendum prior to the hour and date set forth in the solicitation by one of the following methods:

1. By completing the Subcontractor Annual Representations and Certifications (SARC), or

2. By separate fax, letter, or email.

If by virtue of this Addendum you desire to change a proposal already submitted, such change may be made by email, provided such email clearly references the Solicitation number and this Amendment number and is received prior to the proposal due date.

Amendment No. 3 is issued to answer questions and extend the proposal due date as follows:

Question No. 1: Reference is made to RFP document J4 Internal Cryogenics SOW Section 9.3: Any temporary vacuum equipment needed for installation and/or testing of vacuum insulated pipes shall be supplied by the Subcontractor as part of this SOW. Does the scope include complete vacuum pump setup and if yes, will it be on a daily rate basis and limited duration or for permanent procurement?

Answer No. 1: Vacuum pump setups will only be needed for the tests done at the manufacturer's facility.

There is no installation in the scope. The scope does not include delivery of vacuum pump setups.

Question No. 2: Reference is made to RFP document J4 Internal Cryogenics SOW Section 14 (Deliverables during engineering phase): Develop schedule for the installation and commissioning efforts. On-Site installation and commissioning service is not specifically listed in the scope of work but is repeatedly mentioned throughout the Scope of Work document, and it is also not listed as a possible milestone in other documents. We usually offer on-site services as standard. Can you clarify the scope of on-site services needed so we can include in our quote and preliminary project schedule?

Answer No. 2: There is no on-site work in the scope and none is required. With advance written notice, the Subcontractor may elect to be present during Fermilab’s Incoming Inspection at SURF in South Dakota.

Question No. 3: Reference is made to RFP document J1 FRA General Terms and Conditions for Supplies (03.2024) Section 6.2, ASSUMPTION OF RISK UNTIL FINAL ACCEPTANCE (SUPPLIES): Unless the subcontract specifically provides otherwise, risk of loss of or damage to supplies shall remain with the Subcontractor until, and shall pass to FRA upon – (a) Delivery of the supplies to a carrier, if transportation is f.o.b. origin; or (b) Acceptance by FRA or delivery of the supplies to FRA at the destination specified in the subcontract, whichever is later, if transportation is f.o.b. destination. (a) In the Scope of Work and RFP documents no shipping term is specifically mentioned. However, in the FRA Terms and Conditions two choices are listed, but only if chosen, which are both a F.O.B. variant. Do we understand it correctly, that F.O.B. is to be quoted for all goods to be delivered? (b) Fixed prices are asked for this RFP. However, we also offer the option of submission of costs incurred by our company for shipping with a Handling fee, if that were an option FRA would accept.

Answer No. 3: (a) The incoterms for the internal cryogenics acquisition are DAP--FRA Warehouse (1313 E.

Saint Patrick Street; Rapid City, South Dakota 57701) per Incoterms 2020 (b) The proposed fixed price should be inclusive of the shipping and handling costs.

Question No. 4: Reference is made to RFP document RFP LBNF-357777-JD 09-13-2024 Final, Section L.17, Subcontracting: Unless otherwise specified, the successful Offeror shall be responsible for performance of any lower-tier subcontractor that may perform work under this Subcontract. Performance by a lower-tier subcontractor employee is subject to FRA consent and will be considered in FRA’s evaluation. The FRA Subcontractor must ensure that any lower-tier subcontractor abides by all terms and conditions and requirements of the FRA Subcontract. Question: We will offer from our main manufacturing facility.

Depending on capacity and utilization of machinery and staff, we may have to use another production facility for certain products, which will also be stated in the final project schedule. A paragraph to that effect will be included in our quote. Do we have to include this in our subcontracting plan?

Answer No. 4: As part of our evaluation, it is necessary that Fermilab understand where key components are to be manufactured. We must be able to understand and verify the qualifications/experience of the entity doing the manufacturing per the Evaluation Factors in Section M. Therefore, your proposal should clearly mention the other production facility. If the alternate production facility is a subcontractor (i.e. it is not a wholly owned business unit of the offeror), then it should be reflected in your small business subcontracting plan (if a small business plan is required per Federal Acquisition Regulation/FAR 52.219-9).

An extension has been granted as follows.

The deadline for receipt of offeror questions is hereby changed to October 30, 2024 at 5:00 PM Central (US- Chicago) Time

The proposal due date is herby changed to November 12, 2024 at 5:00 PM Central (US-Chicago) Time

All other provisions remain unchanged.
