About this file

This document is an Addendum to a Solicitation for the Construction Manager-as-Advisor (CMa) services for the Long-Baseline Neutrino Facility (LBNF) Near Site Conventional Facilities (NSCF) project.

The Addendum provides additional information in response to questions regarding the CMa's role in quality control and insurance/indemnification requirements. Specifically, the CMa will be required to have its own quality assurance/quality control (QA/QC) plan, which subcontractors can either follow or have an equivalent plan. The CMa will oversee the construction subcontractors' QC programs to ensure compliance, but the subcontractors will be responsible for their own QA/QC. Additionally, the construction subcontractors will be required to add the CMa as an additional insured, but will not be required to indemnify the CMa in the same manner as the prime contractor, Fermi Research Alliance (FRA). The solicitation number is LBNF-342884-BWQ, with a proposal due date of 5/15/2024.

CONSTRUCTION MANAGER-AS-ADVISOR

Bidders must acknowledge this Addendum prior to the hour and date set forth in the solicitation by one of the following methods:

1. By completing the Representations, Certifications and Acknowledgments (PUR-466), or

2. By separate email.

If by virtue of this Addendum you desire to change a bid already submitted, such change may be made by email, provided such email makes reference to the Solicitation and this Addendum and is received prior to the time set for opening.

This Addendum is providing additional information on the items below:

I. QUESTIONS/RESPONSES (Numbering Continued from Addendum No. 04 QUESTIONS/RESPONSES Section)

36. Will the awarded construction subcontracts require FRA’s construction subcontractor(s) and their tiered subcontractors to name the CMa as an additional insured, in the same manner they name FRA as AI?

Response: The CMa will be added as additional insured on the Construction subcontractor's certificate of insurance.

37. Will the awarded construction subcontracts require FRA’s construction subcontractor(s) and their tiered subcontractors to indemnify the CMa, in the same manner they indemnify FRA?

Response: No.

38. How will the CMa be expected to implement their internationally recognized quality control plan since they are not directing design or construction work on the site? Are all tiered sub-contractors to the CMa required to also have an equivalent program?

Response: There is a distinction between the QA/QC Plan the CMa itself must demonstrate as having, and the work the CMa does in assisting FRA in ensuring the Construction Subcontractors follow their own respective QA/QC Plans. The Corporate Quality Assurance/Quality Control Plan the CMa must demonstrate as having as a Mandatory Requirement in Section M, Part 2.1 of the RFP is the plan the CMa will adhere to in the performance of its own scope. Sub-tiers to the CMa will either follow this plan or have their own plan meeting this requirement.

The Construction Subcontractors will be following their own Project QA/QC Plans that meet the requirements of the US Army Corp of Engineers Construction Quality Management Program. The CMa would be overseeing the Subcontractors' QC Programs to ensure the three phases of control are being carried out by the Subcontractor with preparatory and initial meetings being held in accordance with the requirements. Follow up phase inspections and tests will be performed by the CMa.

ALL OTHER TERMS AND CONDITIONS AS REFERENCED UNDER THE SUBJECT RFP REMAIN UNCHANGED.
