About this file
This is a Labor and Material Payment Bond form issued by the County of Orange, California, required for contractors awarded public works contracts under California Civil Code Sections 9550 et seq. The bond guarantees that the contractor and its subcontractors will pay for all materials, labor, equipment, and supplies used in performing contract work, as well as amounts due under the Unemployment Insurance Code. The bond amount must equal at least the estimated contract value payable by the County. The surety assumes joint and several liability with the contractor and agrees that no changes, extensions, or alterations to the contract terms, specifications, or work scope will affect the bond's obligations. The County maintains the right to pursue claims under the bond for any unpaid labor, materials, or employment-related obligations, with the surety responsible for court costs, reasonable expenses, and attorneys' fees if the County successfully enforces the bond.
The bond is executed by the contractor as principal and a surety authorized to conduct business in California. The document requires proper execution by authorized corporate officers per California Corporations Code Section 313, with signatures from either two designated officers or one officer with written evidence of authority. The bond inures to the benefit of any claimants entitled to file under California Civil Code Section 9100 and covers payment obligations for amounts withheld and paid to the Employment Development Department. The bond form includes blank fields for the bond number, penal sum amount, execution date, contractor identification, surety identification, and approval signatures from the County's CEO/Risk Management office and Office of County Counsel, establishing a comprehensive security mechanism for the specific irrigation controller and master valve installation project at Mile Square Regional Park valued at potentially exceeding $200,000.
