The following comments were received from the respective divisions for this project.

Air Traffic Obstruction Evaluation Group:

This Structure will exceed the RWY 17R/35L Part 77 Transitional surface. Structure must be lighted with red obstruction lights in accordance with FAA Advisory Circular 70/7460-1, Obstruction Marking and Lighting, Chapters 4, 5, and 12. Copy of the current AC 70/7460-1 can be viewed and/or downloaded at https://www.faa.gov/regulations_policies/advisory_circulars/index.cfm/go/document.current/ documentNumber/70_7460-1.

Further, you should contact the Airport Traffic Control Tower (ATCT) Watch Supervisor at DWH prior to the crane(s) being raised for purposes of establishing a procedure to have the crane(s) immediately lowered upon request of the ATCT. When the crane(s) is no longer needed and has been permanently lowered, you should contact the ATCT at the telephone numbers given above and log back into your registered E-file account to provide the Flight Data Center (FDC) with notification that the NOTAM can be cancelled.

A separate notice to the FAA is required for any construction equipment, such as temporary cranes, whose working limits would exceed the height and lateral dimensions of your proposal.

This determination does not constitute FAA approval or disapproval of the physical development involved in the proposal. It is a determination with respect to the safe and efficient use of navigable airspace by aircraft and with respect to the safety of persons and property on the ground.

In making this determination, the FAA has considered matters such as the effects the proposal would have on existing or planned traffic patterns of neighboring airports, the effects it would have on the existing airspace structure and projected programs of the FAA, the effects it would have on the safety of persons and property on the ground, and the effects that existing or proposed manmade objects (on file with the FAA), and known natural objects within the affected area would have on the airport proposal.

When your Airport Layout Plan is updated, please include this new development. In the meantime, we will show this feature on your current ALP approved on 02/09/2021.

This determination expires on March 8, 2024 unless:

(a) extended, revised or terminated by the issuing office.

(b) the construction is subject to the licensing authority of the Federal Communications Commission (FCC) and an application for a construction permit has been filed, as required by the FCC, within 6 months of the date of this determination. In such case, the determination expires on the date prescribed by the FCC for the completion of construction, or the date the FCC denies the application.

NOTE: Request for extension of the effective period of this determination must be obtained at least 15 days prior to expiration date specified in this letter.

The Federal Aviation Administration has completed an aeronautical study under the provisions of 49 U.S.C, Section 44718 and, if applicable, Title 14 of the Code of Federal Regulations, part 77, concerning:

This aeronautical study revealed that the structure as described above would have a substantial adverse effect on the safe and efficient utilization of the navigable airspace by aircraft and/or on the operation of air navigation facilities. Therefore, pursuant to the authority delegated to me, it is hereby determined that the structure would be a hazard to air navigation.

This determination concerns the effect of this structure on the safe and efficient use of navigable airspace by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or regulation of any Federal, State, or local government body.

This aeronautical study considered and analyzed the impact on existing and proposed arrival, departure, and en route procedures for aircraft operating under both visual flight rules and instrument flight rules; the impact on all existing and planned public-use airports, military airports and aeronautical facilities; and the cumulative impact resulting from the studied structure when combined with the impact of other existing or proposed structures. The study disclosed that the described structure would have a substantial adverse effect on air navigation.

The following comments were received from the respective lines of business for this project. The comments don’t necessarily apply to each point in the project, so please refer to the individual case numbers if you have questions. Air Traffic Obstruction Evaluation Group: This Structure at 152 feet AGL will exceed the VFR Traffic Pattern Airspace Airport Horizontal Surface by 4 feet. As defined in the FAA JO 7400.2, 6-3-8, Evaluating Effect on VFR Operations, para. d. Airport Areas, penetration of the VFR Traffic Pattern Airspace will adversely impact air navigation by being a physical obstruction to air navigation or by distracting a pilot’s attention during a critical phase of flight. A structure that exceeds a Part 77 obstruction standard and that exceeds the VFR horizontal, conical, approach, or transitional surface height is considered to have an adverse effect and would have a substantial adverse effect if a significant volume (an average of 1 per week) of VFR aeronautical operations are affected. Potential options to mitigate include but are not limited to: Consulting with the Air Traffic Manager/OSG and Flight Standards to develop and review for suitability and safety, acceptable actions to lessen operational impacts e.g. The closure of the effected runway during construction activities, restricted operations by aircraft category or type of operation, review for impacts to the VFR Traffic Pattern, restrict aircraft in the pattern away from the obstruction, displacement of the runway threshold, etc. If the runway is to remain open, NOTAMs should be coordinated and required to identify the construction equipment location and identify the revisions (if applicable) to the declared distances data due to the construction activity and the structure must be lighted with flags and red obstruction lights in accordance with FAA Advisory Circular 70/7460-1, Obstruction Marking and Lighting, Chapters 3, 4, 5, and 12. Copy of the current AC 70/7460-1 can be viewed and/or downloaded at https://www.faa.gov/regulations_policies/advisory_circulars/ index.cfm/go/document.current/documentNumber/70_7460-1. Airports Division must coordinate with the Airport Authority on mitigating any 20:1 impact. Flight Procedures: The study was submitted in OE/AAA system with 4D accuracy. The following affect will require an FDC NOTAM. NEH = No effect height A/ C=Accuracy Code RNAV (GPS) RWY 35L: CIRCLING CAT A CMDA 660 4D A/C, NEH 301 MSL. (If 1A A/C, then No IFR effect). LOC RWY 17R: CIRCLING CAT A CMDA 660 4D A/C, NEH 301 MSL. (If 1A A/C, then No IFR effect). All requests for FDC NOTAM action must be made utilizing the users OE/AAA account. The Sponsor (or Sponsor's representative) is to log into their OE/AAA account and go to "Search Archives". The aeronautical study number (ASN) associated with the proposed obstruction is to be entered (see FAA determination letter for ASN). If the Sponsor (or Sponsor's representative) is having difficulty using the tool, please contact the OE/AAA support desk at 202-580-7500 or refer to the online instructions. Request must be initiated a minimum of 5 business days prior to conducting operations/construction to allow for processing and issuance of NOTAMS. The Sponsor (or Sponsor's representative) is responsible to verify NOTAMS are active prior to beginning operations. Flight Standards: Hughes Aerospace developed and maintains the PUBLIC instrument flight procedure RNAV (GPS) RWY 17R at David Wayne Hooks Airport (KDWH). We have determined that this proposed new Airport Tower in NRA Study’s will require a 1A AC(Survey) to prevent impact to the minima of this procedure. Please see the attached document for impact to the procedure. This comment is in addition to the previous Flight Standards comments, which still apply.
