E.2 52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)

(A) Basis for Award.

This procurement is being conducted pursuant to FAR Part 15 procedures. The Government intends to award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. A trade‑off process will be used, and the Government may award to other than the lowest‑priced offeror if doing so is determined to provide the best value to the Government.

(B) Evaluation Factors The following factors will be evaluated as part of the trade‑off analysis:

(1) Factor 1 – Technical Capability and Key Personnel The Government will evaluate the offeror’s ability to meet the requirements of the PWS based on the submitted Grounds Maintenance Plan, staffing approach, Key Personnel, required licenses, and qualifications as specified in the Instructions to Offerors. The evaluation will assess the extent to which the offeror demonstrates an understanding of the PWS requirements and a feasible approach to successful performance.

(2) Factor 2 – Past Performance The Government will evaluate the Prime Contractor’s past performance on contracts comparable in size, scope, and complexity to assess the expected level of confidence in the offeror’s ability to successfully perform the requirements of this solicitation. Past performance information may include, but is not limited to, Past Performance Questionnaires (PPQs), CPARS records, and information obtained from other Government or commercial sources.

The evaluation will consider the relevance, quality, and recentness of past performance, including the offeror’s record of meeting contract requirements, providing timely and quality services, effective management of personnel and equipment, and maintaining compliance and professionalism on similar grounds maintenance or service contracts.

The Government may consider information from any available source and is not required to contact all or any references submitted by the offeror. The Government may also consider information obtained from entities or individuals not identified by the offeror.

Offerors that lack relevant past performance, or for whom past performance information is not available, will receive a Neutral Confidence rating. A Neutral rating will not be assessed favorably or unfavorably.

(3) Factor 3 – Price The Government will evaluate the reasonableness of the offeror’s proposed price. Offerors shall submit the completed Price Schedule included in the solicitation. The Government may reject offers that exceed available funding or that are determined to be unbalanced.

(C) Relative Importance of Factors For the purposes of this evaluation, factors are listed in descending order of importance.

Non‑price factors, when combined, are significantly more important than price. The Government may award to other than the lowest‑priced offeror if it is determined to be in the Government’s best interest.

(D) Options The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if option prices are significantly unbalanced. Evaluation of options does not obligate the Government to exercise the option(s).

(E) Notice of Award A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
