About this file

This is a Non-Discrimination and Non-Retaliation Certification document issued by the City of Austin for Invitation for Bid (IFB) 6200 BYS1062. The certification requires offerors to acknowledge compliance with Austin City Code Section 5-4-2 and certify their commitment to non-discriminatory employment practices. Offerors must check a box confirming their compliance, and failure to do so will result in a nonresponsive determination. The certification mandates that contractors take affirmative action in all employment-related decisions, post required notices in conspicuous places, include non-discrimination language in all employee recruitment solicitations, obtain written agreements from labor unions regarding non-discriminatory practices, and require subcontractors with 15 or more employees performing work valued at $2,000 or more to comply with the same standards. Contractors must cooperate fully with the City and Equal Employment/Fair Housing Office in any investigations or conciliation efforts.

The contractor must adopt the City's Minimum Non-Discrimination and Non-Retaliation Policy, which prohibits discrimination based on race, creed, color, national origin, sex, age, religion, veteran status, gender identity, disability, or sexual orientation across all employment activities. The policy prohibits retaliation against employees who inquire about or disclose compensation information and requires immediate reporting of discrimination, harassment, or retaliation to supervisors or human resources. Upon contract award, the contractor must provide the City with its non-discrimination and non-retaliation policies on company letterhead conforming to the City's minimum standards, or the certified policy will automatically serve as the contractor's policy. Non-compliance with these requirements may result in contract termination and suspension or debarment from future City contracts. The certification remains in force for one year from filing and automatically renews annually for the contract term.
