About this file

This document is a Living Wage Program submittal requirement for the City of Austin, Texas, issued under Rule R161-17.14, applicable to the Automatic Door Maintenance, Repair, Replacement, and Inspection contract. Contractors submitting offers on this contract must certify that all employees and subcontractor personnel directly assigned to the contract will be paid a minimum living wage of $22.15 per hour. The submittal requires contractors to provide a comprehensive certification with their offer that lists all assigned employees by name and job title, with this list to be updated as necessary throughout the contract term. Within 30 days of contract execution, contractors must provide individual employee certifications signed by each employee directly assigned to the work. Annual recertifications must be submitted on the anniversary date of contract execution, and additional certifications are required whenever employees are added or changes occur.

The City of Austin reserves the right to periodically review employee data and access employee records maintained in accordance with the Fair Labor Standards Act to verify compliance with the living wage provision. Contractors must maintain basic employment and wage information for each employee throughout the contract term and may not retaliate against employees claiming non-compliance. Violations of the living wage requirement require the contractor to compensate affected employees for the wage deficiency for each day the violation continues. Willful or repeated violations, fraudulent statements on the certification, or failure to comply may result in contract termination for cause, suspension or debarment of the violating firm, or legal action.
