About this file

This document is an Employer Certification form for the Wage Theft Ordinance Responsibility Criteria issued by the City of Austin, Texas, applicable to all employers submitting offers for city contracts. The certification requires employers to confirm under penalty of perjury that they have not been adjudicated for wage theft-related incidents as defined in Austin City Code Chapter 4, Section 4-22-1(G) and (H) within the five years preceding the contract award date. All employers awarded contracts with the City of Austin must complete the City of Austin Wage Theft Training within 30 days of contract award. The form requires the firm's legal entity name, signature of an authorized representative, the representative's printed name and title, the location where signed, and the date of certification. The contract opportunity itself involves providing 19% aqueous ammonia via truckload delivery to Sand Hill Energy Center operated by Austin Energy, the City of Austin's electric utility, for use in nitrous oxide suppression at the facility.

The wage theft certification is a mandatory responsibility criterion for contract eligibility and must be completed prior to contract award. Employers must also agree to abide by the provisions outlined in Austin City Code Section 4-22-5(B) and Section 4-22-6(A). No pricing information, set-asides, contract term details, or other commercial terms are specified in this certification document. For additional information regarding the wage theft program requirements, employers should contact the Wage Compliance Team at wagetheft@austintexas.gov.
