1 11/30/2023 Solicitation 52.212-2 How will the Government evaluate VISA Participation and if the VISA Participant is an affiliate, of some kind, but not the same Prime Contractor company offering a proposal under the NSGB-2 RFP, should the NSGB-2 Offeror annotate this on its Business Proposal?
The Evaluation Criteria States:
"A. FACTOR 1 – VISA PARTICIPATION
In accordance with DFARS PGI 247.573(b)(2)(iii)(B), the Government must provide an evaluation criterion for Offeror participation in the VISA. “VISA participant” as defined for the purposes of this evaluation is as follows:
An entity that is a US-flag vessel operator organized under the laws of a State of the United States, or the District of Columbia, that is a signatory party to VISA, including all United States subsidiaries and affiliates of the entity which own, operate, charter or lease ships and intermodal equipment in the regular course of their business and in which the entity holds a controlling interest.
USTRANSCOM will verify VISA Participant status of the Offerors by validating enrollment with the Maritime Administration (MARAD) and confirming with the USTRANSCOM VISA Contracting Officer that the Offeror has an active VISA Contingency Contract at the time of proposal submission. USTRANSCOM shall evaluate the VISA Participation status on an Acceptable/Unacceptable basis as defined below."
In order to be considered for award, the Prime Contractor offering a proposal under the NSGB-2 RFP shall be both a Voluntary Intermodal Sealift Agreement (VISA) participant, at time of proposal submission, AND considered and registered as a small business under NAICS 483111. Meaning the Offeror/Company submitting a proposal is the same Company holding the VISA contract.
The Prime Contractor offering a proposal under the NSGB-2 RFP does not need to annotate this on its Business Proposal as the USTRANSCOM VISA Contracting Officer will verify the Prime Contractor's VISA Participant status as stated in the Evaluation Criteria.
