SUMMARY OF CHANGES

The following revisions are hereby incorporated as Amendment 0002. Offerors shall utilize the conformed copy of the SF 33 with changes incorporated. All other terms and conditions remain unchanged.

SECTION B – SUPPLIES OR SERVICES AND PRICES

From:

INTRODUCTION

The contract ordering period is from time of contract award through 60 months thereafter with discrete ordering periods by CLIN as specified below.

Ordering Period 1 is comprised of CLINs 0001 through 0014 with an ordering period commencing at time of award through 12 months.

Ordering Period 2 is comprised of CLINs 1001 through 1013 with an ordering period commencing immediately following the conclusion of Ordering Period 1 through 12 months.

Ordering Period 3 is comprised of CLINs 2001 through 2013 with an ordering period commencing immediately following the conclusion of Ordering Period 2 through 12 months.

Ordering Period 4 is comprised of CLINs 3001 through 3013 with an ordering period commencing immediately following the conclusion of Ordering Period 3 through 12 months.

Ordering Period 5 is comprised of CLINs 4001 through 4014 with an ordering period commencing immediately following the conclusion of Ordering Period 4 through 12 months.

The Contractor is obligated to honor the competitively established Section B prices should the Government decide to award one or more task orders during any Ordering Period. The prices are not interdependent upon one another and the Government is not obligated to award any combination of CLINs to utilize the competitively established Section B prices for purposes of task order placement. However, use of any one or more established prices is solely at the Government’s discretion as the Government may determine it appropriate to re-negotiate pricing attributable to a reduction in magnitude of work as may be expected in any Sunsetting program. Also, it is noted there are several instances in Section B where competitively established Section B prices do not exist. This shall not be interpreted to mean the Government does not possess the authority to negotiate a price for task order placement nor shall the appearing of a competitively established Section B pricing for a particular CLIN be interpreted to mean there is any guarantee of task order placement.

Ordering Period 5 is comprised of CLINs 4001 through 4014 with an ordering period commencing immediately following the conclusion of Ordering Period 4 through 12 months.

Notwithstanding the above, the Government reserves the right to unilaterally extend one or more ordering periods by an amount or amounts of time equal to the duration(s) associated with the Option to Extend Services clause (FAR 52.217-8) not to exceed a cumulative six months. Also, the Government may place an order for CLIN 4014 at any time during which performance under the contract is on-going. Performance of the Transition Out task will not occur concurrently with performance of any other task(s) under the contract.

The Contractor is obligated to honor the competitively established Section B prices should the Government decide to award one or more task orders during any Ordering Period. 6.2 Small Business Participation Plan (Factor 4)

In accordance with DFARS 215.304(c)(i), all offerors are required to submit a Small Business Participation Plan identifying the SB, HUBZone, SDVOSB, SDB and WOSB firms it intends to use in performance of the TMIP-J Sustainment program (See Attachment 5). Offerors shall also explain the commitment to use such firms, the complexity and variety of the work small firms are likely to perform, and the proposed small business target percentages of dollars obligated under the contract for Small Business, HUBZone, SDVOSB, SDB and WOSB.

Minimum small business participation plan targets are identified in Section M below.

Small business prime contractors can use their own planned performance in calculating the proposed percentage(s) of small business participation and can revise Attachment 5 to accommodate.

SECTION M – EVALUATON FACTORS FOR AWARD

From:

2.5 Factor 3: Price

The Offerors’ Price will be evaluated using one or more of the techniques defined in FAR 15.404-1 in order to determine if it is reasonable and balanced. Its Total Evaluated Price will be calculated as stated below. Finally, the price proposal will be evaluated for completeness.

(1) Price Reasonableness. IAW FAR 31.201-3, a cost is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business. Normally, reasonableness is established through cost and price analysis techniques as described in FAR 15.404-1.

The Government may determine that an offer is unacceptable, and therefore unawardable, if prices are found to not be reasonable.

(2) Unbalanced Pricing. Offerors are cautioned against submitting a materially unbalanced offer. Unbalanced pricing exists when, despite an acceptable TEP, the price of one or more items is significantly over or under-stated as demonstrated by the application of price analysis techniques. An offer may be rejected if the Government determines the lack of balance poses an unacceptable risk to the Government (FAR 15.404-1(g)).

(3) Total Evaluated Price (TEP). Total Evaluated Price will be calculated by summing the ceiling price for CLINs 0001-0005, 0009, 0010, 1001-1005, 1009, 1010, 2001-2005, 2009, 3001-3005, 3009, 4001-4005 and 4009; plus the proposed firm-fixed-prices (i.e. Amounts and Maximum Amounts) for the following CLINs: 0007, 0008, 0014, 1007, 1008, 2007, 2008, 3007, 3008, 4007, 4008 and 4014; plus the proposed estimated costs, consisting of the government stated forecasted direct cost plus the offeror’s burdening, for CLINs 0011, 0012, 1011, 1012, 2011, 2012, 3011, 3012, 4011 and 4012, plus 50% of the CLINs 4001-4005, 4007-4009 and 4011-4012 evaluated amounts. The Attachment 4 Price Worksheet will be used to accomplish the TEP evaluation.

(4) Completeness. A price proposal is complete if the Offeror provides Price data for all solicitation requirements and the proposed prices are traceable and accurate. The proposed prices are traceable if they can be tracked from the Bases of Estimate (BOEs) (when required) to the Price formats as well as throughout any provided Price volume documents.
