NOTICE FOR FILING AGENCY PROTESTS

It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.

Informal forum with the Ombudsman. Interested parties who believe that a Coast Guard procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the Coast Guard Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103(d)(2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be forwarded to the address below:

SECTION C - DESCRIPTION AND SPECIFICATION

C.1

DESCRIPTION OF WORK:

PART 1 – OVERVIEW AND OBJECTIVES

The scope of this procurement is to accomplish, under the direction of the Contracting Officer, U.S. Coast Guard Surface Forces Logistics Command (SFLC), assigned planning functions and execution of dockside ship repair availabilities (DS), non-scheduled repairs and alterations, and material procurement for the Coast Guard icebreaker CGC HEALY (WAGB 20). Due to a continuing Coast Guard reorganization, some nomenclature in this solicitation reflects SFLC’s prior organizational identity. The cutter is homeported in Seattle, WA at the Integrated Support Center (Pier 36), at which location the work under this contract will take place.

HEALY’s mission generally lasts from March until late September after which the vessel returns to homeport for its annual winter maintenance period. The objective of this contract is to optimize maintenance of the vessel through involvement of the contractor in SFLC’s planning process and through better scheduling, sequencing and rationalization of the production effort.

The Contractor’s efforts under the contract will be integrated into the SFLC A-Team process, outlined in the Naval Engineering Organization and Operating Procedures, MLCPACINST M9000 6E. In such cases, the contractor will be expected to participate at specifically identified points in the process for work item identification, assigned planning and specification development. Planning will be conducted during a defined period prior to the ship’s return from mission. Most repair/maintenance efforts will occur during the annual DS maintenance availabilities. However, work may also be executed at other times include voyage or casualty repairs outside of scheduled repair availabilities.

Note: CGC HEALY is scheduled for a triennial drydocking availability in FY13 (October 2012 – March 2013). As a result, it is likely that CLINs 0007 and 0008 will not be exercised under the contract resulting from this solicitation.

PART 2‑ CONTRACT LINE ITEM DESCRIPTION

The Contractor, under the written direction of SFLC, shall furnish the material, services and facilities (except those furnished by the Government under express provisions of this contract) necessary for the accomplishment of the following work on CGC HEALY.

ITEM 0001 AND OPTION ITEMS 0005, 0007, 0009 and 0011 - PLANNING FOR DOCKSIDE (DS) AVAILABILITIES FOR CGC HEALY The Contractor shall accomplish Planning within the performance period specified in Section F for the specific HEALY DS to the extent SFLC directs in writing after award and as outlined in this Item. The Government reserves the right to perform some or all of these functions internally, or to order these supplies and services elsewhere at its discretion.

Some time after the 1st A-Team meeting, SFLC will deliver to the Contractor the Approved worklist and a general outline of the planning effort for purposes of proposal development. The parties will then negotiate a price for the planning line item. Upon award of the planning line item, the notional planning requirement contained in Attachment J.1a will be superseded by the planning requirement identified in the option award document. Likewise, the Section B price for the notional planning line item will be superseded by the price negotiated for the actual planning requirement.

After award of the planning line item, the Contractor will produce a draft specification and rough-order estimate for SFLC review at A-60. Following SFLC’s review of the draft, the Contractor will incorporate all A-Team comments, finalize the specification, complete document preparation and planning of shipyard production work, including authorized pre-fabrication and LLTM purchases, and any other work necessary to prepare for the specific DS. See Table C-1 for the anticipated planning phase timeline. The following provides an illustrative but incomplete summary of the contractor’s planning responsibilities.

a.

Develop specifications using SFLC’s specification library for recurring work items. During the planning process the Contractor may suggest revisions to such existing SFLC specifications to incorporate lessons learned from previous repairs, realize potential production efficiencies, or to improve the quality of maintenance provided to the ship.

b.

Generate specifications from inception, based upon Current Ships Maintenance Projects, CASREP message, etc.

c.

Accomplish ship checks at the vessel’s homeport and while the ship is on mission.

d.

Technically review and evaluate government and third party engineering changes.

e.

Generate design and configuration changes to ship and ship systems from inception.

f.

Identify, and when authorized by the SFLC, procure, receive, inspect and store Long Lead-Time Material (LLTM).

g.

Produce a draft specification and rough order estimate for SFLC review.

h.

Research and obtain necessary logistics support information such as Provisioning Technical Documentation.

i.

Identify engineering drawings requiring correction and provide proposed solutions.

j.

Provide an integrated production schedule for execution of the DS.

k.

Develop and utilize a progress measurement system to determine the physical progress of the planning and execution phases. The progressing system shall permit a direct comparison of the physical progress of completed work to the integrated production schedule noted in the above subparagraph.

l.

Apply internal quality assurance procedures and those required by MLCPACINST M9000 6E to ensure that procured material, engineering and production work will achieve and maintain required quality standards.

m.

The Contractor cannot modify the basic design features of the engineering data provided by the Government. If the Contractor deems modifications necessary, the Contractor shall notify SFLC with a detailed problem identification and proposed solution. The notice will be reviewed by SFLC and may be incorporated into the authorized planning effort.

n.

Specifications shall be based on a cutter’s Long Range Maintenance Plan (LRMP), Cutter Class Maintenance Plan (CCMP), submitted Current Ship’s Maintenance Projects (CSMP), completed work specifications previously developed by SFLC and other data derived from ship checks and technical information provided by SFLC. Work specifications shall be prepared and stored in order to minimize preparation or revision of specifications for the same or similar work required for other availabilities.

o.

All required engineering, drawing modifications and illustrative material shall be prepared to interpret and define the repair and alterations to the ship.

p.

When authorized by SFLC, all drawings and other data developed by the Contractor shall represent a practical engineering solution based on the best trade‑off between total cost, reliability and maintainability. Such design work will meet the requirement of the General Specifications for Overhaul of Surface Ships, NAVSEA S9AA0-AB-GOS-010, and be formatted as indicated in MLCPACINST M9000 6E.

q.

The Contractor shall develop and submit test procedures in support of work specifications as applicable in accordance with GSO Section 092 and shipyard procedures.

r.

Upon DS option award, the notional DS specification contained in Attachment J.1, the Section B price for that notional specification, and the Section F.4 period of performance will be superseded by the negotiated specification, price and period of performance that appears in the executing document.

s.

The following documents or their subsequent revisions in effect at time of contract award and/or option exercise, as well as applicable current instructions, general specifications, type plans, naval ship technical manuals and directives from the Naval Sea Systems Command shall be used in the technical requirements of work under the Contract:
