There are companies involved in MDDC support that have unique capabilities, processes, hardware, and software that have been developed with Government funding (e.g., TEDAC, TM Ops). It was stated at Industry Day that exclusive teaming would not be permitted. How will the MDA assure that companies do not team exclusively? Exclusive teaming of these capabilities could greatly harm competition.
Some possible inconsistencies were noticed in the Limitations on Subcontracting reference in the Draft RFP Section L and the Small Business information provided in the Industry Day Briefing. Please refer to the Draft RFP for the most up to date and relevant small business clauses.
134.
Does the prohibition on exclusivity extend to companies that are part of a teaming agreement or Joint Venture?

This section states that the “Sample Task provided and evaluated under this solicitation may or may not be executed. The PoP for each additional TO will be determined at TO award.” Please clarify if the Transition period will be treated as a separate Task Order or how the Transition Period will be awarded. (Section L-1.1 para 1)
At this time, the transition period is planned to be an individual standalone Task Order.
136.
Please clarify the government’s intent if all Task Orders will need to be in place by the end of the transition period (no more than 45 days). (L-1.1 para 1; L-6.4 item3; M-6.4 item3)
The government does not foresee all Task Orders being in place at the end of the transition period. Task Orders will be issued as requirements emerge and funding is provided.
137.
L-8.9 states that the "total evaluated price" is calculated as follows:

1. Total evaluated price = (offeror fully burdened fixed labor rates) x (Gov't defined notional labor hours) + (offeror fixed ODCltravel burden factors) x (Gov-defined notional ODC/travel costs)

2. This "total evaluated price" is "to facilitate comparison of offers."

3. This method of preparing "total evaluated price" means that offeror can vary only rates - FBFLRs by year and ODC and travel burdens by year.

4. This means that there is no application of any efficiencies or improvements in the contractor's approach that could reduce hours and corresponding cost/overall price.

How does the Government intend on evaluating staffing efficiencies proposed on the basic contract? (L-8.9) Please be aware that Section L has been revised for the Draft RFP.

For evaluation purposes, the total number of hours is fixed. The LOE nature of this effort does restrict an offeror’s opportunity to propose reduced hours. An offeror can still demonstrate an understanding of the requirements by proposing an appropriate skill-mix within the overall LOE provided in the RFP. One attribute of an appropriate skill-mix is that it utilizes staff efficiently.

138.
The Government has requested profit rates. How will these be evaluated? (L-8.11)
Section L has been revised for the Draft RFP.
139.
For the 50% rule concerning a team: Is a series of bi-lateral teaming agreements between a prime and teammates sufficient documentation for a "team," or is a single, collective teaming agreement among all parties required? (L-8.13c)
Some possible inconsistencies were noticed in the Limitations on Subcontracting reference in the Draft RFP Section L and the Small Business information provided in the Industry Day Briefing. Please refer to the Draft RFP for the most up to date and relevant small business clauses.
140.
DRFP L-8.13.b & c – Implies that multiple small businesses can count toward meeting the 50% result using a teaming agreement approach that does not form a formal JV. Recent case law involving Edwards AFB, Tybrin, and CenTech appears to have invalidated this approach. Namely, Edwards AFB and the SBA supported CenTech’s approach to allow three small businesses to count toward the 50% rule. However, the final ruling upheld Tybrin’s protest which resulted in the award to CenTech being vacated. Does MDA have case law which would give the contractor community confidence that the suggested approach listed in L-8.13.b & C will withstand a protest?
Some possible inconsistencies were noticed in the Limitations on Subcontracting reference in the Draft RFP Section L and the Small Business information provided in the Industry Day Briefing. Please refer to the Draft RFP for the most up to date and relevant small business clauses.
141.
Teaming Partners may have an important but narrow role on a team, would the Government consider changing the minimum threshold for teaming partner performance information sheets (Section L-7.2) from three to one, enabling better alignment with a teaming partner’s role?
Some possible inconsistencies were noticed in the Limitations on Subcontracting reference in the Draft RFP Section L and the Small Business information provided in the Industry Day Briefing. Please refer to the Draft RFP for the most up to date and relevant small business clauses.

Please explain the use of CLIN 2. It is FFP, but is it a task order based CLIN, where specific requirements over the 10 year period of performance can be added and managed as separate ID/IQ tasks (per SOW 2.1)? (a) Will it be bid in the proposal as one large labor hour total to set the ceiling for CLIN 2?
CLIN 0002 is has been revised for the Draft RFP; however, CLIN 0002 value/hours will be the ceiling for labor for the basic contract.
143.
