Questions & Answers #4

1) I would like to respectfully inquire about any controlled Documents associated with the RFP?

Answer: There are not controlled documents associated with the RFQ.

2) Per the latest Q&A, questions #20

20) With the new FCL requirement, can you confirm that I Joint Venture does NOT have to have an active FCL as long as the JV Member companies are cleared at the required level per the SBA regulations, 13 CFR 121.103 (h), and NISPOM 2-102b? Please clarify? Answer: The Joint Venture entity is required to have an active Secret Facility Clearance at time of quote submission. In accordance with this DSS guidance (full link below), “if you form a JV that is awarded a classified contract, the JV entity will require a FCL. This applies to all JVs, regardless if the separate entities of the JV currently hold a FCL.”(https://www.dcsa.mil/Portals/91/Documents/Contact/DCSA_SB_Guide_Facility_Clearance_Proces s.pdf ?ver=2020-05-12-184040-170 and https://www.state.gov/facility-security-clearances-faq/ )

However, The GAO ruling outlined in the articles below contradicts your answer.

GAO Affirms SBA Rule: Only Joint Venture Members, not the JV, Need Facility Clearance - SmallGovCon GAO: Small Biz Joint Ventures Can Use Member FCLs to Pursue DoD Contracts | Maynard Cooper "Bottom line, GAO affirmed that a joint venture does not have to hold the facility clearance where its members do hold the required facility clearance. This is a strong affirmation of SBA's rules and Congressional intent regarding joint ventures.Sep 21, 2021"

Please provide an updated Q&A reaffirming that JV whose partners do hold clearance are eligible to submit bids.

Answer: The Offeror must have a Secret FCL at time of quote submission.

The Quote shall provide documentation evidencing that the offeror (Prime) holds, at a minimum, an active Secret Facility Clearance as accredited by the Defense Security Service (DSS) at time of quote submission. (Reference; DoDM 5220.22 and Section 1629 of the 2020 NDAA provision).

o Joint Ventures (JVs) – The JV Entity is not required to have a Secret FCL pursuant to section 1629 of the 2020 NDAA provision IF ALL joint venture partners possess Secret FCLs as accredited by DSS at time of quote submission.

Post award

• The NSW’s Security Programs Division will ensure the JV agreement details the terms under which the joint venturers have agreed to provide their employees to perform the required tasks, and the terms of the contract. For purposes of exchange of classified information and visits among the joint venturers, the general rules applicable to the exchange of classified information and visits between prime and subcontractors will apply.

• If relying on section 1629, after award and prior to the start of performance, the Government may have to submit and obtain an approval for exception to policy through DoD.

o Subcontractor(s) - If any proposed FTE is employed by a subcontractor, then the subcontractor shall ALSO have at a minimum an active Secret Facility Clearance as accredited by the DSS at time of quote submission.

3) (n) QUOTE FORMAT AND CONTENT: The quote shall consist of three (3) volumes: (I) Administrative, (II) Technical Capability and (III) Price.

The paragraphs that follow above and listed under evaluation criteria, there are four (4) volumes identified instead of three as above:

VOLUME I - ADMINISTRATIVE

VOLUME II – SECRET QUALIFYING CRITERIA – FACILITY CLEARANCE (Pass/Fail)

VOLUME III – TECHNICAL CAPABILITY

VOLUME IV – PRICE

Please clarify all four (4) proposals are required and titled accordingly.

Answer: The quote shall consist of four (4) volumes. See revised FAR 52.212-1

4) (d) TECHNICAL CAPABILITY (Volume III)

• More substantial experience will be evaluated more favorably if it benefits the Government.

o Is substantial experience the same number of in same position? Or, years with Navy? Or breadth of work?

• Experience working with or for Naval Special Warfare will be evaluated more favorably.

o Will experience within Navy agency qualify?

Answer: The Government cannot provide answers to hypothetical questions. It is up to each offeror to determine how to meet or exceed the stated qualifications.

5) VOLUME III – TECHNICAL CAPABILITY

• The Quoter shall limit this Technical Volume to 2 pages for each resume, 8 pages total. The letter of intent is limited to 1 page for each FTE, 4 pages total. The cover page and table of contents do not count towards the page limitation.

Please confirm that 2 pgs resume plus 1 pg LOI means we submit a total of 12 pgs instead of 8 pgs total (4 resumes x 3 – 12 pgs)

Answer: Confirmed. See revised FAR 52.212-1.
