INSPECTION AND ACCEPTANCE
SECTION E ‑ INSPECTION AND ACCEPTANCE
E.1.
Roles of Government Personnel and Responsibility for Contract Administration
E.1.1 Contracting Officer (CO): The Contracting Officer is the final authority in all contractual matters relating to this contract as well as to any design, construction, or other type of contract associated with this contract. The Contracting Officer has overall responsibility for administration of this contract and is authorized to take action on behalf of the Government to amend, modify, or deviate from contract terms, conditions, requirements, specifications, details, and/or delivery schedule. The Contracting Officer may delegate certain responsibilities to authorized representatives.
E.1.2 Contracting Officer's Authorized Representative (COR): The award letter will indicate who has been designated as the Contracting Officer's Authorized Representative to assist the Contracting Officer in the discharge of responsibilities. Responsibilities of the COR include: determining the adequacy of performance by the contractor in accordance with the terms and conditions of this contract; acting as the Government representative in charge of work at the site(s); ensuring compliance with contract requirements insofar as the work is concerned; and advising the Contracting Officer of any significant factors which may cause delays in performance of work. All service to be provided under this contract shall be delivered to the COR, except for those services reserved to the Contracting Officer and identified as reserved in this contract or in the memorandum delegating authority to the Contracting Officer's Representative.
E.1.3 Contract Inspectors: Other government or contract personnel may be assigned to assist the COR with the responsibility for day-to-day monitoring of the contractor’s work. The responsibilities of the contract inspector include, but are not limited to: inspecting the work to ensure compliance with the contract requirements; following through to assure that all defects or omissions are corrected; conferring with representatives of the contractor regarding any problems encountered in the performance of the work and generally assisting the COR in carrying out his/her responsibilities.
E.2.
Documentation of Inspection and Acceptance.
E.2.1.
The COR is responsible for the performance of inspections of deliverables upon receipt by the Government and/or evaluations of services completed to date, documentation of every inspection/evaluation, and providing the Contractor with copies of all inspection/evaluation reports. Where product or service warranties apply, these must be provided by the Contractor at time of delivery or completion of work/services.
E.3.
FAR 52.246-4 - Inspection of Services - Fixed Price (Aug 1996).
E.3.1 Definitions. "Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.
E.3.2 The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
E.3.3 The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.
E.3.4 If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
E.3.5 If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may (1) require the Contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.
E.3.6 If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may (1) by contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service or (2) terminate the contract for default.
