About this file
This is a Certification of Drug-Free Workplace Program form issued by the State of Florida Department of Management Services for ITN No. DMS-26/27-025 related to MyFloridaNetwork-3. The form establishes the requirements that bidders must meet to receive preference in the award process when competing bids are equal in price, quality, and service. Bidders must certify compliance with six specific requirements: publishing a statement prohibiting unlawful manufacture, distribution, dispensing, possession, or use of controlled substances in the workplace; informing employees of drug abuse dangers and company policy; providing each employee engaged in the contract work a copy of the prohibition statement; notifying employees that compliance is a condition of employment and requiring them to report convictions within five days; imposing sanctions or requiring participation in drug abuse assistance programs for violating employees; and making good faith efforts to maintain a drug-free workplace. The authorized representative of the responding organization must sign the certification, acknowledging that false statements are punishable under law.
The form serves as a compliance certification document rather than a procurement specification document and does not contain pricing information, set-asides, funding sources, or contract term details. Instead, it functions as a preference mechanism under Florida Statutes Section 287.087, allowing businesses that have implemented certified drug-free workplace programs to gain competitive advantage in the state procurement process. Bidders responding to ITN DMS-26/27-025 must complete and submit this form as part of their proposal to demonstrate eligibility for drug-free workplace preference consideration.
