About this file
This is a Justification and Approval (J&A) document for other than full and open competition submitted by the Department of Veterans Affairs for a sole source acquisition.
The South Central VA Health Care Network (VISN 16) is procuring Alaris System Maintenance Software for the Alaris Support Program (Alaris Infusion System) to support multiple VA facilities in Louisiana, Arkansas, Texas, and Mississippi. The Alaris Infusion System is a proprietary medical device used across these facilities to administer fluids, medications, and nutrients to patients in a controlled manner. The acquisition includes a base year of twelve months and four optional one-year periods. CareFusion Solutions, LLC. (UEI: E99HA2K3YTG8), a subsidiary of Becton Dickinson and Company, is the Original Equipment Manufacturer and sole source for this software. The OEM does not authorize third-party maintenance providers, resellers, or distributors, and using non-OEM maintenance technicians invalidates warranties. The justification cites 41 USC §3304(a)(1) (only one responsible source and no other supplies or services will satisfy agency requirements) as the statutory authority for this non-competitive procurement. Although conducted as a brand-name-only competitive solicitation under FAR Part 12, the specification restricts competition to vendors capable of providing the specified OEM product. The Contracting Officer will make a price fair and reasonableness determination prior to award in accordance with FAR 12.204(a). The document was certified by Biomedical Engineer Devang J. Patel, approved by Contracting Officer C. Robert Oravetz, and approved by Branch Chief John L. Walker, Jr. on July 1, 2026. The total estimated acquisition cost was redacted for public notice posting.

Pear Orchard Road, Plaza 1, Ridgeland, MS 39157
2. Nature and/or Description of the Action Being Approved: The specific (brand name only) services being requested are the following: Alaris System Maintenance Software for Alaris Support Program (Alaris Infusion System). The Alaris Infusion System (and the Alaris System Maintenance Software to support this system) is proprietary in nature having unique features, characteristics, and attributes that are unique to this proprietary system. The estimated period of performance for this acquisition is a base year (of twelve (12) months) and four (4) option years (that are each twelve (12) months in duration). The total, estimated cost of this acquisition is $XXXXXX **Retracted for public notice posting. See detailed description in Item 3.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The South Central VA Health Care Network (VISN 16) oversees and supports multiple VA facilities that are located in Louisiana, Arkansas, Texas, and Mississippi. As part of their veteran patient care mission these facilities (at these locations) continually use medical infusion devices to treat patients with varying medical conditions. Medical infusion devices are vital medical systems used to administer fluids, medications, and nutrients into a patient's body in a controlled and precise manner. They are extensively deployed across clinical settings, including hospitals, ambulatory care centers, and home healthcare, to ensure strict adherence to dosing schedules. At these facilities utilization of medical infusion devices (by providers to treat patients) is currently being accomplished and facilitated through use of the following: Alaris Support Program (Alaris Infusion System). This system/program is fully integrated within and is a vital component of the patient care delivery system at all of these facilities to treat patients. Continued use of this critical program/system requires the purchase of Alaris System Maintenance Software to ensure that this program/system operates at full functionality and at the recommended (and at the optimum) level per Original Equipment Manufacturer (OEM) guidelines.
Requirement For Brand Name: Brand Name, Exact Offerings Only are required for this acquisition. Or equal, or equivalent, alternate, and/or substitute offerings will not meet the government requirements (and these non-brand name offerings cannot be modified or altered to meet government requirements). **The Alaris Support Program (Alaris Infusion System) requires the use of Alaris System Maintenance Software. Other (non-Alaris) software offerings are not compatible with and cannot be used when operating/using this program/system. Proprietary interfaces and (manufacturer imposed) system security limitations/accesses prevent alternative software support venues from being utilized with the Alaris Infusion System.
4. Statutory Authority Permitting Other than Full and Open Competition: The Statutory Authority Permitting Other than Full and Open Competition is the following: 6.103-1 Only one
VHAPG Part 806.3 OFOC Page 2 of 4 Revision: 04 Effective Date: 12/15/25 Acquisition ID#: 36C256-26-AP-3426 responsible source and no other supplies or services will satisfy agency requirements. It is specifically noted that competitive acquisition procedures will be utilized for this acquisition but brand name only services are required (and will only be accepted by the government), which in turn restricts competition. The associated regulatory guidance is 6.103-1(d) which states the following:
(d) Application for brand-name descriptions. Except as authorized at 6.103-5, use of brand-name descriptions, or specification of attributes peculiar to one manufacturer, prevents full and open competition and should only be used when justified and approved according to 6.104. This does not apply to “brand name or equal” descriptions as they provide for full and open competition.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies): Utilizing a competitive solicitation, the Government will solicit all sources that can provide the specified brand name only services that are required. Although the OEM is the only manufacturer, this is a brand name only competitive acquisition, and a full-and-open competition will be conducted among any vendors capable of providing the brand-name OEM product.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Needed brand name only services are to be acquired competitively utilizing FAR Part 12 procedures. Prior to award, a price fair and reasonableness determination will be made by the Contracting Officer in accordance with the criteria outlined in FAR 12.204 (a).
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: In accordance with applicable regulation and policy limited market research was conducted for this procurement. A review of the Contract Opportunities (betasam) website found that these services have been acquired non-competitively in past procurements by other VA facilities. CareFusion is the OEM manufacturer of the Alaris System Maintenance Software.

An acquisition using brand name only specifications does not permit full and open competition; however, the Government will solicit all sources that can provide the specified brand name item.
