FAR Part 6 Justification and Approval for Other than
Full and Open Competition
1. Contracting Activity: 182 MSG/MSC, 2416 S. Falcon Blvd, Peoria, IL.
2. Description of Action: The 182 Airlift Wing requests a firm fixed price construction contract with the successful 182AW Construction Multiple Award Task Order Contract (MATOC) Indefinite Delivery Indefinite Quantity Contractor. The Government projects award for September 2020 and fiscal year 2020, funds type Operations and Maintenance funds will be used. The estimated profit will be negotiated as part of the individual task order award.
3. Description of Supplies/Services: 1) Locks and latches, Manufacturer: Best, Product: Locks and Cores; 2) Exit Devices, Manufacturer: Schlage Everest Primos Full-size 6-pin interchangeable cores, Level 9G; Quantities of each item are listed within the solicitation W50S7T-20-R-0001, Attachment 3 – Seed Project Specifications Project No
JLQN152006.
4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2) and 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements, and brand name descriptions.
5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.
For the Locks, Latches, and exit devices, Civil Engineering and the Base Fire Personnel have agreed to a standardized keying system for all facilities’ locking mechanisms and have been in use effectively on all our facilities since the base contracted with BEST in 1992. The 182nd Airlift Wing uses this system along with controlled issuance, key control logs, building manager accountability, periodic inspections to comply with Air National Guard Instruction (ANGI) 32-1001 P2.2.25. The standardized key system allows for a master key to be available for each building. One master key for each building allows fire safety personnel to expeditiously clear rooms during emergency situations. The inclusion of a secondary key system would increase the time and costs associated with maintenance, training of maintenance personnel, and adjustment of emergency management plans and associated response times. The 182nd Airlift Wing has an internal master key system utilizing the Best 7-pin locking system. Other locking systems will decrease functionality of security and safety procedures.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 as part of the solicitation and any bids or proposals received shall be considered.
a. Effective Competition: Effective competition will be achieved. There are currently no other manufacturers of the Best 7-pin locking system. However, BEST is sold by at least 12 different vendors on GSA and through open market sources for the 9K cylindrical locks. BEST cylindrical locks have also been provided by three different construction contractors on former contracts. Each of the other manufacturers have retail sellers on both GSA and in open market suppliers.
b. Subcontracting Competition: Subcontracting competition will be achieved by the prime contractor soliciting small businesses for all of the aforementioned requirements listed within section 3.
7. Actions to Increase Competition: There are currently a plethora of competition in contractors that sell each of the products listed within section 3 of this J&A. There is not currently any plans to further increase this competition.
8. Market Research: Market research was conducted through searches on GSA Advantage and previous construction contracts conducted at the 182nd Airlift Wing. The Civil Engineering Government Purchase Cardholder makes quarterly purchases of necessary supplies for the items noted within section 3 for every facility on the installation.
9. Interested Sources: K-D-L Hardware Supply Inc, 850 Poplar Place S, Seattle, WA 98144; Grainger, Inc., 100 Grainger Parkway A2C55, Lake Forest, IL 60045; The Office Group Inc., 372 Wythe Creek Rd Ste C, Poquoson, VA 23662-192; Wrigglesworth Enterprises, Inc., 3516 S College Rd, Wilmington, NC 28412-0912; Galaxie Defense Marketing Services, 5330 Napa St Ste A, San Diego, CA 92110-2613; WECsys LLC, 8825 Xylon Ave N, Brooklyn Park, MN 55445; SPS Industrial Inc., 3324 SE Gran Park Way, Stuart, FL 3499-390; SEVA Technical Services, 700 Mobjack Pl, Newport News, VA 23606; KPaul Properties LLC, 5616 W 74th Street, Indianapolis, IN 46278.
10. Other Facts: The government will provide a core at no cost to the contractor. The contractor is only responsible to provide a barrel capable of accepting the Best 7-pin locking core. A different system would require government personnel to receive training on how to incorporate a different master key system. In order to maintain the same level of response times for fire safety personnel, the remaining locks on base would be required to change over to the new master key system. The cost of making these changes would be cost prohibitive to completing this project.
