a. Special Contract Requirement H314, Engine Upgrade Effort, is hereby amended as set forth below:
From:
H314 ENGINE UPGRADE EFFORT (ASC/WNZJC) (OCT 2010)
(a) The T-6A/B Texan II aircraft is currently undergoing a two-phased engine upgrade effort for its engine with the T-6A/B OEM (Hawker Beechcraft Corporation) and the Engine OEM (Pratt and Whitney - Canada). The effort to upgrade the PT6A-68 engine is a redesign to the second stage carrier Reduction Gear Box (RGB). The resulting engine configuration will be certified utilizing required FAA certification processes. Beginning in November 2010, all engines delivered with new Production aircraft (and spares) will be delivered in a Phase II configuration.
(b) The effort to upgrade Phase I engines to Phase II engines began in September 2010 and will be complete by June 2019 (based on an assumed 40-hour/month utilization rate). All efforts to upgrade engines to a Phase II configuration shall be accomplished at the same time as each of these engines come due for a 4,500 hour major time change/overhaul.
(c) Any engine that has not reached a Phase II configuration shall be upgraded to Phase II configuration at its 4,500 hour (or next immediate) scheduled overhaul. All efforts and associated costs to logistically support the upgrade to the Phase II engine configuration are the responsibility of the COMBS contractor.

b. Special Contract Requirement H317, Liquidated Damages, is hereby amended as set forth below:
From:
H317 LIQUIDATED DAMAGES (ASC/WNZJC) (OCT 2010)
(a) The amounts set forth for payment in Section B, CLIN 1XXX Series are based on the Contractor's COMBS Services Operations effort at each installation satisfactorily meeting the key performance parameters, as set forth in the PWS paragraph 1.1.A.1. Should the Contractor fail to meet these required percentages at any installation, a reduction will be made to the net amount due the Contractor for CLS effort at that beddown location in accordance with paragraph (f) of this clause. Other material discrepancies (items listed in the IPC but not listed in the Minimum Essential Subsystem List/Minimum Essential Subsystem Matrix (MESL/MESM) (Section J, Attachments 15, 16 and 17 herein)) shall be received within 30 days after receipt of the demand.
(b) The Contractor Logistic Support manager and the Functional Director (FD) or any Contracting Officer Representative (COR), shall determine the hours chargeable to the contractor for NMCS, PMCS, Other Material Discrepancies (OMD), and NMCM (SE). This determination shall be accomplished within 10 working days after monthly issuance of the Air Force Instruction (AFI) 21-103/NALCOMIS data.
(c) Chargeable NMCS, PMCS, OMD, and NMCM (SE) hours will include all supplies, parts, bench stock and LRUs (including engines) required to support the aircraft (Ref: AFI 21-103 and PROCESS FOR
RECORDING AND REPORTING NMCS/PMCS TIME FROM NALCOMIS).
(d) If the Government terminates this contract in whole or in part under FAR 52.249-8, Default (Fixed- Price Supply and Service), the Contractor is liable for liquidated damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
(e) The Contractor will not be charged with liquidated damages when the delay in delivery or performance arises out of causes beyond their control and without fault or negligence of the Contractor as defined in FAR 52.249-8, Default (Fixed-Price Supply and Service). Liquidated damages will not be assessed due to parts or material not available due to unavailability of funds or being removed from the Contractor's repair cycle for Government directed inspection/analysis or for maintenance tooling.
NMCS/PMCS relief will be granted up to the quantity of parts or material removed from Contractor's repair cycle in support of Deficiency Report (DR) investigations.
(f) For each hour in a given calendar month (1st day of month through last day of month) that the mission capable rates are not met due to Contractor fault the Contractor shall be required to pay the Government an amount as calculated using the example set forth below:
(1) Amortization computation for the hourly rate:
(i) Aircraft Acquisition Cost = T-6 Aircraft unit fly-away cost per the current version of AFI 65-503 Attachment A10-1.
ACQ = Unit Price $6,342,000
(ii) Hourly unamortized cost (UNAM) is Acquisition cost divided by useful life in flight hours (18,720 hours)
UNAM = ACQ/18,720
UNAM = $6,342,000/18,720 = $339
(2) Hourly interest Computation:
(i) Unamortized value over remaining aircraft life is annual cost times remaining life.
UNAMORT = UNAM X REMLIFE*
(18.73 years at 720 hours/year)
UNAMORT = $339 X 18.73 X 720 = $4,571,619
*REMLIFE for each COMBS FY Period of Performance, as identified in Section B, is as follows:
COMBS FY12: 18.73
COMBS FY13: 18.18
COMBS FY14: 17.66
COMBS FY15: 16.73
COMBS FY16: 16.58
(ii) Annual interest on the unamortized value of the aircraft is the Government's interest rate (as determined by the Treasury Department) times the remaining unamortized value of the aircraft.
ANNINT = GOVINT x UNAMORT ANNINT = 3.125% x $4,571,619 = $142,864
(iii) Hourly interest on the unamortized value is the annual interest divided by 720 flight hours per year.
HRINT = ANNINIT / 720
HRINT = $142,864 / 720 = $199
(3) Total Hourly Cost Computation:
Total hourly cost of the aircraft is its hourly unamortized cost plus the hourly interest cost.
HRCOST = HRUNAM + HRINT
HRCOST = $339 + $199 = $538
(4) For each MOB, monthly liquidated damages will be assessed against the total and partial number of non-mission capable hours above the maximum rates allowed in the Performance Work Statement.
"Credit" cannot be carried from a base meeting requirements, from PMCS rates to NMCS rates or across the months. This is calculated by: Total Flight hours in the month for each respective base multiplied by the actual Non Mission Capable rate less the permitted Non/Partial Mission Capable Rates.
LD = TOTALHR x [NMCMse + (NMCSact - NMCScont)+(PMCSact - PMCScont)] x HRCOST
An example of this is as follows:
LD = 3,042 Hours x [0% + (10.11% - 4.00%) + (1.41% - 2.5%)] x $538 LD = 3,042 x [0% + (6.11%) + (0%)] x $538 = $99,997
(5) Other material discrepancies (OMD) shall incur liquidated damages starting at the 31st day after the requirement is identified to the COMBS Services contractor at the rate of $100 per missing part number per aircraft for each month (full or part) that the demand is not filled.
(6) Maximum annual liquidated damages assessment will not to exceed 25% of the current AFI 65- 503 published T-6A or T-6B value (base-dependant).
Note: All figures are rounded up to nearest dollar.

CONTRACT DATA REQUIREMENTS LIST (CDRL)
PREFACE
1. SCOPE. This Contract Data Requirements List (CDRL) establishes the data to be delivered by the contractor and the submittal, approval and distribution requirements of all the data items contained herein.
2. GENERAL. The data requirements are listed on the enclosed DD Forms 1423s. These forms have been completed in consonance with
DOD 5010.12-M.
3. DATA MANAGEMENT/AUTHORIZATION. The Data Manager is the program office element authorized to coordinate, prepare or suggest changes to the data requirements and distribution. Changes to the data requirements shall be made with the specific approval of the
Contracting Officer (CO).
4. DATA SUBMITTAL APPROVALS. A data code of “A” in Block 8 (Approval Code) of the data item denotes government approval is required based on the content of, as well as, the format of the data item. Approval of the content of a data item shall be consistent with the
Statement of Work (SOW) requirement(s) that generated the data.
a. Evidence of government approval or disapproval will be by letter from the ASC/WNZJ procuring agency to the Contractor.
b. Unless otherwise specified in Block 16 (Remarks) of the data item, government approval/comments/disapproval may be anticipated within 45 days after receipt of the data. This note does not apply to Engineering Change Proposals, Deviations, Contract Change
Proposals, or Material Deficiency Information.
c. The Contractor shall submit within 30 calendar days either:
(1) A revised document incorporating the government comments, or
(2) A reply to the government comments as to acceptability of the comments or a schedule for revision as a result thereof.
d. Data submittal requirements shall not be considered to have been met until the procuring agency has determined that all contractual requirements have been met regarding the identified data.
e. For each data item in the CDRL, the contractor shall clearly state in the final transmittal letter that the last submittal is being made and that all contractual requirements concerning that data item have been fulfilled.
5. METHOD OF TRANSMITTAL. a. Data requires electronic delivery when possible. If electronic delivery is not possible, hard copies of the data shall be submitted as listed in Block 14 (Distribution) of the data item, and the original and one copy of the letter of transmittal
(LT), (without enclosures) for the data submitted shall be forwarded to ASC/WNZJ, Attn: Contracting Officer (CO), one copy (including
DD Forms 250/copy) to ASC/WNZJ, Attn: Data Manager (DM) and one copy to the Administrative Contracting Officer (ACO).
a. The transmittal document and the data itself shall contain a reference to the contract number, data item sequence number, contract line item number, Data Item Description (DID) number and title/subtitle of the DID. Unless otherwise specified in the data item, each revised submittal of a data item shall be a complete volume and shall include sufficient additional information (i.e., volume numbers and revision levels) for positive identification of the data element being submitted. The contractor shall include, at the front of the volume, a brief summary of changes since the last submittal and shall indicate revised material by a vertical line down the right margin. The document revision shall be indicated on the title page of the data item and on each revised page. In the event no changes have occurred since the last submittal, a letter so stating is required and resubmission of the data is not required.
b. When “DAC” appears within a data item, it shall be construed as days after incorporation of the contractual agreement which includes that data item.
c. Schedule flow times specified in Block 12 (Data of First Submission) and Block 13 (Date of Subsequent Submission) on a data item are shown in calendar days unless otherwise stated. Data items with a submittal date which falls on Saturday, Sunday, or a legal holiday, shall be due on the next working day. If an addressee named in Block 14 (Distribution) on a data item does not receive data due to them, the Contractor shall mail a duplicate set immediately upon telecon or written notification from the addressee or the Data Manager.
d. The Contractor is not authorized to provide copies of any data required by the data item to activities who are not specifically identified in Block 14 (Distribution) of the data item.
e. Data submittals shall be provided and handled in accordance with the DD Form 254 security guidelines. The Contractor shall provide data in basic volumes at an unclassified level. Questions concerning the classification or submission of any classified data relating to the JPATS Program not resolvable by Contractor’s security organization should be referred to the ASC/WNZJ Program Security Officer, Bldg 11A, Room 201-I, 1970 Monahan Way, Wright-Patterson AFB OH 45433-7211.
6. DOCUMENTATION MARKING. The Contractor shall review and comply with DoD Directives 5230.24.
a. Unless otherwise indicated, the following distribution statement applies to all data items that contain a “D” in Block 9
(Distribution Statement) or a reference to Block 9 in Block 16 (Remarks):
“DISTRIBUTION STATEMENT “D”: Distribution authorized to Department of Defense and DoD Contractors only to protect technical or operational data or information from automatic dissemination under the International Exchange Program or by other means.
This protection covers information required solely for administrative or operational purposes.
The Contractor shall be responsible for annotating the appropriate document date.
b. The Contractor shall insure that all deliverable data subject to Export Control Laws is marked with the following statement:
“WARNING - This document contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., 2751 et seq) or the Export Administration Act of 1979, as amended (Title 50, U.S.C., App. 2401 et seq).
