3 PEP QUESTIONS & ANSWERS

SUBMITTED AFTER RELEASE

OF THE FINAL RFPS

ADDITIONAL QUESTIONS

The following additional questions and answers are provided for informational purposes only and intended to assist in clarifying issues raised by potential offerors regarding the official solicitation. Please note, the official solicitation has set forth and established the actual terms and conditions of this acquisition. Any discrepancy between the official solicitation and these questions and answers must be resolved based upon the parameters of the official solicitation. It was the intent of the Government to resolve the majority, if not all, of the issues raised by these questions and answers within the context of the official solicitation; however, additional questions have been raised after its release.

1. Question: Must an Offeror and Teammate be a J/V, or can a Prime/Sub relationship contractually established as a team? If the Offeror can be a Prime/Sub team, are they still allowed to submit up to 4 team member (Sub) Past/Present experiences?

Response:

Question 1, part 1 - A Prime/Sub relationship is permitted when it is contractually formed In accordance with FAR part 2 “Small Business Teaming Arrangement”, FAR part 9.6 “Contractor Team Arrangements”, and all applicable FAR and SBA regulations.

-FAR part 2, “Small Business Teaming Arrangement” –

(1) Means an arrangement where–

(i) Two or more small business concerns have formed a joint venture; or

(ii) A small business offeror agrees with one or more other small business concerns to have them act as its subcontractors under a specified Government contract. A Small Business Teaming Arrangement between the offeror and its small business subcontractor(s) exists through a written agreement between the parties that–

(A) Is specifically referred to as a "Small Business Teaming Arrangement"; and

(B) Sets forth the different responsibilities, roles, and percentages (or other allocations) of work as it relates to the acquisition.

-FAR part 9.6, “Contractor Team Arrangements”

9.601 Definition.

Contractor team arrangement, as used in this subpart, means an arrangement in which-

(1) Two or more companies form a partnership or joint venture to act as a potential prime contractor; or

(2) A potential prime contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract or acquisition program.

9.602 General.

(a) Contractor team arrangements may be desirable from both a Government and industry standpoint in order to enable the companies involved to-

(1) Complement each other’s unique capabilities; and

(2) Offer the Government the best combination of performance, cost, and delivery for the system or product being acquired.

(b) Contractor team arrangements may be particularly appropriate in complex research and development acquisitions, but may be used in other appropriate acquisitions, including production.

(c) The companies involved normally form a contractor team arrangement before submitting an offer. However, they may enter into an arrangement later in the acquisition process, including after contract award.

9.603 Policy.

The Government will recognize the integrity and validity of contractor team arrangements;

provided, the arrangements are identified and company relationships are fully disclosed in an offer or, for arrangements entered into after submission of an offer, before the arrangement becomes effective.

The Government will not normally require or encourage the dissolution of contractor team arrangements.

Question 1, part 2 - A Prime/Sub team that meets the requirements stipulated in Question 1, part 1 – “A Prime/Sub relationship is permitted when it is contractually formed In Accordance with FAR part 2 “Small Business Teaming Arrangement”, FAR part 9.6 “Contractor Team Arrangements”, and all applicable SBA regulations”, the Prime/Sub team is allowed to submit up to 4 team member Past/Present experiences, as specified in the Section M, Part II, Proposal Evaluation, Section C, Part 1.

2. Question: Past Performances will consider contracts awarded by these two Agencies for one NSN with more than 300 ea (items), Small Business Utilization and Similar Dollar Amount as Very Relevant?

Response: Section M, Part II, Proposal Evaluation, Section C, Part 4, Relevancy Definitions, lays out the relevancy criteria. The relevancy definitions relate to quantities of different NSNs, not a quantity of one NSN. Since you only have one NSN, you fall under “NOT RELEVANT: Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.”

3. Question: Is there a deadline for submitting questions to the government for this proposal effort?

Response: The deadline for questions on the official solicitation is 7 calendar days prior to the offer due date of 2 Mar 21. The last day to submit questions is 5:00 p.m. eastern time on 23 Feb 21.

4. Question: What are “bid sets”?

Response: Bid sets are drawings the Government has in our repository that are being provided for contractors to utilize to be able to quote on some of the NSNs. NOTE: Not all of the NSNs have drawings available.

5. Question: Is it all the items provided to bid on by way of DOD Safe or is it something else?

Response: At this time, the bid sets are being provided by disk and are being mailed through the US postal service. Please review the original Notice for Bid Sets attachment in Beta SAM for instructions on requesting a bid set. NOTE: Be sure to include the applicable solicitation number when requesting a bid set.

6. Question: Will the PPI Tool be provided via DoD SAFE?

Response: Yes, the PPI Tool will be provided by DoD SAFE. Please notify the following:
