3 PEP QUESTIONS & ANSWERS

ADDITIONAL QUESTION
The following additional question and answer is provided for informational purposes only and intended to assist in clarifying issues raised by potential offerors regarding the draft solicitation prior to release of the official solicitation. Please note, the official solicitation will set forth and establish the actual terms and conditions of this acquisition. Any discrepancy between the official solicitation and these questions and answers must be resolved based upon the parameters of the official solicitation. It is the intent of the
Government to resolve the majority, if not all, of the issues raised by these questions and answers within the context of the official solicitation; however, additional questions may be raised after its release if necessary.
Question: May a Native American tribe propose on both solicitations using separate tribally owned entities, one that qualifies under SBA 8a standards and the other under the small business category?
Response: In accordance with Section M, Part I, Basis of Contract Award, Part A, Source Selection Methodology, includes a NOTE that states “Offerors are instructed to propose on either FA8517-21-R- 0001 8(a) or FA8517-21-R-0002 (SB) but not both. Offerors submitting a proposal under both RFPs may be determined noncompliant with the terms and conditions of the RFPs and may be determined to be not eligible for award under either RFP.” In the above situation, a Native American tribe may propose on both solicitations as long as they utilize separate tribally owned entities, one that qualifies under SBA 8(a) and the other under the small business category.
