1.0 Program Structure and Objective. The Government plans to award a single contract for a Next Generation High- Pressure Cold Spray System. This system is used to apply coatings for corrosion resistance, component repair, and for additive manufacturing. A firm-fixed-price type contract will be awarded as a result of this solicitation and evaluation.
2.0 General Instructions.
2.1. This competitive acquisition will be conducted utilizing price as the only evaluated factor. Contract award will be made to the Offeror with the lowest total evaluated price (TEP). The quote shall be compliant with the requirements as stated in this solicitation and its attachments. Offerors shall provide evidence that their quote is for a system and all items which will meet the Government’s needs. Non-conformance with the instructions provided in these instructions will most likely result in an Offeror being ineligible for award.
2.1.1. The Offeror must provide us with the following when responding to this solicitation:
a. Quote Sheet – it must be completed, to include signature. The Offeror may also provide us with an quote on their own stationery, form, etc., but this Quote Sheet must be completed and returned to us.
b. Product/Technical Information & Solution – this must be detailed enough to enable the Government to evaluate it against the solicitation and its attachments. There is not a specific template or format for the requested information in this document. This document must be no longer than 100 pages and shall be readable by Microsoft Word & Excel or Adobe Reader/Acrobat.
c. Warranty Information Failure to submit all of these items may render the Offeror ineligible to receive the award.
2.1.2 Brand Name Items. This is a Brand Name requirement IAW RFO Subpart 11.204, Items peculiar to one manufacturer, and the authority found at RFO 12.201-1, Simplified Procedures (41 U.S.C. 1901). There are four components of this system which are Brand Name items; see the solicitation and attachments for details. Substitute/”equivalent” items are not permitted in quotes for this solicitation. Quotes with substitute/”equal” items for those four components will render the Offeror ineligible for award.
2.1.3 Shipping. Shipping will be FOB Destination only (Tinker AFB, OK 73145-3303). Separate charges for shipping/freight will not be allowed.
2.1.4. The quote shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of their offer for this system, and especially the brand name parts.
2.1.5. All quotes must conform to the solicitation requirements, including all stated terms, conditions, representations, and certifications. All items will be evaluated to ensure they conform to the requirements set forth in this solicitation. The Government reserves the right to reject any/all quotes which do not conform to this solicitation’s requirements.
2.1.6. Period for acceptance of quotes. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the solicitation.
2.1.7. Late submissions, modifications, revisions, and withdrawals of quotes.
a. Offerors are responsible for submitting quotes and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.
b. Any offer, modification, or revision received after the time specified for receipt of quotes is “late” and will not be considered for award. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
c. If an emergency or unanticipated event interrupts normal Government processes so that quotes cannot be received at the Government office designated for receipt of quotes by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
d. Offerors may withdraw their quotes by written notice to the Government received at any time before award.
NOTICE TO OFFERORS – SOLICIATION REQUIREMENTS
If you disagree with any of the solicitation requirements (which includes all stated terms, conditions, representations, and certifications), you must inform the Government of your issue with the aforementioned requirements and provide your rationale for disagreement. The Government reserves the right to reject any/all quotes which do not conform to the solicitation requirements
[End of Provision Addendum]
52.212‐2 ‐‐ Evaluation – Commercial Items
As prescribed in RFO 12.205(a)(2), the following addendum is provided for this solicitation and hereby amends all language therein:
1.0. Two-Factor Competition
1.1 Basis for Contract Award. This acquisition will utilize two factors for choosing a successful Offeror:
a. Technical Acceptability [pass/fail]; and,
b. Lowest Total Price.
Award will be made to the responsible Offeror with technically acceptable approach and the lowest total evaluated price (TEP); additionally, the quote must conform to the solicitation requirements (to include all stated terms, conditions, representations, and certifications). In order to be eligible for award, the Offeror must be able to provide and install a Next Generation High-Pressure Cold Spray System with the four Brand Name components and all other items and services mentioned in the solicitation and Statement of Work (SOW); no other brands than what are specified in the solicitation and attachments are acceptable for those four components.
1.2. Interchanges. The Government intends to issue the award without interchanges; however, the Government reserves the right to conduct interchanges with one, some, or all Offerors if later determined to be necessary by the Contracting Officer. The Government may waive informalities and minor irregularities in quotations received; therefore, the Offeror’s initial quotation should be complete and contain the Offeror’s best terms from a price and technical standpoint.
1.3. Solicitation Requirements (Responsibility and Terms and Conditions). Offerors are required to meet all solicitation requirements, such as terms and conditions, and representations and certifications, in addition to the price and technical factors. The Government will also review Offeror data in SAM.gov, the Supplier Performance Risk System (SPRS) application, and anywhere else information can be found in order to determine that Offerors are responsible.
1.3.1. Responsibility. This is the status of a prospective contractor determining that it does or does not have the capability, tenacity, and perseverance to perform a contract. RFO 9.103 requires Contracting Officers only award contracts to responsible prospective contractors, and therefore must make a determination that an Offeror is either responsible or nonresponsible. Responsibility is never considered a separate evaluation factor, but rather a pre-award process which must be followed much like ensuring an Offeror complies with terms and conditions as set forth in the solicitation.
RFO 9.104, Standards, requires all vendors to be actively and completely registered in the System for Award Management (SAM), have no exclusions, completed Representations and Certifications, and have the capacity to meet the Government’s requirements. Additionally, 9.104-1(b) states that vendors must be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and Governmental business commitments, and 9.104-1(c) states that vendors must have a satisfactory performance record.
R-DFARS 209.105-1(c) states that the Contracting Officer must consider supplier risk in award decisions. Supplier risk is assessed by reviewing the SPRS application, which is found on the Procurement Integrated Enterprise Environment (PIEE) website (https://piee.eb.mil/). Negative information in SPRS may be an indicator of undue risk and can disqualify an Offeror from receiving an award.
1.3.2. Terms and Conditions. IAW RFO Part 9, failure to comply with the terms and conditions of the solicitation may result in the Offeror being ineligible for award, as well being determined to be a non-responsible Offeror. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable, and the quote, therefore, is ineligible for award.
https://piee.eb.mil/
1.4. Late Quotes. Any quote, modification, or revision received after the time specified for receipt of quotes is “late” and will not be considered for award. However, a late modification of an otherwise successful quote that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
1.5. Number of Contracts to Be Awarded. The Government intends to select one contractor for award; however, the Government reserves the right not to award a contract at all, depending on the quality of the quotes and prices submitted and the availability of funds.
2.0. Evaluation Factor
2.1. Factor 1 – Technical Acceptability. This is a pass-or-fail factor. This evaluation will be based on each’s vendor’s approach for meeting the technical requirements of this solicitation, which includes all attachments. The evaluation focuses on the technical approach as described in each quote. The technical evaluation does not consider price. Each quote will be evaluated for technical acceptability, based on the criteria listed below.
Each Offeror must provide their written approach for this factor in order to be considered responsive for this factor. Statements such as "Concur", "I Concur", "We Concur", or any equivalent will not be acceptable to the Government.
To be determined technically acceptable at the factor level, the vendor must meet all the criteria in the Solicitation, and Statement of Work. Failure to meet any criteria will result in an unacceptable technical rating.
The technical ratings are defined as follows:
Pass Technically acceptable; the quote meets the requirements of the solicitation, and the Government has faith that the vendor can successfully satisfy the Government’s requirement.
Fail Technically unacceptable; the quote does not meet the requirements of the solicitation, and the Government believes the vendor cannot successfully satisfy the Government’s requirement
If the Government decides that interchanges are required to address technical capability/acceptability, we intend to conduct three rounds maximum with each Offeror. An quote can be deemed technically unacceptable after three rounds if the Government deems it to be. The Government can stop interchanges at any time with any vendor and can exceed three rounds of interchanges with any vendor if deemed necessary by the Government.
2.2. Factor 2 – Price. Price quotes will be evaluated as follows:
2.2.1. Completeness. Quotes will be reviewed for completeness. Incomplete quotes will be considered ineligible for award.
2.2.2. Price Reasonableness. The offered prices will be evaluated for reasonableness. Reasonableness must represent a price to the Government a prudent person would pay in the conduct of competitive business. Normally, price reasonableness is established through adequate price competition, but may also be determined through price analysis techniques as described in RFO 15.404-1(b)(2).
2.2.3. Price Realism. To be realistic, the offered price must demonstrate an adequate understanding of the requirement.
The Government intends to determine price realism based on adequate price competition. In the event the Government cannot determine price realism based on adequate price competition, the Government reserves the right to conduct a more detailed price realism evaluation using one or more of the price analysis techniques described in RFO 15.404-1(b)(2). The Government may also use other evaluation techniques, as needed. All documentation submitted to support price realism will be considered in the evaluation. Offerors whose price is determined to be unrealistically low based on an inadequate understanding of requirements will be ineligible for award.
2.2.4. Unbalanced pricing. Offerors’ quotes will be reviewed for unbalanced pricing. Unbalanced pricing exists when, despite an acceptable total price, the price of one or more line items (including sub line items) is significantly over or understated as demonstrated by application of price analysis techniques, such that:
a. There is reasonable doubt the quote would result in the lowest overall price to the Government, even though it is the lowest priced Offeror; or
b. The quote is so grossly unbalanced; its acceptance would be tantamount to allowing an advanced payment.
The Government will evaluate any supporting information provided by the Offeror explaining variances that appear unbalanced. Evaluated quotes that are determined to be unbalanced may be deemed ineligible for award by the Contracting Officer if a determination is made that lack of balance poses an unacceptable risk to the Government.
2.2.5. Total Evaluated Price (TEP). The TEP will be calculated as the sum of the total quoted prices for all separately priced line items (including any sub line items). The total offered price for each separately priced line item shall be calculated as the offered unit price multiplied by the corresponding quantity.
2.2.6. Terms and Conditions and Offeror Responsibility. The Government will ensure Offeror submissions are compliant with all of the solicitation’s terms and conditions, as well as making sure Offerors are responsible prior to consideration for award IAW para. 1.3.
2.3. Debriefings. If a post award debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:
a. The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s quote.
b. The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.
c. The overall ranking of all Offerors when any ranking was developed by the agency during source selection.
d. A summary of the rationale for award.
e. For acquisitions of commercial products, the make and model of the product to be delivered by the successful
Offeror.
f. Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.
[End of Provision Addendum]
NOTE: Installation may be delayed for up to 18 months due to coordination with and approvals from Tinker AFB Civil Engineering regarding your suggested installation methods as they apply to altering real property/infrastructure.
