52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (FEB 2012)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Paragraph has been deleted from this clause because it is not applicable.
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Paragraph has been deleted from this solicitation because it is not applicable.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award. The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Paragraph has been deleted from this clause because is not applicable.
(i) Paragraphs (i)(1)-(3) have been deleted from this clause because it is not applicable.
(i)(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Data Universal Numbering System (DUNS) Number. (Applies to all offers exceeding $3,000, and offers of $3,000 or less if the solicitation requires the Contractor to be registered in the Central Contractor Registration (CCR) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address.
The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1- 866-705-5711 or via the internet at http://fedgov.dnb.com/webform. An offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The offeror should indicate that it is an offeror for a Government contract when contacting the local Dun and Bradstreet office.
(k) Central Contractor Registration. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered offeror. Offerors may obtain information on registration and annual confirmation requirements via the CCR database accessed through https://www.acquisition.gov or by calling 1-888-227-2423 or 269-961-5757.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
https://www.acquisition.gov/
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.
(End of provision)
ADDENDUM TO 52.212-1 INSTRUCTIONS AND NOTICES TO BIDDERS
FAR 52.212-1 and Addendum thereto, FAR 52.212-2 and Addendum thereto, and FAR 52.213-3 will be physically removed from any resultant award, but will be deemed to be incorporated by reference in any award resulting from this solicitation. The offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers.
1. This Addendum prescribes the format for proposals and describes the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of information essential to the understanding and comprehensive evaluation of proposals. The instructions permit the inclusion of any additional data or information an offeror deems pertinent within the stated page limitations. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make an award based on initial proposals received, without discussion of such proposals.
2. If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unclear or unsound, the offeror shall immediately notify the Contracting Officer in writing with supporting rationale. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. All questions in reference to this solicitation shall be submitted to the Law Enforcement Equipment e-mail lawenforcementequipm@wpafb.af.mil.
3. To ensure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to submit all documentation/information detailed herein, including terms and conditions, representations and certifications including FAR 52.212-3, DFARS 252.212-7000 and technical requirements. Failure to submit all required documentation/information may result in a proposal being ineligible for award. In submitting a proposal, offerors are agreeing to the terms and conditions as written in this RFP. Offerors shall submit an original paper copy of the completed proposal and two (2) exact copies as described below. Also offerors are required to submit an original compact disc (CD) of their entire proposal and a copy. If there are discrepancies between the original paper copy and duplicate copies, the original paper copy proposal will take precedence and will be the one evaluated. E-mail or facsimiles proposals will not be considered. If an offeror’s proposal is determined unacceptable upon completion of proposal evaluations, the offeror will be notified promptly of the basis for the determination. The response shall consist of a Main Cover Letter and two (2) separate parts, Part I: Technical Proposal, and Part II:
Price Proposal, submitted in two separate binders.
Main Cover Letter: Limit 1 Page. It should include the offeror’s CAGE Code for their Central Contractor Registration (CCR/SAM).
Part I – Technical Proposal: Limit 40 pages for each equipment category proposal. The sizing guide for Common DoD Civilian & Military Items for concealable body armor - ballistic does not count towards the page limitation for the technical proposal. See proposal below for a full description of each criteria.
Part II – Price Proposal: No page limitation. See Proposal Content below.
4. Page format: Each page of the proposal, other than foldouts, will be typed on 8-1/2” by 11” and will use
Times new Roman, 12 pt. font. Margins will be no smaller than 1”. Each page will be numbered. If printing appears on both sides of a sheet of paper, it is considered to be two (2) pages.
mailto:lawenforcementequipm@wpafb.af.mil
5. Proposals are due at 1000 hours Central Daylight Savings Time on 7 June 2013. Proposals and Equipment shall be delivered to the attention of Jamie Brunner, Contracting Officer, HQ AFSFC, 1517 Billy Mitchell Blvd, Bldg 954, JBSA-Lackland AFB, TX 78236-0119. Proposals may be mailed, overnight mailed, or hand-carried to the above address so they are received by the contracting office by the due date and time.
6. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional data will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit cost data to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
7. The acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR 15.101-2, as supplemented.
8. Offerors may quote on a single equipment category or up to all four categories. Each equipment category will be evaluated separately. If an offeror is submitting proposals for more than one category, the offeror shall submit a separate proposal for each equipment category. Each equipment category must be supplied “all or none” to be considered for award.
9. Only one proposal per category per offeror will be accepted. If multiple offers are received, the first one received will be evaluated and any others received will not be evaluated and remain unopened, with electronic notice to the offeror.
10. For any equipment category proposal, the offeror must provide pricing for all pieces of equipment in that category. Failure to provide pricing for all pieces of equipment in a category shall deem your proposal as unawardable for that category.
11. Standard commercial packaging applies to this acquisition.
12. The post award conference will be held at the HQSFC Building in San Antonio, TX. The fixed price for this post award conference will be $3,000.00. One post award conference will be awarded per product category unless an offeror is awarded more than one category. If an offeror is awarded more than one category, only one post award conference will be held. This is the minimum guarantee for this IDIQ contract.
13. Product samples shall be submitted at or prior to the term specified for receipt of offers. These samples shall be submitted at no expense to the Government and returned at the sender’s request and expense, unless they are destroyed during preaward testing. It is the responsibility of the contractor to submit all equipment for a category in boxes labeled for that particular category. The government will not sort equipment into categories, therefore if you are bidding on two or more categories ensure that your equipment is boxed by category and labeled accordingly. Example, the offeror is bidding on category 1 & 2, part of the equipment for category 1 is included with a box for category 2, the government is not responsible for sorting the equipment into the correct categoires and this may result in an unacceptable technical proposal. If an offeror’s proposal is awarded a contract for a category(ies) then the samples submitted by that offeror for the awarded category(ies) will be kept by the government at no expense to the government.
14. Proposal Content:
a. VOLUME I – Technical Proposal
(1.) The Technical Proposal Volume (Volume I) shall not make reference to cost or price information.
The proposal shall meet all salient characteristics/ technical requirements stated in FAR 52.212-2 and elsewhere in the RFP to be eligible for award. The offeror should provide documentation which supports all the evaluation factors contained in the addendum to FAR 52.212.2 below. The information provided should be adequate and sufficient to allow the Government to evaluate an offeror’s equipment salient characteristics/technical requirements.
(2.) As the technical volume will primarily describe and demonstrate the capability of the offeror to fulfill all salient characteristics/technical requirements stated in FAR 52.212-2, the technical proposal should be specific and complete in every detail.
(3.) It is the offeror’s responsibility to ensure the completeness of the technical proposal; therefore the technical evaluation panel for the Government has been instructed to evaluate on the basis of the information provided. The Government shall not assume an offeror possesses any capability unless specified in its proposal. Understanding of the requirements must be demonstrated by more than a reiteration of them. Repeating the salient characteristics/technical requirements without sufficient elaboration will not be acceptable. Statements such as the offeror understands, can or will comply with all the requirements, standard procedures will be employed, etc., are insufficient.
(4.) The offeror shall provide the completed Air Force Law Enforcement Equipment Requirements
Acceptability Checklist (RFP Attachment 12). The offeror shall fill-in all the yellow high-lighted cells for the equipment categories that they are proposing on. Failure to fill in one yellow high-lighted cells shall deem your proposal as unawardable. Ensure that the file is saved as an Excel (.xls) file to the compact discs (CDs) that shall be submitted.
(5.) The offeror shall provide each piece of equipment for each equipment category on which they propose. In the Common DoD Civilian & Military Items equipment category, the offeror shall only provide one (1) large regular – male, one (1) large long- male, one (1) medium regular-female and one (1) medium long - female concealable body armor – ballistic. The Vehicle Patrol Kit and Law Enforcement Crime Scene Kit categories, only need to provide one (1) of each of the kits. In the Black Nylon Gear category, the offeror shall only provide one (1) large black nylon utility belt.
(6.) The offeror for Common DoD Civilian & Military Items equipment category shall provide a measuring guide and sizing instructions for the male and female concealable body armor - ballistic item. The sizing guide does not count towards the page limitation for the technical proposal.
(7.) The offeror shall provide a plan that demonstrates the capability of meeting peak (surge) ordering periods during the Fiscal Year End (Aug-Sept).
(8.) The offeror must certify that they can deliver to all Continental United States (CONUS) and Outside the Continental United States (OCONUS) Air Force installations in (Base Shipping Locations RFP Attachment 06).
(9.) The specific topics to be addressed in Volume I are stated in addendum to FAR 52.212-2.
Any factor determined unacceptable will render the entire Technical Proposal as unacceptable. Upon final determination that a proposal is unacceptable, the PCO will promptly notify the offeror submitting the proposal that it will not be considered for award and shall indicate in general terms the basis for the determination. Proposals should cover all aspects of salient characteristics/technical requirements. Offerors should, to the maximum extent possible, clearly communicate and articulate how the proposed product meets these evaluation factors. If it is not mentioned, the presumption by the evaluators will be that it does not meet the criteria and was thus not included in the proposal for that reason.
Subcontracting Plan Submission: IAW FAR 52.219-8 and FAR 52.219-9, large businesses whose proposal exceeds $650,000 shall submit a subcontracting plan with their proposal. The following information is provided as the agency goals:
(1). Small Business= 23% (2). HUBZone Small Business= 3% (3). Service-Disabled Veteran-Owned Small Business= 3% (4). Small Disadvantaged Business= 5% (5). Women-Owned Small Business= 5%
Offerors shall explain if subcontracting is not achievable for this RFP.
Failure to submit a sub-contracting plan will result in an Offeror’s proposal being found unacceptable.
a. VOLUME II – Price Proposal
(1).General – All information relating to pricing data shall be included in this volume. Under no circumstances shall pricing data be included elsewhere in the proposal. (No price tags on the equipment) Should such pricing data be included in the technical capability, the result will be removal of such pricing data and all other information included on the same page with such data.
This could result in the exclusion from evaluation of critical technical information. The price proposal shall contain the following in the order shown:
i. Follow instructions contained in the Pricing Model (RFP Attachments 02 through 05) to complete the Pricing Information. Ensure that the Pricing Model is saved as an Excel (.xls) file to the compact discs (CDs) that shall be submitted.
ii. Offerors must complete all appropriate blocks on the cover page of the solicitation to include block 17a, 30a, 30b, and 30c.
iii. Completed provisions/clauses for Offeror’s Representations and Certifications – Commercial Items (see FAR 52.212-3 and DFARS 252.212-7000).
iv. Required Statement Regarding Expiration Date of Proposal: A statement shall be provided that the proposal and prices will remain in effect for 120 days after solicitation closing date.
Include this statement on the cover letter.
v. Signed acknowledgement of any Amendment(s) issued against this solicitation
(if applicable).
52.212-2 Evaluation—Commercial Items.
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
Evaluation—Commercial Items (Jan 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(b) Offerors will be evaluated based upon the ADDENDUM 52-212-2 Evaluation Factors below.
(c) Options. The Government will evaluate offers for award purposes to include option year pricing as described in Addendum 52.212-2 Evaluation Factors below by adding the total evaluated price for all options to the total evaluated price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
ADDENDUM TO 52.212-2 EVALUATION FACTORS
(1)Basis for Contract Award:
1.1 This acquisition will use Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR 15.101-2, as supplemented. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award of each category will be made on the basis of the lowest total evaluated price for each category of proposals meeting the acceptability standards for non-cost factors. Award will be made on the basis of proposals which are deemed responsible in accordance with the Federal Acquisition Regulation and conform to the RFP requirements.
1.2 The RFP requirements include all stated terms, conditions, representations, certifications, and all other information required in FAR 52.212-1 and addendum of this RFP. Offerors must be able to provide equipment to all CONUS and OCONUS Air Force Installations listed in RFP Attachment 06 titled “Base Shipping Locations.” The Government intends to award without discussions; therefore, each proposal should contain the offeror’s best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.
(2) Evaluation Ratings:
2.1 The Government will evaluate each proposal for Technical Acceptability and Price: Completeness, Reasonableness, Unrealistic Low Prices and Unbalanced Pricing. The proposal may be rated as either Technically Acceptable or Technically Unacceptable on the Technical factor. The proposal will be rated as Technically Acceptable if it meets all stated criteria and salient characteristics as described in this RFP. If the proposal fails to meet any technical criteria, the proposal for that category will be rated Technically Unacceptable and will be ineligible for award of that category if, at time of award decision, that rating still applies.
2.2 The proposal for a category may be rated either Reasonable or Unreasonable on the Price factor. For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business.
2.3 Normally, price reasonableness is established through adequate price competition, but may also be determined through price analysis techniques as described in FAR 15.404. For additional information, see FAR 31.201-3.
A Total Evaluated Price (TEP) will be calculated for evaluation purposes for each of the four product categories.
2.4 Technical Acceptability will be evaluated on all offerors. Only those proposals determined to be Technically Acceptable either initially or as a result of exchanges with the offerors, will be considered for award. Those proposals rated Technically Acceptable and Complete, Reasonable, and Balanced on TEP will then be
RATING DESCRIPTION
Technically Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Technically Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
ranked from lowest TEP to highest TEP. The Government will determine at this time the awardee to be made, if any, and award to the lowest price, technically acceptable offer for each equipment category.
(3) Number of Contracts to be Awarded:
3.1 The Government intends to award one contract for each of the four equipment categories. If an Offeror is awarded more than one product category the requirements will be administered on one contract. However, the Government reserves the right to award one contract or none at all, depending on the quality of the proposals, prices submitted, and the availability of funds.
(4) Rejection of Unrealistic Offers:
4.1 The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, or unrealistically high or low in price when compared to the Government estimates, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.
(5) Correction Potential of Proposal:
5.1 The Government will consider, throughout the evaluation, the correction potential of any proposal uncertainty.
5.2 The judgment of such correction potential is within the sole discretion of the Government. If an aspect of an offeror’s proposal not meeting the Government’s requirements is not considered correctable, the offeror may be ineligible for award..
(6) Factors:
6.1 The Government will evaluate the proposals for each category for Technical Acceptability based on meeting
ALL the criteria listed in the salient characteristics. Failure to meet any of these criteria will result in a rating of Technically Unacceptable. See Salient Characteristics for each equipment category in RFP Attachment 01 (Salient Characteristics).
6.2 Factor 1 – Technical Proposal:
i. Information provided for each piece of equipment will be evaluated to ensure equipment meets the salient characteristics specified in this solicitation. The salient characteristics are listed in RFP Attachment 01 (Salient Characteristics). Each piece of equipment will be evaluated on a pass/fail basis, assigned ratings of acceptable or unacceptable.
ii. Surge Capability
1. The offeror’s surge capability plan must demonstrate the capability to meet surge in orders for the Fiscal Year End (Aug-Sept). Offeror’s plan must certify that at least 40% during the first year and 75% of the projected annual quantity of items per equipment category for the remaining years, can be provided during the surge period with an on-time delivery of 30 days for CONUS and 45 days for OCONUS.
6.3 Factor 2 – Price:
i. Completion of the RFP pricing model and list will represent the price proposal. No separate price proposal will be accepted.
1. The offeror shall fill-in the unit prices in the Pricing Model and List as described in the instructions in the Pricing Model(s) (RFP Attachment 02-05) that they are proposing on. The offeror’s yearly cost will be calculated in the Pricing Model by multiplying the estimated quantities for each unit by the offeror’s proposed unit prices for each piece of equipment in the Equipment Category. The Total Evaluated Price (TEP) will be calculated by totaling these yearly costs (including the six (6) month option).
2. Completeness: The Government will review the Pricing submissions for completeness of all unit rates and growth percentages as well as TEP. The completeness review will focus on whether the offeror used the Government-developed Excel file as required, and whether the pricing tabs included blanks or formulas, if any locked cells were tampered with, if any formatting was changed and if unit and growth rates were only carried out to two decimal places. Incomplete price submissions may not be evaluated and the proposal may be eliminated from the competition.
3. Reasonableness: Price analysis will be performed on the TEP to determine the reasonableness of the offeror’s price proposal. For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. Normally, price reasonableness is established through adequate price competition, but may also be determined through price analysis techniques as described in FAR 15.404. For additional information see FAR 31.201-3.
4. Unrealistically Low Prices: Unrealistically low proposed unit prices or TEP, initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the offeror does not understand the requirements or the offeror cannot sustain the requirement at that price.
5. Unbalanced Pricing: Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of cost or price analysis techniques. The Government shall analyze offers to determine whether they are balanced with respect to separately priced line items or subline items. Offers that are determined to be unbalanced may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
