52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

BASIS FOR CONTRACT AWARD:

(i) In accordance with FAR 12/FAR 15 and the DoD Source Selection Procedures guide, the Government is conducting a Lowest Price Technically Acceptable source selection. The Government will select the proposal with the lowest evaluated price from among those meeting the acceptability standards for non-price factors.

A Contract may be awarded to the offeror who is deemed responsible in accordance with the FAR Part 9.1, as supplemented, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by FAR 52.212-1 of this solicitation) and is judged, based on the evaluation factors and subfactors, to represent the lowest price technically acceptable proposal. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process. Affordability of the lowest priced technically acceptable proposal will be assessed in the source selection process.

(ii) The following evaluation factors will be used to evaluate proposals. The Government will evaluate proposals for acceptability, but will not rank the proposals by the non-price factors or subfactors:

1. Price Evaluation Factor

The government shall place in order all responsive proposals by price, including option prices. The evaluated price will include consideration of pricing for the extension of services under clause 52.217-8.

For the base and each option period the government will use the monthly rate proposed. The final evaluated price will include the proposed monthly rate plus 6 months of services at the monthly rate for the base and all option periods. The extended amounts will be added together to determine the total evaluated price. The unit price of the offeror’s proposal shall control any conflict between the unit price and the extended amount submitted in response to this solicitation. Failure to propose for any item in the

Price Schedule may cause the offeror’s proposal to be rejected as non-responsive. Award will be made based on the contract line item prices proposed by the offeror initially or as a result of discussions, if conducted. The price evaluation will document the completeness, balance, and affordability (based on available government budget) of the proposed total evaluated price.

Example:

CLIN 0001 MONTHLY RATE x (10 MONTHS + 6 MONTHS) +

CLIN 0002 MONTHLY RATE x (10 MONTHS + 6 MONTHS) + … +

CLIN 1001 MONTHLY RATE x (12 MONTHS + 6 MONTHS) + … +

CLIN 2001 MONTHLY RATE x (12 MONTHS + 6 MONTHS) + … +

CLIN 3001 MONTHLY RATE x (12 MONTHS + 6 MONTHS) + … +

CLIN 4001 MONTHLY RATE x (12 MONTHS + 6 MONTHS) + … =

TOTAL EVALUATED PRICE

2. Non-Price Evaluation Factors

Non-Price Factor 1: Technical

The Government will evaluate proposals for technical acceptability on an Acceptable/Unacceptable basis. All technical criteria (i.e. subfactors) must be rated “Acceptable” to be considered technically acceptable. Only those proposals determined to be technically acceptable, either initially or as a result of discussions, will be considered for award

The technical subfactors will receive one of the ratings listed below:

TABLE 1- TECHNICAL EVALUATION RATINGS

Acceptable Proposal clearly meets the minimum requirements of the solicitation

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation

SubFactor 1: Facilities Clearance

Description: This factor either

A) Verifies an offeror’s Facility Clearance to determine if it clearly meets the solicitation requirement for a Secret Facility Clearance.

B) Verifies an offeror’s statement that neither prime nor subcontractor partners possess an FCL, including acknolwedgement of PWS 1.9.

Measure of Merit: This requirement is met when the offeror’s proposal provides a valid Secret

Facility Clearance which meets the minimum requirements of the solicitation or a statement that neither prime nor subcontractor partners possess an FCL, including acknolwedgement of PWS 1.9.

SubFactor 2: Staffing Plan/Organization Chart

Description: This factor evaluates an offeror’s Staffing Plan/Organization Chart to determine if it clearly identifies the number of employees; skill mix and labor type; organizational structure; and how personnel will be allocated to tasks, subtasks and crossover tasks (including detail on how any adjustments will be made) to meet the minimum requirements of the solicitation and PWS.

Measure of Merit: This requirement is met when the offeror’s proposal clearly addresses the staffing and organization for performing the minimum requirements of the PWS Section 2.0, inclusive of all sub paragraphs, and the solicitation.

Non-Price Factor 2: Past Performance

The Past Performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. Offerors must receive a past performance rating of “Acceptable” to be eligible for award.

a. Ratings. The Past Performance factor will receive one of the ratings described below.

b. Evaluation Process. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the solicitation requirements. In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided by the offeror, and information obtained from other sources available to the Government, to include: the Past Performance Information

Retrieval System (PPIRS); Federal Awardee Performance and Integrity Information System

(FAPIIS); Electronic Subcontract Reporting System (eSRS), or other databases; and interviews/questionnaires with Program Managers, Contracting Officers and Fee Determining

Officials, the Defense Contract Management Agency (DCMA), and commercial sources.

1. Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 3 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

2. Relevancy Assessment. The Government will conduct an evaluation of all recent performance information obtained to determine whether the products provided/services performed under those contracts related to Supply, Fuels, Munitions and Mobility.

Consideration will be given to services provided consisting of: Supply, Fuels, Munitions, and

Mobility, with a similar or greater in size and magnitude (based on workload data – see RFP attachment) required under this solicitation. A relevancy determination of the offeror’s past performance will be made based upon the aforementioned considerations, including joint venture partner(s) and major and critical subcontractor(s). In determining the relevancy of effort performed under individual past performance contracts, the government will only consider the specific effort or portion consistent with that proposed by the prime, subcontractor or teaming partner. Offeror provided past performance information and information obtained from other sources will be used to establish the relevancy of past performance. Past performance information that fails this condition will not be evaluated.

The Government will use the following relevancy definitions when assessing recent, relevant contracts:

TABLE 3 – PAST PERFORMANCE RELEVANCY RATINGS

TABLE 2- PAST PERFORMANCE EVALUATION RATINGS

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

Rating Definition

RELEVANT Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

NOT RELEVANT Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

3. Performance Quality Assessment. The Government will consider the performance quality of recent, relevant efforts. The quality assessment may result in positive or adverse findings.

Adverse is defined as past performance information that supports an unsatisfactory rating on any evaluation element or any unfavorable comment received from sources without a formal rating system. For adverse information identified, the evaluation will consider the number and severity of the problem(s), mitigating circumstances, and the effectiveness of corrective actions that have resulted in sustained improvements. Process changes will only be considered when objectively measurable improvements in performance have been demonstrated. The Government will use the following quality levels when assessing recent, relevant efforts:

TABLE 4 – PAST PERFORMANCE QUALITY ASSESSMENT

Quality Assessment/Color Description

SATISFACTORY (S) During the contract period, contractor performance is substantially meeting (or substantially met) contract requirements. For any problems encountered, contractor took effective corrective action.

UNSATISFACTORY(U) During the contract period, contractor performance is not meeting (or did not meet) some contract requirements. For problems encountered, corrective action appeared only marginally effective, not effective, or not fully implemented. Customer involvement was required.

NOT AVAILABLE(N) Quality and/or performance information is not available.

c. Assigning Ratings. As a result of the relevancy and performance quality assessments of the recent contracts evaluated, offerors will receive an integrated past performance rating at the factor level (see Table 2).

(iii) The Government will evaluate all responsive proposals in order of price. The lowest priced offeror will be evaluated for technical and past performance acceptability. If the lowest priced offeror’s technical and past performance factors are rated “Acceptable”, the evaluation is complete. If either of the lowest priced offeror’s technical or past performance factors are rated “Unacceptable”, the overall proposal is deemed unacceptable and the Government will evaluate the next lowest priced offeror’s technical proposal and past performance information for acceptability. Evaluations will continue in this manner until an offeror’s technical and past performance information are both rated “Acceptable” or until all proposals are evaluated.

(iv) Failure to meet the requirements of the solicitation may result in an offer being determined nonresponsive and only responsive proposals will be considered. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. This award will result in a Firm Fixed Price contract.

(v) The Government reserves the right to award without discussions and as such offerors are advised to submit their most favorable proposal or best effort as their initial offer. If award is made without discussions, proposal revisions will not be permitted. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final

Proposal Revision (FPR) submissions will be considered in making the source selection decision. The

Government reserves the right to enter discussions at any time during evaluations.

(vi) The Government reserves the right to conduct a pre-award survey on a prospective contractor(s) to determine their ability to perform. Offerors are advised that accomplishment of a pre-award survey is part of the evaluation process and is not to be construed as an indication that an offeror will receive or is in the best position to receive an award.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
