RFP – Page

RFP Page 70 states: “Section 613a BGB may apply to any contract awarded.”

German Law BGB paragraph may require the successful bidder to take over the personnel of the incumbent. This requires the Government is to provide offerors with a detailed list of all numbers of existing employees that are subject to this transfer, together with their employment levels, age, exact salaries, and exact social insurance payments. Can you please kindly provide this information so that we can price and plan accordingly?

It is the offerors responsibility to determine if 613a BGB applies and propose accordingly (see Addendum to FAR 52.212- 1 Instructions to Offerors – Commercial Items). The Government is not in possession of any such staffing information and is unable to obtain it.

2 RFP RFP – Page

Page 37 of the RFP states that ± 30% variation in Government estimated quantities specified in the pricing schedule is considered to be within scope of this contract. Given the historical data available, we suggest that this is too high and is typically ±10%. Can the inclusive scope variation in quantity estimates be revised to ±10%?

The 30% increase/decrease refers to the estimated quantities of the individual CLINs for purpose of scope determination. The contractor may or may not be required to perform the additional work. The Government does not anticipate to change the indicated variation, it will remain at +/- 30%.

RFP

CLIN0001 –

Page 3 of the RFP, CLIN0001 states that Phase-In is noted as not separately priced (NSP). As the phase in requires significant investment in terms of time period (60 days), personnel and resources, the incumbent Contractor will not be subject to the phase-in and these costs and would have an unfair advantage.

It is an assumption that the incumbent would have an unfair advantage. The Government does not anticipate any amendment to CLIN X001. The Phase-In will remain not separately priced (NSP).

The Government is working on additional Questions & Answers which will be provided as soon as possible.

Can the phase-in service be excluded from the overall price evaluation to mitigate this significant advantage?

4 General Question

General Question

Could you please confirm whether a phase-out period and cost for this service will be required at the end of the contract performance?

The Government is not anticipating a phase-out period at the end of the contract period.

5 General Question

General Question

Would it be possible to be provided with the Contract Manpower Reporting (CMR) data for the previous four years of this contract?

The Contract Manpower Reporting data is confidential data of the current incumbent and this office is not in possession or has access of /to such data.

CLIN0016 –

Is CLIIN 0016 to be used for placing all Administrative, Service call and servicing/Inspection personnel costs as a monthly fixed fee?

Yes, with the exception of material, which shall be charged under CLIN X017.

7 RFP Reference:

RFP CLINs

Under which CLIIN are the repair costs for free-standing and fixed appliance repairs allocated? Are these to be treated as Service call repairs with material costs charged against CLIIN 0017 and Labor costs covered under running personnel costs (Monthly fixed fee regardless of manhours invested)?

The labor for repair of appliances must be invoiced under CLIN X016 “Recurring Maintenance & Work Program (Service Calls). Materials must be invoiced under CLIN X017 “Material”.

CLIN0017 –

Our Interpretation of CLIIN 0017 is that the 450K allocated for the cost of Materials for repairs, with a +/-10% difference prior to a change of contract being possible means that:

If the total expenditure is 10% less than the allocated sum, the contract could be subject to a change for the following year with the allocated funds potentially being reduced. If the total expenditure is greater than 10% of the allocated sum in the financial year, the contract could be subject to a change to increase the allocated funds.

450K is an annual estimated amount and will be allocated based on estimates by the Government at task order level. CLIN X017 “Materials” includes material required for the Performance of the Family Housing Maintenance Services. The estimated amount is provided for each option year. The +/- % variation applies at the task order level. If actual material costs exceed 10% or are less 10% (20% range) then the Government or contractor may seek an adjustment.

The Government is working on additional Questions & Answers which will be provided as soon as possible.

It does not mean that the limit of spend is set to a maximum of 450K and the contractor is expected to fund up to 10% more of the allocated 450K without reimbursement (which could leave a prospective contract partner up to 45K out of pocket).

Is this interpretation correct?

CLIN0017 –

Our Interpretation of CLIIN 0008AB is that the 150K allocated for the cost of purchasing Self-Help Material, with a +/-10% difference prior to a change of contract being possible means that:

If the total expenditure is 10% less than the allocated sum, the contract could be subject to a change for the following year with the allocated funds potentially being reduced. If the total expenditure is greater than 10% of the allocated sum in the financial year, the contract could be subject to a change to increase the allocated funds.

It does not mean that the limit of spend is set to a maximum of 150K and the contractor is expected to fund up to 10% more of the allocated 150K without reimbursement (which could leave a prospective contract partner up to 15K out of pocket).

Is this interpretation correct?

150K is an annual estimated amount and will be allocated based on estimates by the Government at task order level. The estimated amount for CLIN X008AB is provided for each option year. The +/- % variation applies at the task order level. If actual material costs exceed 10% or are less 10% (20% range) then the Government or contractor may seek an adjustment.

13 Pre-Proposal Conference

Preproposal Conference

Can the Government provide additional information regarding the 10% rule for the material CLINs? For example, if EUR 10 were 100% and the contractor’s actual expenses would be EUR 11.50, since actual material cost exceed 10%, the contractor may seek adjustment IAW CLIN X017. In case of adjustment, would the Government then adjust the entire amount (EUR 1.50) or only the amount exceeding the 10% range

(0.50EUR)?

In the provided example, the contractor may seek adjustment for the amount exceeding the 20% range (0.50EUR) only.

17 Column with heading UGS Site Visit

The acronym term UGS is not identified elsewhere in the RFP or PWS. Since this column has values, will the Government identify its meaning and spell out this term?

It is not clear where this acronym was found in the RFP. However, if it is referred to USG, it is an acronym for United States Government.
