Question # Question/Comment Government Response

1442 and Section M – in the 1442 the magnitude of the project is noted as $20 to $100 million. In Section M, Evaluation Factors for Award, the relevant project size is noted a greater than $3,000,000. The Government’s requirement for the work is inconsistent. Is the project value $1M to $5M

Per FAR 36.204 and DFARS 236.204, the magnitude of construction refers to the estimated price range of the anticipated award. Section M references the evaluations factors to be used to make the award, particularly, the past performance factor. Under past performance, there are three (3) elements that the Government will assess: recency, relevancy, and performance quality. For a project to be considered RELEVANT, projects must meet all three criteria of SCOPE, MAGNITUDE, and COMPLEXITY. To meet the requirement of MAGNITUDE, projects that are submitted either through offeror PPQs or ratings received in the Federal Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS) shall be greater than $3M. Any submission of a past project(s) $3M or less will be considered NOT RELEVANT.

1442 and Section M – in the 1442 the magnitude of the project is noted as $20 to $100 million. In Section M, Evaluation Factors for Award, the relevant project size is noted a greater than $3,000,000. The Government’s requirement for the work is inconsistent. Will the Government make the relevant project value(s) greater than $20,000,000?

Please see Response 1.

Section M – for an “Acceptable” evaluation of relevancy, will the Government require at least one project to be greater than $20,000,000 in contract value?

The Government will consider for evaluation completed projects that are greater than $3M. In accordance with Section M of the solicitation, magnitude refers to the value of past performance project information being evaluated and is only one of three criteria that offerors shall meet in order for a project to be considered RELEVANT. Acceptability refers to the Government's overall Past Performance Evaluation Rating of an offeror's proposal.

1442 and Section M – the Government defines “RELEVANT” as “Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation.” Which “magnitude” is the Government referring to, the value of the requirement as noted in the 1442, or the contract value greater than $3,000,000?

Please see Response 3.

1442 and Section M – If the Government’s response to the definition of relevancy is a project greater than $3,000,000, what is the relevance of the Magnitude noted on the 1442 of $20,000,000 to $100,000,000?

Please see Response 1.

FA524025R0001 - AJJW 25-1071M Repair Marbo Bulk Plumbing Station (BPS) Tank 2 and Wells 1 & 3 - Questions & Answers (Q&A)

I have a question about the site visit. Do the attendees need an Andersen Base Pass to access the sites? Or do they need any type of passes to enter Camp Skaggs, where it will be held?

The project site is located outside of the main Andersen Air Force Base and does not require an Andersen Air Force Base Pass.

In the Government’s response to RFI #1, the GOV confirmed the estimated price range of the anticipated award as per Amendment 2 to be in the $10,000,000 to $25,000,000 range.

The GOV further confirmed that the evaluation of criteria in Section M for MAGNITUDE AND COMPLEXITY (GOV emphasis added) is a project greater than $3,000,000. The disconnect between the projected price range of the requirement and allowing projects greater than $3,000,000 to be considered Relevant is a risk to the Government. The proposed design-build requirement is complex and will require significant experience on larger, more complex jobs. Will the GOV please raise the relevancy requirement to a minimum of $10,000,000 to reflect the difficulty and experience required to successfully complete this requirement?

The relevancy requirement is clearly stated in Section M.

In the Basis of Design, Chapter 3 Environmental, it is noted in 3- 1 that Asbestos may be required and testing for hazardous materials will be required on all electrical and process equipment. As this is a Design-Build project and without specific quantities of Asbestos, lead or other hazardous materials to be disposed of the GOV must retain responsibility for this abatement. Please remove this requirement from the contract, or will the GOV retain this scope in the contract but provide for unit price payment for quantities.

Please clarify your question.

Reference Section H - Special Contract Requirements, clause

52.236-1 PERFORMANCE OF WORK BY THE

CONTRACTOR - Since this solicitation is a competitive HUBZone set-aside, please confirm whether it requires the HUBZone-certified company to perform 100% of the work without subcontracting. Specifically, given that the project includes specialized provisions for instrumentation and control (SCADA) equipment, does this mean the contractor must have the in-house capability to perform this work without employing a subcontractor?

No. The prime contractor shall be a HUBZone firm. However they are able to subcontract work out to other small business or specialized firms.

Reference Section H - Special Contract Requirements, clause

52.236-1 PERFORMANCE OF WORK BY THE

CONTRACTOR - Would the Government consider reducing the required percentage of work to be self-performed by the contractor, in order to allow the HUBZone-certified company to fully participate while engaging a highly qualified subcontractor for specialized roles and tasks critical to the project?

Please refer to answer 9.

Reference Section C - Description/Specifications/Statement of Work, clause 252.222-7000 RESTRICTIONS ON EMPLOYMENT OF PERSONNEL. Please confirm whether this solicitation strictly requires the employment of individuals who are residents of Guam for all work performed for this project.

The use of the local workforce shall be to the maximum extent practicable. However, the use of other workers is allowed.

Reference Section C - Description/Specifications/Statement of Work, clause 252.222-7000 RESTRICTIONS ON EMPLOYEMENT OF PERSONNEL. Can HUBZone-certified company hire personnel who are not Guam residents, provided they have valid legal work authorization in Guam, particularly for highly specialized roles such as SCADA technicians, electricians, etc.

Yes.

Reference to Section L - Instructions, Conditions, & Notices to Offerors or Quoters, PART IV - BONDING, BID GUARANTEE, and LETTER OF GOOD FINANCIAL STANDING: Please clarify the actual bonding requirement for this solicitation—is it 100% or 200% of the contract price.

The penal sum of each bond shall be 100% of the proposal price. Please consult with your bonding company for further clarification.

This paragraph states that “To be considered, the contractor must have a letter from an approved surety that states the contractor has a relationship with the company and required bonding capacity has been obtained or will be obtained upon award”. List of certified sureties:

https://www.fiscal.treasury.gov/surety-bonds/list-certified-companies.html. However, clause 52.228-15 Performance and Payment Bonds and 52.228-1 Bid Guarantee – specified the other acceptable security such as postal money order, certified check, cashier's check, irrevocable letter of credit, or, in accordance with Treasury Department regulations, certain bonds or notes of the United States.

Please therefore confirm that the Offeror/Contractor can provide performance bond and bid guarantee in the form of either of the following

- Postal Money Order

- Certified checks

- Cashier’s checks

- Certain Bonds

- Irrevocable letter of credit

- Certain notes of the United States

The bid guarantee shall accompany an offeror proposal (pre-award) . Postal money order, certified check, cashier's check, irrevocable letter of credit, or, in accordance with Treasury Department regulations, certain bonds or notes of the United States are acceptable forms of a bid guarantee.

In the Basis of Design, Chapter 1, section 1-1, the Purpose of the project is stated as producing a 35% Concept Design Package, DD 1391, and cost estimate. This is further supported by reference in section 1-3.3. In subsection 1-4, it is noted that Design Funding is scheduled for FY 26 and construction in FY

27. Please confirm that this is the only scope required, and that full design and construction is not included in this proposal.

This is a Design Build project. The scope of work (SOW), dated 03 February 2025 details the elements of the scope that need to be performed. The Basis of Design was provided as an informational document used to assist with bid preparation. The DD 1391 and cost estimate are NOT part of the scope of this project. Please refer to the SOW.
