Attachment 3 to Pre-proposal Conference Meeting Minutes
Questions and Answers dated 1 Jul 2022
Solicitation No. FA520922R0006
No. Reference Question Answer
Q1. Solicitation 52.228-15 Performance and Payment Bonds-Construction. Jun 2020
There is a description of payment bond as well as performance bond. We believe that payment bond is unnecessary like a usual contract for US military construction in Japan.
Is it right for this project?
In accordance with para H003(a) of Other Contract Requirements at Attachment J-1 of RFP, no payment bond is required for both original contract and each task order.
Q2. J-8 Section M-100, B. Past Performance Factor.
About Past Performance, should we get a questionnaire about a single construction project? Or should we ask the contracting officer to do a survey of the entire contract, such as current SABER, IDIQ, or MACC?
Can you tell us which one is more appreciated?
We accept both Past Performance Questionnaire to the entire contract and single construction project. There is no preference for either project.
Q3. Attachment J-7 Section L-100
1. PART I ‒SUMMARY AND
MISCELLANEOUS DATA
(g) Contractor Teaming Arrangement (if applicable): See Section L, Paragraph L- 100.B.4.(e).
Since the project will be wide range of area in Honshu, we will use subcontractors in wide area. In the attachment J-7, it seems we may need to propose a teaming agreement (If applicable) and instruct “See Section L, Paragraph L-100.B.4.(e).” However, we cannot find Paragraph L-100.B.4.(e). Could you explain it?
This is numbering error. Paragraph L- 100.B.4.(e) will be changed to read L- 100.B.3.(e) under the Amendment 0001.
As for teaming agreement stated in the Attachment J-7 L-100 B.1.(g) teaming arrangement is not required unless contractor certifies itself a “Joint Venture” at paragraph K004 of section J, Attachment J-
1. Otherwise, subcontractors’ past performance information is not considered for evaluation.
Q4. Attachment J-6a SABER SOW (B-21-
213) Atch J-6b DWG (B21213)
We heard that the documents above are only for the references. It means there is no mock project for this solicitation. Is it right?
The Mock Project is reference purpose only.
Therefore, Solicitation, Section J specifies “Note 2: Attachment J-5 thru J-8 will physically be removed from the resultant contract.”
Q5. Attachment J-2 SABER GENERAL
PROVISIONS
1.24.4 Government Supporting Documents
The Government will provide the following supporting documents;
a. Statement of Work (SOW);
b. Preliminary drawings or other forms of conceptual drawings or sketches;
c. Cost estimates;
d. Justification for non-pre-priced items (NPI) if any;
e. Verified as-built drawings if available;
f. Manufacturer's or technical drawings/schematics for fabrication and assembly of structural elements if available;
g. Any special instructions or requirements if any.
h. Performance Schedule such as Preparing of Contractor's Design Supporting Documentation / Supporting Drawings prior to the actual construction, and Construction Period.
From the wording above, will all SABER projects be Design Build projects?
This SABER contract does not anticipate any Design-Build (DB) requirements.
Q6. Attachment J-3 UNIT PRICE GUIDE In the UPG guide, we cannot see the design fee. Could you clarify it?
SABER contract does not require services of a registered architect or engineer. So UPG does not include any design fee.
Q7. Attachment J-7 Section L-100, 3. Could we count the current Army MACC contract itself as one of our PPI?
If so, could 374th Contracting Squadron provide answers to the PPQ?
Yes, you may send out the past performance questionnaire to the appropriate POC in 374 CONS.
Q8. Attachment J-7, Para L-100. B. 3. (b) Can the Past Performance Questionnaires (PPQs) be replaced with CPARS information, if the past performance was ordered by the US government?
Are the PPQ required, even if the past performance was US government contract?
The responsibility to send out the past performance questionnaire rests solely with the offeror.
Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
(see attachment J-7, Section L, Para L-100)
Note the most recent CPARS may not be finalized prior to Award.
Q9. Attachment J-1, Para H010 How often should we expect Unit Price Guides (UPG) are updated?
In accordance with H010(b), UPG may be updated annually by bilateral modification when there are changes to the four publications.
Q10. Attachment J-1, Sec 1 Para B003 (b) Is it possible for the government to provide the number and the total amount of Task Orders each year for reference only?
The Government is unable to commit itself for the number or amount of annual Task Orders anticipated to issue.
Q11. Past Performance Questionnaire Cover Letter
PPQ due date shows “not later than 8 Jul 22”.
However, Solicitation does not specify the different due date for PPQ. Please clarify.
We accept PPQ not later than the due date specified in the SF1442.
