ADDENDUM TO FAR PROVISION 52.212-2, EVALUATION--COMMERCIAL ITEMS

THIS SECTION IS FOR SOLICITATION PURPOSES ONLY. THIS SECTION WILL

BE PHYSICALLY REMOVED FROM ANY RESULTANT AWARD, BUT WILL BE

DEEMED INCORPORATED BY REFERENCE.

Evaluation will be made in accordance with FAR 52.212-2 Addendum of this solicitation.

1. The Government will award a firm fixed-price contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the

Government, price and other factors considered. The following factors shall be used in the following order to evaluate offers:

Part I - TECHNICAL CAPABILITY

Part II - PRICE

2. BASIS FOR CONTRACT AWARD: This is a competitive Lowest Price Technically

By submission of its offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being determined unacceptable. The evaluation process shall proceed as follows:

PART I – TECHNICAL CAPABILITY

1. First, the technical capability of all offers will be evaluated on an ACCEPTABLE /

UNACCEPTABLE basis. Professional Qualifications/Certifications and Past Performance sub-factors will be weighted equally and all areas must have an ACCEPTABLE rating. Because risk of unsuccessful performance is expected to be minimal, risk is not separately evaluated, but instead is included as part of the technical capability and will be evaluated for acceptability only.

2. Evaluators shall assign a rating of ACCEPTABLE / UNACCEPTABLE based on the minimum requirements stated below.

A. Sub-Factor 1 – Professional Qualifications/Certifications

B. Sub-Factor 2 – Past Performance

Past Performance Acceptable/Unacceptable Rating Method

Adjectival Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

1. CRITERIA: Offerors must provide a minimum of two (2) and a maximum of five (5) references of their choice of projects of similar contracts in size and scope as those required by this contract. The past performance questionnaires do not count towards the 15 page limit. The

Offeror must provide for each reference the reference's company name, POCs, address, contact information to include phone number and e-mail address, project description, dollar value and period of performance. The Government will consider and evaluate Offeror's past performance information, to include the references, which are deemed recent and relevant for the requirements of this RFP in evaluation of Offeror’s adherence to period of performance and services performed according to contract specifications without deficiencies. The Government will also use information submitted by the Offeror and other sources such as other Federal

Government offices and commercial sources, to assess performance. Recent and Relevant is defined in the subparagraph below:

i. Recency Assessment: An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past five (5) years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

ii. Relevancy Assessment: An assessment of the recent past performance information will be made to determine whether the provided service performed under those contracts relate to a similar scope as those required by this solicitation. To be relevant, the work must be of a nature, magnitude and scope similar to that required by this contract. Relevant past performance is the operation, maintenance and repair of a central steam/heat plant and the condensate distribution system, Facility Support Services contract, or a utility/energy plant contract, for example.

2. MINIMUM STANDARD OF ACCEPTABILITY: The minimum standard of acceptability is met when the Offeror provides minimum of two (2) and a maximum of five (5) references of their choice of projects of similar contracts in size and scope in which the Offeror adhered to period of performance and services performed according to contract specifications without deficiencies. The Offeror must provide for each reference the reference's company name, POCs, address, contact information to include phone number and e-mail address, project description, dollar value and period of performance. The Government will consider and evaluate

Offeror's past performance information, to include the references, which are deemed recent and relevant for the requirements of this RFP in evaluation of Offeror’s adherence to period of performance/time of service and service according to contract specifications listed in the PWS.

The Government will also use information submitted by the Offeror and other sources such as other Federal Government offices and commercial sources, to assess performance. Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.

Recent and Relevant is defined in the subparagraph below:

i. Recency Assessment: An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 5 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

ii. Relevancy Assessment: An evaluation of all recent performance information obtained to determine whether the provided service performed under those contracts relate to a similar size and scope as those required by this solicitation. In determining the relevancy of effort performed under individual past performance contracts, the Government will consider the specific effort or portion consistent with that proposed by the prime contractor and/or subcontractor. The past performance information obtained from sources will be used to establish the relevancy of past performance.

3. Those offers not meeting the minimum standard for acceptability will not be considered for award. Professional Qualifications/Certifications and Past Performance sub-factors will be weighted equally and all areas must have an ACCEPTABLE rating. The

Technical capability sub-factors ratings of ACCEPTABLE will be required in order to be considered for award.

PART II – PRICE PROPOSAL

A. Next, offers that are deemed technically acceptable shall be ranked according to price, including all aspects of the proposal. The Offeror’s price proposal will be submitted in a separate volume. Offeror’s must complete the Price Schedule, Attachment 2. No price information is to be included in the technical sections of the proposal.

B. For award purposes, the Government will evaluate the total prices in Price Schedule, Attachment 2, including all Option Periods. The Attachment 2, Price Schedule, will be utilized for evaluation purposes only. The total price of the Base or Option Period is the sum of the extended unit prices within the applicable period. The extended amounts for the base period and all option periods will be added together for a total evaluated price. Unit prices shall prevail in the event the extended price is calculated incorrectly. Price Schedule unit prices shall prevail in the event the bid schedule unit price is different. The Government may determine an offer unacceptable if the proposed prices are materially unbalanced, which is defined as significantly understated or overstated in relation to the actual cost of the item or when the price is determined not to be fair and reasonable.
