A. The purpose of this amendment is to answer Questions and Answers related to FY23 ETOC Solicitation and the Seed Project.
F A462023R00020002 Page 2 of5
1. Question: It was mentioned at the site visit that dedicated supervision will be determined on a task order by task order basis.
Please confirm that a dedicated superintendent is NOT required for the seed project.
Answer: Yes, dedicated supervision will be on a task order by task order basis. For the Seed Project Task Order, a dedicated Quality Control Manager or Superintendent is not required. However, a Site Manager is required as a single Point-of-Contact for the Government, and to supervise any construction forces under that manager. The Site Manager is not prohibited from performing work and construction activities for the project.
2 Question: It was mentioned at the site visit that the "Buy America Act" will apply to all task orders. Because multiple items within the SOW such as new wall cabinets, countertops, sinks, cooktop, range hood, etc. (Home Depot brands) are NOT American made, this will drive cost and create substantial lead times for procurement of material. Can the "Buy America Act" be waived or relaxed for this and other task orders requiring material that is readily available off the shelf bit NOT American made?
Answer: No, the Buy American Act cannot be waived. All products for this project must comply with the Buy American Act. The range hood, cabinets/ countertop, and sink fixture can all be found as manufactured in the United States. The Statement of Work (SOW) Attachments which show product data are for salient characteristics only; and are for a Basis-of-Performance only. Any "equal" product, complying with the Buy American Act, is acceptable. It may be difficult to find a two-burner stovetop manufactured in the United States. The USA has trade agreements with various nations. The revised SOW list an example of the stovetop, which is manufactured in Italy and shipped to distributers in the USA. This stovetop is manufactured in Italy, which is an acceptable trade agreement country per the Boy American Act. Refer to Paragraphs 4.2.2, 4.2.3and 4.2.6 of the revised SOW (23R0002_ OPP1134574-Atch10B-Amend02SOW23MAR2023) and SOW Attachments (SOWAtchJAmend02TwoBurnerStovetop andSOWAtchK-Amend02RangeHood) for product "salient characteristics".
3. Question: It was mentioned at the site visit that the BDG will apply to this and other task orders. Will the BDG be enforced on all task orders or will specific sections be identified that must be adhered to. If so, can you identify what sections or applicable BDG requirements we are to follow for the seed project?
Answer: Yes, in general the Base Design Guide applies to all work, unless specifically addressed in the SOW. Revised Attachment L (SOWAtchL-Amend02Submitta1Register), lists the required submittals for this project. SOWAtchM SustainableProcurementStmnt, lists required products for sustainable procurement. Hazardous material and waste disposal requirements are outlined under Section 3 Paragraphs of the SOW. Any deviations from the Division 1 requirements (eg:
O&M Manual content)are specifically listed in the SOW.
4. Question: Will the GC be responsible for Final As-Built updates including ACAD updates or just red line submission at project completion?
Answer: No. There are no AutoCAD documents or Design associated with this project. Thus, there are no updates required. Any changes or alteration from Attachment G -Government Provided Work Plan (SOWAtchG GvntProvidedWorkPlan) shall be redlined on a hard copy and submitted to the Government upon completion of the work.
5. Question: Will Testing of newly installed material be required along with an affidavit to show no ACM or LBP?
F A462023R00020002 Page 3 of5
Answer: Yes. Per Paragraph 3.3 of the revised SOW, new materials used shall be tested for asbestos and lead. Per BOG Section013543 - Environmental Procedures, Paragraph 1.16(A), new materials shall be tested for asbestos and lead, as listed in the paragraph. Anticipated materials to be tested include: gypsum wallboard and compounds, paint, sealants, mastics, sheet vinyl flooring and resilient base. The Contractor shall provide a statement that no products containing ACM or LBP (exceeding 100 ppm) were used. The statement does not need to be from an engineer or AHERA Certified Inspector. Test results shall be included. Refer to attachment23R0002 _ OPPl 134574-Atchl 0B-Amend02SOW23MAR2023 andSOWAtchL Amend02SubmittalRegister.
6. Question: Since the building will be occupied during construction, will the Government move all the furniture and electronics from the work area?
Answer: Yes, the Government will be moved out of the Fourth Floor. Furniture on the Third Floor will be moved to one side of the room to provide adequate access to the electrical panel, and the ceiling area where work is to occur.
7. Question: Because of the limited space within the work area can material be stored on site in a laydown area or connex box?
Answer: Yes, a CONEX storage container will be allowed on the backside of the tower in a parking space. It may not block the front entrance. This will be discussed in more detail following the Contract Award.
8. Question: It was mentioned at the site visit that 3064schedule and 3065 progress reports would not be needed for projects under a certain magnitude and less than 30 days. Because this project has a 45-dayphase 2 duration, will a 3064 and 3065 be required?
Answer: Yes, both the AF3064 and the AF3065 will be required for this project as the period of performance exceeds 30 days as the Government shall make progress payments monthly as the work proceeds. Refer to page49 of 23R0002_SF1442-03NAR2023 and revised SOWAtchL-Amend02SubmittalRegister.
9. Question: Will invoicing for material submittals and material procurement be allowed in Phase 1?
Answer: No, material submittals and material procurement is not allowed to be invoiced during Phase I, as this is not actual work performed.
10. Question: Section 0 1500 Task Order Closeout paragraph2. l states to follow BDG section 017700 for closeout procedures.
Majority of the standard closeout documents will not apply to this and other task orders. Are we still to follow the BDG or will submittal register be scrubbed on a case-by-case basis for applicable items?
Answer: A Submittal Register is provided for this project. One will be provided for each task order with the applicable submittals required by the contractor to provide for Government review. No other submittal beyond those listed will be required. A Limited O&M Manual will be required (Refer to Question 11 below), An Equipment-in-Place List is not required.
There is no training required for this project.
11. Question: Paragraph 3 .2.1 states to follow BDG section0 17823 for O&M Manuals. It was mentioned at the site visit that a scaled down version of the O&M's would be preferred. Please clarify ifwe are to follow BDG ad provide formatted O&M's per BDG section 01783?
Answer: Per Paragraph 4.2.9 of the SOW, a Limited O&M Manual is required. The specific requirements for this manual are listed under this paragraph. An Equipment-in-Place List is not required. The manual does not need to meet the requirements in Section 017823,just those listed in the SOW. An electronic version is required, not a hardcopy.
12. Question: Would the government accept email submissions rather than submissions of CDs/DVDs? We believe seed project pricing will be more competitive ifwe can email our proposal rather an suffer the pricing impact of shortened time constraints of submitting CD/DVDs.
Answer: No. Per Section L, Paragraph 1.10, Offerors shall submit one (1) Electronic (CD/DVD) of Volume I Part 1 and Volume I Partll.
Page 4 of5
13. Question: If CD/DVDs remain a requirement, should Volume I: Part 1 and Volume, Part2: Price Proposal be submitted on separate CD/DVDs, or on the same CD/DVD? If on the same CD/DVD, should they be submitted as two separate files?
Answer: Please refer to Section L, Paragraph 1.10 under Volume Submission Requirements. Volume 1, Part 1: Past Performance and Volume 1, Part 2: Price Proposal to be submitted on one (1) Electronic (CD/DVD).
14. Question: Section D on Section L's Past Performance Information states, "Please indicate whether it was development and/or production, or other acquisitions phase ... " Please clarify the following: Are construction efforts/contracts as a prime contractor considered development? Product? Or another acquisition phase? If another acquisition phase, which phase?
Answer: Section D of the Past Performance Information is asking for the role the company (Prime Contractor or Sub-contractor) had during the project provided for Past Performance whether it was developing the project, providing a product, doing the actual physical work of the project or any other aspect to complete the project.
