Section L - Instructions, Conditions, & Notices to Offerors or Quoters

Miscellaneous text in this section has been modified to:

1.0 General Instructions

To assure timely and equitable evaluation of proposals, offerors shall follow the instructions contained herein.

Offerors are required to meet all solicitation requirements, including, but not limited to: terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of three (3) separately bound volumes and one (1) electronic copy of all volumes, separated, provided on a CD; Volume I - Pricing and Contract Documentation, Volume II - Technical Capability and Volume III - Past Performance Information. Non-conformance with the instructions provided in this RFP may result in an unfavorable proposal evaluation and/or an offer being ineligible for award.

a. The proposal shall be clear, concise, and include sufficient detail for effective evaluation and validation of stated claims. The proposal should not simply rephrase or restate the Government's requirements but, rather, shall provide convincing rationale to address how the offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their experience and will base its evaluation on the information presented in the offeror's proposal.

b. The proposal acceptance period is specified in the SF 1442, paragraph 13(d) of the solicitation. The offeror shall make a clear statement in the SF 1442, paragraph 17 of the proposal documentation volume if their acceptance period differs from the period listed in paragraph 13(d).

c. To be considered responsive to the solicitation, the proposal package shall consist of one (1) copy of the three

(3) separately bound volumes and one (1) electronic copy of all volumes, separated, provided on a CD; Volume I - Pricing and Contract Documentation, Volume II - Technical Capability, Volume III - Past Performance Information and an electronic copy (CD) of the documents. Offerors are responsible for submitting proposals, and any revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. Offerors shall use the transmission methods authorized by the solicitation (mailed/hand carried).

Any proposal, modification, or revision, that is received at the designated Government office after the exact time specified for receipt of proposals is "late" and will not be considered.

*Note: Electronic copy must be on a CD; no other form of electronic copy, i.e. USB, emailed, etc. will be accepted.

d. The offeror shall NOT use the Government's designer of record (DOR) firm for this sample project or any projects awarded under this MACC. If there are questions regarding the Government provided designs the offerors will contact the contract administrator for clarification by submitting an official RFI. Failure to follow these guidelines may result in an offer being ineligible for award.

e. Elaborate brochures or documentation, binding, detailed art work, or other embellishments are unnecessary and are not desired.

f. A mandatory pre-proposal site visit will be conducted for the sample project on 16 November 2021 at 9:00am, 1000 Davis Ave, Barksdale AFB, LA 71110 (307th BW HQ B6803). All prospective Offerors shall RSVP for the site visit with Lt Marco Pirozzoli at marco.pirozzoli.1@us.af.mil or Christopher Mitchell at christopher.

visit. It is the responsibility of each offeror to follow up with Lt Marco Pirozzoli or Christopher Mitchell to confirm receipt of your attendees. To ensure proper guidelines and regulations are met due to COVID-19, facemasks and social distancing will be mandatory for all vaccinated and unvaccinated personnel for this site visit per CDC and Barksdale AFB guidance. Each individual is required to complete and carry a copy of form DD3150 provided as attachment 14 to this solicitation. If the COVID-19 guidelines change, we will arrange for multiple site visits on 16, 17 and 18th of November 2021. Each offeror will be notified if the time of the site visit is changed or scheduled for a different day. Offerors will not be allowed to pick the day or time and will be notified by a representative from 2d Contracting Squadron with their day and time.

g. Information provided at the pre-proposal conference shall not change the terms and conditions of the solicitation and specifications. Failure of a prospective offeror to submit any questions will be construed to mean that the prospective offeror fully understands all requirements of the solicitation. Prospective offerors are advised that the pre-proposal site visit will be held solely for the purpose of explaining the concepts involved in the project and the specifications, terms, and conditions of this solicitation.

h. Questions shall be submitted to Lt Marco Pirozzoli at marco.pirozzoli.1@us.af.mil or Christopher Mitchell at christopher.mitchell.36@us.af.mil no later than five (5) business days after the site visit. All questions and answers will be posted to System for Award management (SAM) at web site http://sam.gov within ten (10) to fifteen (15) business days following the pre-proposal conference. All prospective offerors are advised this solicitation will remain unchanged unless it is specifically amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of any such amendment as described in FAR clause 52.215-1, Instructions to Offerors-Competitive Acquisition, of this RFP shall apply.

i. In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy all extra copies of unsuccessful proposals.

j. Joint Venture Offerors:

If the offeror is a joint venture, the offeror shall provide all required solicitation information for all parties including a copy of the signed joint venture agreement with proposal. The agreement shall include information, which identifies the responsibilities for each entity under this contract. The agreement shall demonstrate the relationship between firms and identify contractual relationships and authorities to bind each entity of the joint venture. Any Joint Venture that requires Small Business Administration (SBA) approval must be approved prior to submitting a proposal for this requirement.

k. Teaming/Partnering Offerors:

If the offer is based on a teaming/partnering relationship, the offeror shall provide all required solicitation information for all parties including a copy of the teaming/partnership agreement. The agreement shall include information, which identifies the responsibilities for each entity under this contract. The agreement shall demonstrate the relationship between firms and identify contractual relationships and authorities to bind each entity of the teaming/partnering relationship. For factors I, II, & III the team/partner shall submit as one offeror.

m. The Government is not responsible for any costs incurred or associated with preparation and submission of a proposal in response to this solicitation.

1.1 General Information

1.1.1 Point of Contact

The Contracting Office is the sole point of contact for this acquisition. Address any questions or concerns you may have to the Contracting Officer (CO) or Contract Administrator (CA) listed in the solicitation. Written requests for clarification may be sent to the email addresses located in Section G of the solicitation or the System for Award management (SAM) at web site http://sam.gov

1.1.2 Debriefings

The CO will promptly notify Offerors of any decision to exclude them from the competitive range or of unacceptable proposals whereupon; they may request and receive a debriefing in accordance with FAR 15.505.

Offerors excluded from the competitive range may request a pre-award debriefing or they may choose to wait until after the source selection decision to request a post-award debriefing. However, offerors excluded from the competitive range are entitled to no more than one debriefing for each proposal. The CO will notify offerors of the source selection decision in accordance with FAR 15.506. Upon such notification, unsuccessful offerors may request and receive a debriefing. Offerors desiring a debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable.

1.1.3 Discrepancies

If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the CO in writing with supporting rationale as well as the remedies the offeror is asking the CO to consider as related to the omission or error. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposals, as received, without discussions. This includes matters of additional or substitute pages of the initial proposal.

1.1.4 Electronic Reference Documents

All referenced documents for this solicitation are available on the System for Award Management (SAM) at website http://sam.gov.

1.2 Organization/Number of Copies/Page Limits

The offeror shall prepare the proposal as set forth in the Proposal Organization Table below. The titles and contents of the volumes shall be as defined in this table, all of which shall be within the required page limits and with the number of copies as specified in Table. The contents of each proposal volume are described in the table below:

1.2.1 Page Limitations

Page limitations shall be treated as maximums. If exceeded, the excess pages will not be read or considered in the evaluation of the proposal. Page limitations may be placed on responses to ENs. The specified page limits for EN responses will be identified in the letters forwarding the ENs to the offerors.

1.2.2 Page Size and Format

A page is defined as each face of a sheet of paper containing information. When both sides of a sheet display printed material, it shall be counted as two pages. Page size shall be 8.5 x 11 inches, not including foldouts.

Except for the reproduced sections of the solicitation document, the text size shall be no less than 10 point.

1.2.3 Pricing Related Data

All pricing information shall be addressed in the Pricing/Contract Documentation volume. All offerors are to use the AF Form 3052 (proposal cost sheet) breakdown provided as Attachment 9 to the RFP for pricing information and include in the Pricing/Contract Documentation volume.

1.3 Distribution

The "original" proposal shall be clearly identified. Proposals shall be addressed to the CO and mailed/hand carried to the address listed below:

Electronic submission of proposals are not permitted for this acquisition. All attempted transmittals of bid information or document not otherwise provided for in this solicitation via electronic means shall be rejected by the contracting officer. Such offerors will not be considered for award and these bids will be declared nonconforming to the invitation for bids.

2.0 Proposal Preparation Instructions

2.1 Volume I - Pricing and Contract Documentation (maximum of 30 pages)

2.1.1 Contract Documentation

2.1.1.1 Model Contract/Representations and Certifications

The purpose of this volume is to provide information to the Government for preparing the contract document and supporting file. The offeror's proposal shall include a signed copy of the SF1442 and any fill-ins listed in Sections I and K. This includes: FAR Clause 52.219-28 in Section I and all the full text clauses in Section K.

NOTE: If the offeror has completed these Section K clauses in the System for Award Management (SAM) database, and no changes have been made, the offeror may state this in their proposal in lieu of completing and submitting these clauses as part of their proposal. All sections of the RFP, excluding Instructions to Offerors (Section L) and Evaluation Procedures (Section M), constitute the model contract.

2.1.1.1.1 Section A - Solicitation/Contract Form

Completion of blocks 14, 15, 17, 19, and 20A and signature and date for blocks 20B and 20C of the SF1442. An official having the authority to bind your company contractually must sign and date the SF1442. In doing so, the Offeror accedes to the contract terms and conditions as written in the RFP. In addition, offerors must acknowledge any and all amendments to the solicitation.

2.1.1.1.2 Section B - Supplies or Services and Prices (Attachment 9) Provide a breakdown of the major elements of your cost proposal to include, at a minimum, design costs to complete the design to 100%, and construction costs to include materials, labor, equipment, and any other significant cost items relevant to this project using the attached AF Form 3052 provided as Attachment 9. You may add additional items to this form (breakdown) as you deem appropriate for your proposal. Offeror is also required to submit the financial information request provided as Attachment 7.

2.1.1.2 Exceptions to Solicitation Requirements

Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors.

Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. Provide rationale in support of the exception and fully explain its impact, if any, on the performance, schedule, and price.

2.1.1.3 Authorized Offeror Personnel

Provide the name, title, and telephone number of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.

2.1.2 Volume I - Price and Contract Documentation (Factor 2)

2.1.2.1 Price Reasonableness and Price Realism

This section is to assist you in submitting required documents to evaluate the price reasonableness and price realism and to ensure the proposed price is not unbalanced. The proposed prices will be evaluated to ensure the price is fair and reasonable. Price realism may be used to determine unrealistically low or high proposed prices, initially or subsequently. Unbalanced pricing poses an unacceptable risk to the Government and an offeror's proposal found to be unreasonable, unrealistic or unbalanced may result in the offeror's proposal being rejected.

The burden of proof for credibility of proposed prices rests with the offeror.

2.1.2.2 Price Data

Data beyond that required by this instruction shall not be submitted, unless you consider it essential to document or support your price position. All data relating to the proposed price, including all required supporting documentation, must be included in the section of the proposal designated as the Price volume. Under no circumstances shall this data and documentation be included elsewhere in the proposal.

2.1.2.3 Cost or Pricing Data Requirements

In accordance with FAR 15.403-1(b) and 15.403-3(a) data other than certified cost or pricing data may be required to support a determination of price reasonableness. Data shall be provided in accordance with FAR 15.403-5. If, after receipt of proposals, the CO determines that there is insufficient data available to determine price reasonableness and none of the exceptions in FAR 15.403-1 apply, the offeror shall be required to submit additional cost or pricing data.

2.1.2.4 Rounding

All dollar amounts provided shall be rounded to the nearest dollar.

2.2 Volume II - Technical Capability (Factor 1) (maximum of 40 pages)

2.2.1 General

The Technical Capability volume shall be prepared in accordance with these instructions and shall be evaluated in accordance with the evaluation criteria and evaluation standards in Section M, Evaluation Factors for Award.

Technical proposals shall include necessary information to enable the evaluators to form a definitive conclusion concerning the offeror's ability to perform the required construction and design-build services. Do not merely reiterate the objectives or reformulate the requirements specified in the solicitation.

2.2.2 Format and Specific Content

2.2.2.1 Subfactor 1: Representative Project Design:

i. Representative project: WEST GATE VISITOR CENTER

ii. Project Magnitude: Between $500,000 and $1,000,000 IAW FAR 36.204(e)

The offeror must prove they understand the Representative Project Design and their proposal fully and accurately addresses the criteria below:

a) Specifications: The 35% design specifications will be evaluated to ensure each of the disciplines are completely and accurately addressed, correct design guidance/criteria is used, and the specifications match the drawings, calculations, and rest of the design package.

b) Plans (Drawings): The 35% design drawings will be evaluated to ensure each of the disciplines are completely and accurately addressed, correct design guidance/criteria is used, and the drawings match the specifications, calculations, and rest of the design package.

To receive an "acceptable" rating, the contractor's specification and drawings must be complete, accurate, and in accordance with "Whole Building Design Guide" standards.

2.2.2.2 Subfactor 2: Representative Project Technical Construction approach:

The offeror shall address their technical narrative (approach) for meeting the Government's minimum performance or capability requirements of the specifications. At a minimum, the technical approach narrative shall consist of a detailed and project specific summary of the technical approach the Contractor intends to employ during construction of the sample project.

2.2.2.3 Subfactor 3: Bonding Capability

Offeror must provide evidence it is able to obtain the maximum single award/task order performance and payment bonding capacity of $1M and a minimum aggregate bonding capacity of $10M. At a minimum, the Offeror must submit bonding capacity documents that meet the aggregate and project amounts, backed by a bonding surety with a best company rating of 'A'. The document must also include the surety company's name, address, phone number, and points of contact.

2.3 Volume III - Past Performance (Factor 3) (maximum of 30 pages)

2.3.1 General

When addressing past performance evaluation criteria set forth in this solicitation, the Offeror shall provide recent and relevant information regarding an Offeror's actions under previously awarded contracts. Recent past performance is defined as any work completed within the past five (5) years from the issuance of this solicitation, to include on-going contracts. Relevant past performance submitted for construction must be valued at no less than $500,000.00. Relevant past performance submitted for design must be valued at no less than $50,000.00. Oferrors may submit no more than five (5) past performance references to be evaluated by the Government.

Offerors shall submit projects in which they have performed as the Prime Contractor managing either the Construction portion, Design portion or both portions of the project. However, if submitting as a teaming agreement or as a formal Joint Venture between a Construction and Design firm, Offerors may use past performance references from either firm. All past performance submissions must meet the following criteria:

a) Design and Construction projects submitted shall include experience in the disciplines listed below (Table 1 - General Project Design/Build Experience)

b) Offerors must submit recent and relevant projects for both design and construction projects covering the five

(5) disciplines (i-v) (see Table 1 - General Project Design). One or multiple disciplines for construction, design, or both may be covered in each project.

d) Each past performance reference must include the following information:

1. Contracting Agency/Customer Name

2. Contract Number

3. Contract Type, i.e. Firm Fixed Price, Cost, etc.

4. Project title and brief description of the contract effort (See note below)

5. Period of Performance

6. Contract value at time of award

7. Current value (or final value if complete), including all changes and exercised options

8. Contracting Officer's name, address, and telephone number and email address if available

Note: Description of applicable work must be detailed and include enough data in order for the Government to verify it was in the criteria, and of sufficient quantity to meet or exceed the dollar threshold.

a. An example of work description that will not meet the standard is "repaired 200 car parking lot".

b. An example of work description that will meet the standard is as follows: constructed 1/2 mile two lane access road with type F curb and gutter system. Access road lot included over 5,000 SYs of pavements. Scope included clearing and grubbing existing site, and bringing in suitable fill material to level the road bed.

Construction was 8" lime rock base, 2" S1 structural course, and 1" surface course.

2.3.2 Additional Past Performance

The Offeror shall forward a copy of the past performance questionnaire (Attachment 11) to their most recent references, for whom the Offeror has contracted similar services with Federal, State, and Local Governments. If the offeror does not have Government references, the Offeror shall provide references from private industry sources that are not prohibited from furnishing information to the Government. The questionnaires must be forwarded to a verified point of contact at each of those agencies or business organizations for completion. Prior to forwarding the questionnaire to each reference, the Offeror shall complete the section entitled "Contractor Information". Offerors may include with their proposal information on problems encountered on the identified contracts and the Offeror's corrective actions. The Government will consider this information as well as information obtained from any other sources when evaluating the Offeror's past performance information.

A cover letter (Attachment 10), accompanying the Past Performance Questionnaire, requests the reference complete the questionnaire and fax it to (318) 456-3294, Attention Lt Marco Pirozzoli and Chris Mitchell or email marco.pirozzoli.1@us.af.mil or christopher.mitchell.36@us.af.mil. Questionnaires must be received no later than the proposal due date. Offerors are responsible for ensuring their reference sources receive the questionnaires in time to complete and return them to the 2d Contracting Squadron no later than the proposal due date.

Other Present/Past Performance Information: Offerors are encouraged to include information relevant to the following:*

(1) Professional/Industry Awards (Identify award type, date of award and copy of certificate if applicable.)

(2) Letters of appreciation, recognition or commendation, etc. received on behalf of customer may be submitted.

*This information, if provided, shall be limited to the past five (5) years from solicitation due date.

2.4 Electronic Copy

The CD shall contain all three (3) volumes mentioned in paragraph 1.2 above. The volumes shall be separated into three separate files to include any amendments to this solicitation. The CD copy shall not have any documents password protected.
