SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
INSTRUCTIONS OF OFFERORS
PROPOSAL PREPARATION INSTRUCTIONS
This section provides general guidance for preparing proposals, as well as specific instructions on the format and content of the proposal.
1. Submission of Offers: This firm fixed-price contract is being issued as an unrestricted solicitation. The Contracting Officer has determined there is a high probability of adequate price competition in this acquisition.
Upon examination of the initial offers, the Contracting Officer will review and determine if, in the Contracting Officer's opinion, adequate price competition exists and no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the Contracting Officer determines that adequate price competition no longer exists or that additional data other than certified cost or pricing data, as appropriate, for the Contracting Officer to determine price reasonableness.
Proposals must be complete, self-sufficient, and respond directly to the requirements of the Request for Proposal (RFP). Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The Government intends to evaluate offers and award this firm fixed-price contract without discussions. However, the Government reserves the right to conduct discussions if deemed in its best interest. Therefore, the offeror’s initial proposal should contain the best terms.
Proposals shall be prepared in three (3) volumes; and clearly labeled as appropriate. Specific guidance regarding content of these volumes is discussed below.
2 Construction of Volumes: Each volume shall be organized to prevent extensive searching throughout the document(s) to locate and evaluate any items or area. All proposals shall contain the evaluation requirements stated herein. All written information and data shall be in an 8 ½” x 11” sheet size format, text shall be single spaced and printed black on white paper (black and white requirement does not apply to graphics, photos, etc.) and shall be provided in an appropriate sized 3–ring binder, not to exceed 3.” Pitch size shall not less than 10 pitch. Legibility, clarity, coherence, and the contents are important. Contents shall follow the order of the evaluation criteria and pages shall be numbered. Only written proposals will be accepted. Oral, electronic, and facsimile proposals will not be accepted. Offers that do not meet these requirements may be subject to rejection.

2. Cover Letter: A cover letter identifying the offeror and the project shall be included in Volume I must include the following:
(1) Solicitation number.
(2) Name, address, e-mail, and telephone and facsimile numbers of the offeror.
(3) Names, titles, e-mail, and telephone and facsimile numbers of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this solicitation.
(4) Name, title, and signature of the person authorized to sign the proposal.
3. Table of Contents: The proposal shall contain a detailed Table of Contents. The complete Table of Contents shall be included in each binder used.

Offerors shall ensure the Standard Form 1442 with amendments, if any, are acknowledged, signed and dated by a person legally authorized to bind the company. Ensure Blocks 14, 15, 16, 17, 19, 20A, B, and C, 22 and 30A, B, and C are completed. In doing so, the offeror accedes to the contract terms and conditions as written in sections A through J of the Request for Proposal. These sections constitute the contract.
VOLUME I – TECHNICAL
At a minimum, the submission shall be prepared in a form consistent with the evaluation criteria for award set forth in Section M of this solicitation. All information the offeror deemed appropriate to address these criteria should be included in the proposal in an orderly format following the evaluation criteria. To facilitate evaluation, Volume I should be specific, detailed, and clearly demonstrate that the offeror has a thorough understanding of the requirement for the accomplishment of this effort. Statements that the offeror understands, can, or will comply with the specifications, and phrases such as "standard procedures will be employed", or "well known techniques will be used" etc., will be considered Unacceptable. Offerors should note that data previously submitted under any prior or existing contract or solicitation will not be considered. Therefore, such data should not be relied upon, nor incorporated in the technical proposal by reference.
VOLUME I (TECHNICAL) SHALL NOT CONTAIN ANY PRICES OR PRICING INFORMATION
Volume I (Technical) is limited to no more than 25 pages. Submit original plus three (3) copies.
VOLUME I (TECHNICAL) CONTENTS
Technical Sub-Factor 1 – Bituminous Pavements:
Offerors shall document the capability to produce or purchase the material requirements of sections 02551 of the contract specifications, with emphasis on minimum delivered temperature. Offerors who propose to purchase bituminous pavement must also address and ensure their ability to procure these materials without interruption or delay to support task orders placed under the resultant contract.
Technical Sub-Factor 2 - Concrete Pavements Repair:
Offerors shall document the capability to execute the requirements of section 03320 of the contract specifications.
Offerors who propose to purchase concrete pavement must also address and ensure their ability to procure these materials without interruption or delay to support task orders placed under any resultant contract.
Technical Sub-Factor 3 - Exposed Aggregate Troop walk:
Offerors shall document the capability to execute the requirements of section 02511 of the contract specifications, with emphasis on troop walk placement and finishing. Offerors who propose to purchase concrete pavement must also address and ensure their ability to procure these materials without interruption or delay to support delivery/task orders placed under any resultant contract.
Technical Sub-Factor 4 – Testing:
Offerors shall address their ability to accomplish all required testing as stated throughout the contract specifications, and in section 01010, with special emphasis on the qualifications and certifications of the offerors designated testing laboratories.
Technical Sub-Factor 5 - Heavy/Special Paving Equipment:
Offerors shall address their ability to access all required heavy/special pavement equipment whether through ownership, lease, or subcontract, that will be used to support task orders places under the basic contract.
VOLUME II – PAST PERFORMANCE - Limited to no more than five (5) contracts/jobs referenced with no more than six (6) pages per contract/job listed. Only references for relevant work is requested. Submit original plus three (3) copies. Limited to no more than 30 pages total. Past Performance Questionnaire do not count against the page total.
i. The offeror shall include up to five (5) of the most recent (within 3 years from the date of issuance of the solicitation, except that ongoing programs must have begun no less thaqn three (3) months from issuance of the RFP) and relevant contract or project references (whether federal, state or local government or private industry for the prime contractor, and significant subcontractors). Relevant performance includes performance of efforts involving major road construction and repair similar in scope, magnitude and complexity to the effort described in this solicitation.
ii. At a minimum furnish the following information for each contract listed:
(1) Company/Division name
(2) Product/Service
(3) Contracting Agency/Customer
(4) Contract Number
(5) Contract Dollar Value
(6) Period of Performance
(7) Verified, up-to-date name, address, FAX & telephone number of the contracting officer
(8) Comments regarding compliance with contract terms and conditions
(9) Comments regarding any known performance deemed unacceptable, or not in accordance with the contract terms and conditions.
iii. The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition.
iv. If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent past/present performance information on previous teaming arrangements with same partner. If this is a first time joint effort, each party to the arrangement must provide a list of past and present relevant contracts.
v. The offeror shall ensure that the Past Performance Questionnaires are provided to the referenced points of contact. Completed questionnaires shall be sent directly to the government by the companies completing the questionnaire. Companies completing the questionnaires should email the completed Past Performance Questionnaire to Daniel Newell via email at daniel.newell.4@us.af.mil or delivered to address below. Past Performance Questionnaires must be received before the Request for Proposal close date and time.

VOLUME III – PRICE – Page count limited to the requirements below. Submit original plus three (3) copies.
i. Insert proposed unit and extended prices for the Contract Line Items Numbers (CLINs).
ii. Insert proposed unit and extended prices in Section B for each Contract Line Item Number (CLIN) or Sub CLIN (SCLIN). The extended amount must equal the whole dollar unit price (limited to two (2) decimal places) multiplied by the number of units.
iii. Attachment 6, Seed Project. Complete the Cost Estimate Breakdown Worksheet. Insert proposed estimated quantities, unit prices, and total price for each CLIN.
iv. Attachment 9, Repair Scherz Blvd. Complete the Cost Estimate Breakdown Worksheet. Insert proposed estimated quantities, unit prices, and total price for each CLIN.
v. Complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned in its entirety. For Sections C through I, the offeror shall submit only those pages that require a fill-in.
vi. Acknowledgement of all amendments as applicable to the solicitation in accordance with the instructions on the Standard Form (SF) 30, Amendment of Solicitation/Modification of Contract.
vii. If the offeror is a Large Business, a draft Sub-Contracting Plan is required to be submitted with their proposal.

(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

(e) Offerors are requested to submit questions to the point of contact noted above not later than N/A. Information provided at this conference shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.
(f) A record of the conference shall be made availalbe via FBO. All prospective offerors are encouraged to register as an interested vendor to recieve system generated notices.

SECTION M - EVALUATION FACTORS FOR AWARD
EVALUATION FACTORS
BASIS FOR CONTRACT AWARD
This section provides general guidance for the method of evaluation of proposals.
This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15, Contracting by Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement (AFFARS), DoD
Source Selection Procedures, Appendix A, 04 March 2011 and Air Force Mandatory Procedures 5315.3 04 May 2011. These regulations are available electronically at the Air Force (AF) FAR Site, http://farsite.hill.af.mil.
Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award will be made to the Acceptable offeror with a (1) Technically Acceptable proposal (2) Acceptable Past Performance and
(3) The lowest TEP, which is deemed to be reasonable and balanced. The evaluation process shall proceed in accordance with (IAW) the evaluation instructions listed below.
Prior to any evaluations, the Source Selection Evaluation Team (SSET) will capture the TEP, to include all CLINs, for each offer and rank them lowest to highest. After they are arranged the evaluations will begin for the three lowest priced proposals. First, the Technical Volume (Volume I) will be evaluated. Second, the Past Performance Volume (Volume II) will be evaluated for all technically acceptable proposals. Proposals that have been rated as "Acceptable" in both the Technical and Past Performance factors will then be evaluated based on the reasonableness and balance of the price. The lowest priced proposal, found to be reasonable and balanced, and has been rated “Acceptable” in both technical and past performance factors will be awarded the contract.
If any of the three lowest offeror’s are deemed unacceptable regarding Technical and/or Past Performance the next lowest proposal(s) will be evaluated in accordance with the evaluation instructions listed (in paragraph B and C) below ensuring at least two acceptable proposals are able to be compared for competitive pricing.
By submission of its offer, the offeror is required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors and sub-factors. Failure to meet a requirement may result in an offer being ineligible for award.
All offers receiving an unacceptable rating shall be determined outside the competitive range. Offeror must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

The proposals will be evaluated on the basis of the evaluation factors listed below. These primary areas of importance comprise the decision making process to be used in determining which proposals are acceptable.

B. FACTOR I: TECHNICAL (VOLUME I)
The offeror’s technical capability will be reviewed and assigned one of the following ratings listed in Table A-1 below. The rating represents whether the offeror’s technical proposal meets the requirements IAW the stated evaluation criteria and solicitation requirements set forth in Section L.

Provide all documentation of each factor and subfactor demonstrating the minimum performance or capability requirements specified in Section L of this solicitation.
Unacceptable
Does not provide all or some of the documentation of each factor and subfactor demonstrating the minimum performance or capability requirements as specified in Section L of this solicitation. Proposals with an unacceptable rating are ineligible for award.
Evaluation Process:
The Government technical evaluation team shall evaluate the Technical Volume (Volume I), assigning ratings of Acceptable or Unacceptable. The technical team will evaluate all technical sub factors below for the offeror; the evaluation will result in an overall technical rating of “Acceptable” or “Unacceptable” as defined in Table A-1.
During the technical evaluation each sub-factor will get a rating, and all sub-factors have to be acceptable in order for the technical proposal to be rated acceptable overall.
Technical Sub-Factor 1: Bituminous Pavements
Did the offeror demonstrate understanding and capability of meeting minimum performance and capability requirements of section 02551 of the contract specifications, with emphasis on minimum delivered temperature? In addition, did the offeror demonstrate their ability to procure materials without interruption or delay to support task orders placed under any sesultant contract?
Technical Sub-Factor 2: Concrete Pavements Repair:
Did the offeror demonstrate understanding and capability of meeting minimum performance and capability requirements of section 03320 of the contract specifications? In addition, did the offeror demonstrate their ability to procure materials without interruption or delay to support task orders placed under any sesultant contract?
Technical Sub-Factor 3: Exposed Aggregate Troopwalk
Did the offeror demonstrate understanding and capability of meeting minimum performance or capability requirements of section 02511 of the contract specifications, with emphasis on troopwalk placement and finish? In addition, did the offeror demonstrate their ability to procure materials without interruption or delay to support task orders placed under any sesultant contract?
Technical Sub-Factor 4: Testing
Did the offeror address the requirement to accomplish testing as stated throughout the contract specifications, and in section 01010, with emphasis on the qualifications and certifications of the offerors designated testing laboratories?
Technical Sub-Factor 5: Heavy/Special Pavement Equipment
Did the offeror demonstrate the capability to access all required heavy/special pavement equipment to meet minimum performance and capability requirements of the contract specifications?
C. FACTOR 2: PAST PERFORMANCE (VOLUME II)
The purpose of the past performance evaluation is to allow the Government to assess the offeror’s ability to perform the efforts described in this RFP based on the offeror’s demonstrated present and past performance. The Government will seek recent and relevant past performance information from: (1) past and present efforts provided by the offeror (using questionnaires, forwarded by the offeror to past or current customers) and (2) data independently obtained from other Government (i.e. PPIRS, FAPIIS) and commercial sources. The evaluation process will rate past performance on an “Acceptable” or “Unacceptable” basis. The offeror must receive a past performance rating of “Acceptable” to be eligible for award.
Definition of Past Performance Ratings (Table A-2)

Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort or the offeror’s performance record is unknown.*
Unacceptable
Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
* In the case of an offeror without a record of recent/relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
Evaluation Process:
The Government will evaluate past performance to assess how well the offeror performed work relevant to the type of effort and type of requirement described in the solicitation as an indicator of an offeror’s ability to perform the contract successfully. The Government will use the following procedures in evaluating past performance:
(1) The past performance evaluation will be accomplished by reviewing aspects of the offeror’s relevant and recent past performance. An “acceptable” or “unacceptable” rating will be established through an integrated analysis of the recency/relevancy and performance on all efforts evaluated for the offeror. IAW
FAR 9.104
(a) Recency Assessment:
(i) Performance that has occurred within the last three (3) years of the date of this solicitation, except that ongoing programs must have begun no less than three (3) months from issuance of the RFP. All past performance documentation will be determined to be “recent” or “not recent”. In addition, if the past performance submission is determined “not recent” it will not be evaluated for relevancy.
(b) Relevancy Assessment:
(i) Past and present efforts provided by the offeror (using questionnaires, which are forwarded by the offeror to their selected sources);
(ii) Data independently obtained from other Government and commercial sources. The past performance evaluation will take into account past performance information regarding predecessor companies, key personnel, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition. The past performance evaluation may also consider the past performance of affiliated companies or operating divisions within the parent company or joint ventures of the parent company when it is reasonable to attribute the experience of these past efforts to the proposed effort and when the proposal clearly demonstrates the resources (e.g. financial resources, overall oversight and management or other resources) of the parent or affiliated division will meaningfully affect performance of the instant acquisition. The past performance of teaming partners or subcontractors who are proposed to perform less than 10% of the work and/or are not proposed to perform critical aspects will not be evaluated.
(iii) Relevant performance includes performance of efforts involving requirements that are similar in scope, magnitude, and complexity to the effort described in this solicitation. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor.
(iv) All past performance submissions will be determined to be “relevant” or “not relevant.”
Furthermore, if the past performance submission is determined “not relevant,” then performance will not be assessed.
(c) Performance Assessment:
(i) The performance assessment may reveal positive or adverse past performance information.
Adverse is defined as past performance information that supports an unsatisfactory rating on any evaluation element or any unfavorable comment received from sources without a formal rating system. Multiple ratings of less than “Satisfactory” in Contractor Performance Assessment Reporting System (CPARS) and/or Past Performance Questionnaires (PPQs) may result in a performance quality assessment rating of “Unacceptable.” Offerors may be given an opportunity to respond to adverse past performance information for which they have not previously had an opportunity to address in accordance with FAR 15.306.
(ii) For adverse information identified, the evaluation will consider the number and severity of the problem(s), mitigating circumstances, and the effectiveness of corrective actions that have resulted in sustained improvements. Process changes will only be considered when objectively measurable improvements in performance have been demonstrated.
(iii) Failure to receive an “Acceptable” past performance rating will result in the entire proposal being eliminated from the competition.
The past performance team will integrate the recency, relevancy and performance on all the efforts evaluated for the offeror; the integration will result in an overall Past Performance Evaluation rating of “Acceptable” or “Unacceptable" as defined in Table A-2.
D. FACTOR III: PRICE (VOLUME III)
Offerors whose price factor is determined to be unreasonable or unbalanced may not be considered for award.
The Government will only evaluate the pricing for proposals that have been rated as “Acceptable” in both Technical and Past Performance. Any other data provided by the offeror with their price proposal that is not required by Section L will not be considered or evaluated. TEP will be calculated by totaling all CLINs in Section B.
(1) The offeror’s price proposal will be evaluated for award purposes, based upon the total evaluated price (TEP) for basic requirements (basic award) and all ordering periods. The Government will first conduct an initial review of the overall proposed pricing and rank the offerors from lowest to highest based on TEP.
Then the three lowest TEP will be identified and evaluated in accordance with instructions listed below.
(2) Reasonableness: The price information submitted in each offeror’s price proposal, as required by Section
L will be evaluated to determine if proposed prices are fair and reasonable IAW FAR 15.404 (which may include, but not limited to, one or more of the following proposal analysis techniques listed below). A contract will not be awarded to an offeror whose price is not determined to be fair and reasonable.
a. The Government may use any of the following price analysis techniques IAW FAR 15.404-1(b) to determine price reasonableness: comparison of proposed prices received, comparison of previously proposed prices and previous Government and commercial contract prices, use of parametric estimating/rough yardsticks, comparison with competitive published price lists or market prices, comparison with independent Government cost estimates, comparison with market research, and analysis of pricing information provided by the offeror.
b. If the proposal analysis techniques listed above are insufficient to make a determination of price reasonableness or, if the Contracting Officer determines that adequate price competition no longer exists, the Contracting Officer may request submission of certified cost or pricing data or other than certified cost or pricing data, as appropriate, and/or may use other proposal analysis techniques as described in FAR 15.404, to the extent necessary, in order to make a determination of price reasonableness.
c. If the proposal analysis techniques listed above are insufficient to make a determination of price reasonableness, the Contracting Officer may request data other than certified cost or pricing data and/or may use other proposal analysis techniques as described in FAR 15.404-1, to the extent necessary, in order to make a determination of price reasonableness.
(3) Unbalanced Pricing: The Government will analyze proposals to determine whether they are unbalanced with respect to prices and separately priced line items in accordance with FAR 15.404-1. An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
(4) Failure to comply with these provisions may constitute sufficient cause to justify rejection of a proposal.
(5) The offeror’s Small Business Subcontracting Plan will be evaluated against the subcontracting plan requirements outlined in FAR 19.704.
(6) Attachment 6, the Cost Estimate Breakdown Worksheet will be evaluated for completeness.
(7) Attachment 9, Repair Scherz Blvd will be reviewed for completeness (Applicable CLINs and Unit Prices MUST be provided) but will not be part of the evaluation for award. Note that it is the Government’s intention to award this project in fiscal year 2016, or early 2017, should funds be made available.
E. SOURCE SELECTION
(1) The team will then compile all the data and present their findings and recommendations to the Source
Selection Authority (SSA) who will determine which eligible Offeror meets the Government’s requirements of Technically Acceptable, Acceptable Past Performance and lowest proposed price which represent the best value to the Government.
(2) The solicitation requirements include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation. Award will only be made to an offeror who is deemed responsible and, whose proposal conforms to the Request for Proposal (RFP) requirements.
F. ADDITIONAL INFORMATION
(1) Offeror’s may be asked to clarify certain aspects of their proposal to resolve minor or clerical errors and will not constitute discussions. The contracting officer reserves the right to award a contract without the opportunity for proposal revision.
(2) The Government intends to evaluate proposals and award a contract without discussions. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, in accordance with FAR 15.306 (c)(1) a competitive range will be established consisting of the most highly rated proposals based on the evaluation of each proposal against all the evaluation criteria. Additionally, in accordance with FAR 15.306 (c)(2) the Government reserves the right to further reduce the competitive range based upon efficiency concerns. The Government may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
The offerors responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror's proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the FPR are subject to evaluation and may introduce risk that the offeror's proposal be determined unacceptable and ineligible for award.
